  1. Me, my Fiancee, and her Son, Moved to the US November 7th, 2006 on a K1/K2 Visas. We have applied for my Fiancee's Social Security Number, and it is processing now. I have some questions about what we should do next (based on the K-1 flowchart).

    1) How do we get a Social Security number for my Fiancee's Son, so he can open a bank account, and get a drivers license when he turns 16 (he is 15 and is in the US on a K2)? From what I understand, he needs a (EAD/i-765), but it is a catch 22 because he is not old enough to work. How is this resolved?

    2) I am also worried about his status when his I-94 expires, will he be able to stay in the US based on his Mother's immigration status (his Mom and I will be married of course before either of their I-94s expire).

    3) In step 17 of the K1 Process Flowchart it says "Apply for marriage certificate." does this mean a marriage license in your county of residence, or is there some other "federal marriage certificate" or something else that I am not aware of.

Any answers would be greatly appreciated. I know I should probably make an assumption for my 3rd question, but I have misunderstood/overlooked very important details in the past and I just want to make sure that is not the situation with this.

    Thank you, j and e

  2. Hello everyone,

Is it necessary to have a seperate I-134 Affidavit of Support for my Fiance's Son (15 years old)? He will be moving with us, to the USA, on a K2 Visa.

At http://www.uscis.gov/graphics/formsfee/forms/i-134.htm , it states, "A separate affidavit must be filed by the sponsor for each person." The reason I ask this question, is because he is listed on my Fiance's (his Mother's) I-134 form.

    Thanks much,

    JeffnE

  3. NVC can take up to four weeks to receive the petition from CSC and assign a case number. CSC sent ours on August 18. We are still waiting.

It seems tha cases sent from the service centers between the 1st and the middle of the month take longer to process and those sent towards the end of the month only a week.

Yeah, apparently they mail out stuff in batches.

I would not be too concerned... I kept checking at the NVC to see if they received our case. 21 Days after our NOA2 I sent an email to the NVC regarding our case and asked them to check it out. Day 28, after receiving our NOA2, I received and email saying that the case was processed and sent on to the Embassy. NVC did not even acknowledge receipt of our papers. On the upside, after receiving the email reply, we received packet 3 only 2 business days after they replied to my email. :)

Be patient, it takes a lot of work for them to be inefficient. Good luck

  4. Hey all,

There is a lot of confusion in what comes next so, I have a few questions that I hope some of you have answers to.

    1. What AOS form should I use, and what AOS form should my Parents (co-sponsors) use? I am living in Romania with my Fiance and therefore I do not have a job, so I have to file using my parents as co-sponsors. I just don't know which form I should use and/or my parents should use, I-134, I-864, or I-864A.

    2. For the AOS, how much income and assets will be adequate? There will be 5 people living in the household My Parents (co-sponsors), me (sponsor), and my Fiance and her son (2 beneficiaries). I know there is a 5 x rule, but I don't know what amount to multiply it by (eg. $15,000 or $20,000).

    3. Will the NVC require us to send them any information/documents?

    4. Will we need to send the Romanian embassy any information/documents before we go to the interview?

    5. I know there must be a background check and a medical checkup completed for my Fiance. When should she start working on this?

Any information would be greatly appreciated. As I am sure you can all understand, I want to make sure that I have everything organized and ready as soon as they are requested to speed the process along.

    Thanks much, j and E

  5. Hi everyone,

Just wanted to let everyone who filed an I-129F in Nebraska in March and April of 2006, that they processed our file and we received an NOA2 on August 10th. I was shocked  when it was in my email this morning, considering I did not expect anything for another month or so. Seems like the order in which they process is quite random, or at least beyond this simple mind.

To everyone else who is waiting (especially those who filed before us and around the same day), I hope they process yours soon, also.

  6. As I sort and view the advanced timeline for K1, I am focusing on "I-129F Mail to 1st NOA" and I see that many of these are like 1 or 2 days. Some are more, but most are within a week or so. I overnighted my paperwork to NSC on 8-1-06. USPS says they received it on 8-2-06. Its already 8-11-06 and I have checked my mail today.....A GREAT BIG NOTHING!!!

When you update your timelines are you putting the date of I-129F NOA1 from what is written on what you receive in the mail or the date you actually get something in the mail?

Because I'm checking the mail everyday with expectation and getting killed by the disappointment. How can you send it on one day and then have NOA1 the very next day?

    YOU'RE KILLING ME HERE!!!

My stack of paperwork was almost 2 inches thick. I have so much proof that it should be a slam dunk. I shouldn't have to ask the freakin govt for permission to love and live with this perfect woman for me. It makes me want to sneak her in through Canada.

You don't think they read these forums do you?

It took 16 days between the time our package was received (according to FedEx) and the time they acknowledged the receipt. Hang in there.... it's a slow process, but a pretty solid process considering all the things involved.

  7. I have just found out that my county and state that I was born in, both have a birth certificate (from what I understand, they are different). I am filing a I-129F and would like to know which birth certificate I should use?

I know it seems like splitting hairs, but I want to give the best paperwork, to reduce the chance of my file sitting, waiting for more information/documents.

    Thank you very much, jeff

  8. My fiancee is fluent in both Romanian (native) and English. I have seen several posts where people have translated their own documents for the 129F application. My question is:

If my fiancee translates her own documents, is it necessary to get the papers notarized (by a notary) or stamped by a liscensed translator?

I am asking this because if no official stamps or notorizations are necessary, it seems that anyone could translate the papers, even if they are not qualified, and just sign and date them using the certification declarations others on this site have posted. This does not seem like it would be acceptible. Any more information would be greatly appreciated. Thanks you, Jeff

  9. Hello, I am very interested in reasonable airline tickets. Could you give me some details. I don't know if a US travel agent can book my tickets or not, since I am currently living in Romania. Any information you have would be greatly appreciated. My Fiance and paid around $1,200 this summer for flights.... ouch.

    Thanks, jer

  10. I am living in Romania indefinetely (with my Fiance and her 14 year old son) until we complete the visa process, for all of us to move to the U.S. and be married. We are getting close to filing our 129F form, but need some more information before we do so.

1). As I understand there is usually an interview with USCIS when a 129F form is filed. Will I have to fly back to the U.S. for an interview? If so, what office will the interview take place and how much notice will I get before I have to be on a plane (since last minute flights are so expensive)?

2). Since I have a foreign address, how will USCIS contact me for any correspondence? If I request them to to use my parents as contacts, which is where we will be living for short term after we move to the U.S., will they. My concerns are: USCIS not being able to contact me here in Romania (I do not trust their postal system here), or USCIS may not even contact people with a foreign address and phone number listed on the 129F form.

Any other tips, advice, or information would be greatly appreciated.

If it makes any difference, I am a born U.S. citizen, and I am filing at the USCIS office in Nebraska. I lived in Oregon before moving to Romania, and we are going to live in Illinois when we are able to move to the U.S.

    Thank you, jeff and E
