  1. Read the instructions on the form (see page 8 filing fee). I believe you don't have to pay but I dont know if your AOS is based on K1. Fortunately I did not have to renew my EAD, but I was very close to reach the boiling point.

    My AOS is not based on K1 so guess I don't need to pay extra fees. That makes every thing easier. Thanks Chris!

  2. We did our interview on 01/12/2015. Location - Dallas field office.

    I did a Info pass this Monday, 3/9/2015. The officer is really new. He took my I 485 receipt to make a copy and never gave it back (BTW,should I visit them again to get it back? I called USCIS customer service and they said it's fine not to have it since I already did the interview.)

    According to the officer, the latest update was that the IO gave the case to the supervisor for review last week. Does it mean that the supervisor just started to review it and I might need to wait for another 2 months?

    My husband was married to his high school sweet heart 10 years ago and sponsored his ex-wife GC. I understand that they need to review it more but come on, 50 days to pass it to a supervisor??!!

    Should I try to contact Senator if I don't hear back from them for about 2 weeks?

    But, isn't Info Pass a phone system?

    If yes, how is it affected by bad weather?

    And when you say 'visit,' do you mean go to a physical location, or merely talk on phone?

    Info pass = an appointment with USCIS officer at USCIS field office

    You can schedule it either on line for through the phone.

    There was a ice storm in DFW area so I couldn't make it to the office.

    I was planning to visit info pass yesterday but had to reschedule it due to the bad weather. I haven't received any update yet.

    But my case had everything fine and good to be approved. lets wait

    I thought my case was perfect at first too until officer started to question my husband's previous marriage. We didn't prepare too much about his previous marriage since he was married to his high school sweet heart at 22 and divorce was finalized at his age of 29.

  6. Your interview went good? My intervire didnt last more than 10 minutes, only basic questions. I hope i get as soon as possible, im tired of uscis delays lol

    Probably not that good since I answered my husband's birthday wrong and his mom's maiden name wrong (I answered his mom's married name). But I don't really think that's the issue. It's more like they are observing you and your spouse rather than the answers during the interview.

    The office spent time asking my husband's previous marriage. Even asked where the ex wife is from and if she is a citizen now. Another fact is that we don't have a wedding or engagement ceremony. So these might be red flags. But at the same time, we lived together 1.5 years before we got married (I am pretty sure that the background check would show that or the drive license copies or the credit report?) and we bought a house together once got married. My point is, you never know which parts would get USCIS suspicious.

    I am just pretty sure that my case would definitely not get approved on the spot....

  7. I went to Dallas office for interview on 1/12/2015 and my case is still held for reviewing. But mine is kinda special because my husband was married before and his ex-wife received green card through him like 8 years ago. A supervisor definitely needs to review my case but I don't know how long it's gonna take.

    Unless you have such a situation like me, otherwise you should be able to receive update in 30 days based on my research.

  8. You are right by many things you said, however you don't seem to see it clearly.

    You are right that was foolish to be overconfident and not prepare, but the reason to that was because of your specific case.

    You may have believed that your case was all straight, and there was all good, but that was your biggest mistake of them all.

    You should have discuss your case much sooner.

    There is a reason for all the questions asked on the forms. Knowing your previous marriage and if you are the first person your spouse has ever petition for, is one of the big ones.

    Going by your timeline and story, your case is a great candidate to be looked under the microscope.

    You two started to date just months after he separate, plus he was still legally married.

    Before you went for an interview you were already in trouble, failing as you did just may have made things worse.

    Your mistake would have been major, and since your husband did not know the answer, he should of answer "I don't know" instead of what he replied.

    Saying all this, now is too late to think of all the wrongs. Actually thinking and reacting to it, in my opinion, would be a great mistake.

    Trying to defend your actions would just make things worse.

    You should bring to your spouse, that his previous marriage is very important on the eyes of the government, considering the circumstances, and you too needs to know your case.

    Being together on this, and working out as a team is very important (you two are married, you should be doing this regardless of what you are facing).

    I really hope for your sake that they will see good on your interview and you guys don't get someone investigating you two, but you should be prepared for the worse, and when I say this, I mean try dealing intelligently with what you should expect the worse be, and at the same time show how much love you have for each other. If that fails, nothing will prevail.

    Thanks for the reply! Yes you are right. We didn't realized that we were already in trouble because of his previous marriage until the end of the interview.

    But I want to address one thing that we have disclosed everything on the I-130 form ( about his previous marriage and petition history) and enclosed the court record of the divorce when we submitted the AOS package. It's just that my husband was not willing to elaborate/explain anything during the interview and it made us look bad. :sleepy:

    I definitely agree that a higher level supervisor needs to review my case. But I don't agree that it has something to do with my F1- H1B visa status. After thinking/sorting everything out about 1 week, I can say that my husband's previous marriage, his marriage GC sponsor history and the not prepared interview are the reasons that we are not approved on the spot.

    Honestly, I am a little bit disappointed too. I thought the fact that my husband and me bought a house (co-signed a loan) together 2 months after we got married should be convincing since that's a huge part of American family values. Anyway, me and my husband have been prepared for the worse and I will keep you guys updated.

