Hello, I am coming to you guys for help, this forum helped me in the beginning with my Fiance Visa questions, well now I have several I will begin:
I won't make it too long so we sent my documents for adjustment of status after getting married when we were suppose to, everything was going well, got everything done in the time they wanted, the problems started with the affidavit form, we first sent the wrong form with my brother in laws info, we got a yellow letter saying to sent the right form and proper info and we sent the proper one but now with my husband's uncle information (he was our affidavit for my fiance visa) so we thought there wasn't going to be nay problems, then we got a pink letter saying they were requesting more info since my husband's uncle was missing like 9,000 dlls to meet the yearly income since he adopted 5 kids since last year, so his household grew, the pink letter was requesting assets of his OR get a new joint sponsor, he at the time couldn't give us that documentation since he had legal stuff of his own to take care of so we decided to just sent all the info but with a NEW joint sponsor, all this time with the back and the forth they give you a certain amount of days, we sent the new joint sponsor info like 1 week before the deadline, it did make it in time, this time it was my husbands best friend he owns a company, he actually brought a few years ago his wife from Mexico too and this year hi brought his mother in law, so he has never had problems with these types of documents BUT he didn't put assets either since he makes more than enough yearly, ok, well that was 2 months ago, last week I received a letter saying NOTICE OF DECISION saying:
"Upon consideration, it is ordered that your application to register permanent status form I-485 that you filed on march 23 2016, pursuant to Section 245 of the Immigration and nationality Act INA, be denied for the following reason:
The evidence submitted with your application on march 23 2016 was not sufficient to establish your eligibility for the benefit sought"
Then it goes listing all the stuff I submitted every single time then on the last page (it's 3 pages) it says
There is no appeal to this decision however IF you are placed in removal proceedings you may be able to renew this application in such proceedings before an Immigration judge, furthermore this decision is without prejudice to future applications file with the appropiate USCIS office. If you desire to file a motion you must do so in form I-290B within 30 days from the date of this notice.
Which is until October 11th, OK so my questions are:
1. What is my best option? File a Motion or Re-file form the beginning and pay the 1,000 dlls again?
2.In case I do re-file (start over) what do I do about my passport expiring? and medical test?
I have no money for a lawyer I rely on you guys to help me out once again
PS. We have assets to send from the last affidavit we used, my time frame just ended so we couldn't sent it and the affidavit part does say OPTIONAL, but

Hello, I am trying to get everything ready for my adjustment of status, I came here with a K-1 Visa and already got married in November and I am really confused about the I-693 Form, I had my medical done in Juarez, Mexico back in September, they gave me the sealed enveloped and I gave it to the people that did my interview for my approval of my Fiance Visa, so I don't have anything from the medical with me, I am living in San Diego, what do I have to do with the form, how can I get in contact with the Doctor all the way in Juarez? do I need to send this form? Do I need to go see another Doctor here in San Diego? I don't understand, thanks for your help guys!!!

I was gonna pay it in a Tijuana bank, not Juarez

Another question I havent paid yet I will in cash, but I just saw another appointment opening for the 3rd of september, way better than the 1st of september can I change it? I already printed the bank slip....thank you!

Thanks I saw in the morning and yes, now I have a date, it's super close but it's better then not having a date at all thank you!

Yes, they return it punched, so there will not be an issue if I get a new one? I can take all my passports to the interview, I just don't want it to be a problem at my interview that all the information has the almost expired passport

Hi, we are trying to get an appointment at the Ciudad Juarez consulate for the K1 Visa but we are waiting until more dates open, my Passport (the alien fiance) expires on April 2016, what if it expires before we can get a date? Since all my documents even the DS-160 form have this passport's information, can I get a new one and take this one also to the interview? How do I let them know, I didn't think it was gonna be hard to get a date, or take way to much, it's really important, THANK YOU!!!

How long is the average wait to get an Interview at the Ciudad Juarez Consulate (Mexico)? We tried to get one yesterday online and says No appointments available to just keep checking until there's more appointment dates open, I read somewhere it can take up to a year, is that true???
-
Thank you so much, so the next step will be to pay the 265 dll visa fee, then go from there with the website instructions, and thank god there is no Affidavit fee, we read somewhere it was 150 dlls per form, we freaked out

Hi, my fiance (the petitioner) got a letter a week ago for me, that came from the US Consul in Mexico, it says my Visa is now ready for processing to bring that letter to the interview and it has instructions on where to fill out the DS-160 form then another website that I have to go, to schedule and ASC Appointment and a Consular interview, so I went to the website but in one of the spaces it says to put my DS-260 number, I don't have that, so I have plenty of questions:
1.-Am I suppose to receive another package in the mail with more info?, Do I have to wait to schedule the appointment?
2.-When do I go pay the 265 dollar fee they told me for the Visa Application?
3.-Do they charge per Affidavit form? I am putting 2 (two different people) if they do charge, how much is it and when do I pay for it?
The closer we get the more confusing things get, and I am super stressing, please any help you can get me will be much appreciated, we are so close yet so far!
PS. I already filled out the DS-160 form

Hello, we received the letter that has the instructions for me (the Alien Fiancee) to start my DS-160 Form and schedule my appointments for the interview but I haven't started because I have a question, well first of all we are planning on moving with in the next month to month and a half, so how do I go about changing my address and notifying the Visa people? My 1-129F packet has this current address, and I want to start filing for the DS-160 with in the next week, but I don't know what address to put, can I put my moms address? If I can, after that, how do I notify the offices? Thank you for any help you can give me!!!

Hi, I have a question, me and my fiance are starting to fill/print the forms for the I-129F form, but the G-325A form says it will expire on the 28th of February, we wanted to send the papers by the 27th, will that form be good? or do we need to wait for the new one on the 1st of march? Also another question, we are going to use an affidavit since my boyfriend doesn't make the anual salary required, when do we need to send that form? on the I-129F packet? or later when they'll tell us, Thank you so much for any response this Forum is the best and really helpful

I don't know what stamp you are talking about, they kept my actual VISA, they gave me no papers, or nothing, I was waiting for 12 hours until they took my statement the day they took my Visa. but people keep telling there will be no problem, that people that have crossed or tried to cross illegally have gotten the K1 Visa afterwards, so my situation is nothing, compared to that. Thanks for your reply!!!
-
You should be ok as long as your tourist visa wasn't cancelled for misrepresentation, fraud, or criminal convictions, etc.
Will my situation be considered any of those things???
-
My Visa was cancelled because I gave birth to my son in the US, it was an emergency birth, so it was basically free, so when I was crossing that one time from Tijuana to San Diego to go shopping, they asked us how did we pay for the birth, since they saw that my son was born in the US and I am a Mexican citizen, we said the truth, I got emergency Medical, since it was an emergency C-section, and they didnt like that so they cancelled my Tourist Visa, one of the officers told me I could apply with no problem, since it was just a cancellation, but I wanted to see if anyone has gone through something similar, thanks for the replys!
PS. We have met in person everyweekend since 2009, on February is our 5 year anniversary!!!