    When you say "your type of AOS", do you mean due to my husband's sponsor history , they need a higher rank IO to review the case?

    No wonder that IO never turned on his computer from the very first moment when we stepped in.

    what's the status on the I-485 receipt # ?

    I-485 :interview is scheduled for 1/12/2015

    I-130 :Case was received.

    Here are more background. My husband's ex wife got green card through him in 2005. They were high school sweet hearts (since 17 years old) and got married after college (2005) but separated at the beginning of 2011. The divorce is finalized in 2012 March. Their relationship lasted 10 years. My husband didn't give any detail about his previous relationship to the IO because he insists that it's none of the IO's business. What IO knew is he was married before and ex wife got green card through him. IO asked one more question about his ex wife, "is your wife a citizen now?" He answered "I don't really know but probably is. It has been a long time since she got green card." For some reason, I feel the question "is your wife a citizen now" is a very very important question for my case based on the research I did....

    What do you think Darnell?

    Another thing is, my H1B is going to expire on 6/3/2015 and EAD is going to expire on 7/21/2015. I am still on H1B. Should I extend my H1B or renew my EAD just in case that this GC thing is going to last forever....

  11. I totally disagree about the 'controller' label you're trying to use here .

    Observation is not controlling.

    Seeking computer forensic evidence is also not controlling.

    There may or may not be privacy issues concerned/involved, but there is huge difference on ownership of gear and use of gear.

    Hi Darnell, I did some research on this website and it seems that you are very familiar with Dallas USCIS office.

    Can I ask several post AOS interview questions from you? Don't know what's the best way since you don't accept message?

  12. I want to correct one thing We are not afraid of doing stroke interviews but honesty, I just hope the whole thing ends ASAP because of my personality. I am a inpatient people,

    I even had a hard time to recall my SSN number. Just not sensitive to numbers.

    There is no wife would call her spouse STUPID on public forum. Be prepared for the worst.

    Seriously? I really think the fact that he didn't want to go details making the interview more awkard.

    Anyway, don't make the same mistake we made. We were too relaxed and too casual because we were exactly just being ourselves, bringing too much personalities while asnwering the questions.

  13. I entered USA on F1 Visa back in 2009. Currently I am still on H1B visa (going to expire in June, 2015). I received my EAD card but I didn't use it because I was thinking "why not wait till I get my green card? It has to be approved on spot since the marriage is so real ". <_<

    Here are my timelines and yes, this is how slow of Dallas USCIS office is!

    8/20/2011 Started dating

    4/23/2014 Got Married

    5/8/2014 USCIS received my package

    7/26/2014 EAD approved

    12/12/2014 Interview scheduled

    1/12/2015 Interviewed but I 485 wasn't approved on spot.

    I gotta say my husband and I didn't prepare for the interview at all because we were so confident. First, we dated almost 3 years before getting married and my status has been always legal for the past 5 years. Second, both of us have good jobs. Third, we bought a house 2 months after married and the settlement document/loan has both of our names.

    However ,the interview wasn't very smooth. First, IO didn't really turn on his computer and type stuff. Instead, he just made some notes on the file.I can see there are some stickers on our file which might indicate that he review everything before the interview.

    1. I accidentally said my husband's birthday wrong. (should be 12/14 but for some reason, I said 12/24).

    2. IO asked if I was going to change my last name and I said not really.

    3. IO asked if we were going to have kids. My husband said 4 years later and I said 5 years later. And IO made a comment that he saw hesitation from me (of course, because I didn't know where the 4 years came from. After the interview, husband told me that he thought it's 2015 so he should deduct 1 year from what we agreed on.)

    4. IO asked what's proposal like and we were like, there was no proposal nor wedding. Husband said that we are pretty practical people and I said I am not romantic and doesn't want to deal with the drama.

    5. IO asked if my husband was married before. The answer is yes. Husband said his ex wife is from XX country and got green card from him. IO asked if she is a citizen now and my husband said probably but he didn't really know. At this point, I felt my husband was so stupid. He should have made more explanations, like they were high school sweat hearts and got married after college and the marriage lasted for 5 years. But he didn't.

    6. And IO asked me if I met ex wife before. I said one time.

    I felt awkward in the whole interview. IO went through our pictures (most are travelling pictures taken in the past 3 years) very quickly. I brought the wedding cards, birthday cards and new year cards I received from his family but IO didn't look at it.

    Husband asked when shall we heard back from USCIS and IO said there were some many case in the pipeline, so probably a couple of months later. At the end, the IO took our joint account statements and house settlement notice away and gave us a notice, stating held for review and please contact 120 days later.

    Does anyone from Dallas has the same experience like mine?

    Did I really screw the interview? We are afraid of doing stroke interviews but honesty, I just hope the whole thing ends ASAP. I am not a patient person and this process just took way to long.

    Again, please don't make the same mistakes like I made. Please practice the interview a little bit at home and this is going to save you from panic!!!
