  1. I guess some of you didn't see Chris Rock's show... Brown people were refered to non-white people. No need to get all ultra sensitive! If you try to tell me that immigration is color blind, (stop laughing...) wait until this thread gets popular, see how many people got 221g were from Africa and Asia... compare to others... no need for hushing I will stop mentioning the word "brown country".

    The point here is I do support this thread for one reason: my wife was a 221g survivor too. From Saigon Vietnam. Nonetheless, she is here now.

    Yorak says it clearly, it's not their job to tell you how to get over the system, it's your job to convince them that you deserved to be here... They do not owe you anything... Do your homework and get your love one here!

    Your post is ignorant of the fact that many K1'ers don't have copies of the DS3025, nor any copies of any medical paperwork completed by the designated physician during the consulate interview phase.

    In our case, my fiancee (now my wife) was refused copies by the physician in country as well as the consulate themselves.

    One cannot "supplement" what one does not have!

    I included a letter with my AOS submittal describing the circumstances we experienced. We shall see the outcome.

    Same situation for us, but we went to the civil surgeon anyway and my husband got "revaccinated", so that we could send in the supplemental with the AOS package.

    No, it is not ignorant, but just FACT and experience from many VJers on this board have shared with us. RFE is almost a certainty that many have unfortunately faced for the past year. You almost have to de-script what USCIS says in their document "MAY" means "DO IT OR ELSE".

    I am sorry you didn't get your Vac-Record in your country, and I am sorry that you don't have anything to send in with your AOS package... Most sorry, you feel that ignoring the experience from folks who been through this AOS before is OK... Ignorance of the LAWS is no excuse!

    OP started the thread to find out pro's and con's.... there have been much debates over this issue. A little search could help. Clearly, OP has at least DS3025, with that assumption, the only advice I can tell OP is send it in, do what necessary to get the Sup-Vac done.... but nonetheless, SEND IT IN!

    To get your VAC-REC if you don't have one, go to your PCP with the list of all required shots, redo the shots, most Healthcare Insurance covers these shots. Bring it to the CS and get your I-693 filled out.

    It doesn't hurt to ask for help here and check with VJ....

    Here is the link to look for a Civil Surgeon in your area, MAKE SURE you enter your STATE, it works better that way on this page... don't really know why... but that's how it is...

  3. Applying for a job isn't an issue, accepting a job isn't an issue, LEGALLY working and getting paid... Big time trouble!

    So, the answer is yes, she can apply for job while she filing for her EAD. But to work legally here with her future visa status and immigrant status, the answer is no. Must have EAD to work, most employers will ask for proof of legal status and other things.

  4. Doesn't sound like a fraud case? Emotional abuse? You gotta be kidding me!!!

    Stick with the legal issue: agree with Autumnal, this is a AOS for a marriage base case, the USC must be there. If the USC refuses to adjust the case, guess what buddy, it's time to pack and go home! That WAS the only reason why you were here in the first place... in love, want to be together forever, be together here in the USA etc.... now that basic reason "in love" isn't there, well, I guess one can change their reason after all.

    I don't have any suggestion, but get a lawyer!

  5. It does matter which country you're dealing with.... never heard of a case from UK or AU got returned this way...

    If you're from a "brown people" country... most likely you will get treated with extra care... not the kind you want to have but that's the reality!

    Folks from VN-HCMC got returned, rejected, denied, on-hold indefinately, for no good reason or no reason at all... why? Because they can! The State Department tents to model after "rather wrongfully deny than wrongfully approve!!!"

    But, by saying "no matter how much evidence you show them" still not enough is a very general statement... each Country has its own circumstance and level of marriage fraud... VN-HCMC is 100% higher than UK-London in this category therefore the amount of evidence the fiance must show the Consulate in HCMC will be 100% more than what a UK-fiance must show.... it's just the fact!!!

    So, please keep in mind when posting on this thread:

    - Which evidence commontly required by your country's consulate

    - Since when you notice the denial/return rate has changed (HCMC started last March 2005)

    - Make sure to let us know if any reason for return/reject/deny

  6. Ok, you're at the very very very early stage of K-1!!!

    You can start by collecting Every evidence you have to support your relationship. Included but not limited:

    - Your OWN credit card statement where it shows you bought your flight-tickets to VN to meet your fiance

    - Three years worth of TAX Return, if not, explain why not in a sworn statement letter. Get notarized.

    - Have her to translate all of her government issued id/document birth certificate, school diplomat, divorce paper etc. into English by the local government office in HCMC. She should be able to find that out easy in Saigon. All translated documents must be done by the government with official seals and stamps affixed on them.

    - Both sign "Sworn statement of single status" if you are both single and available to be married.

    - Keep extra detail of your phone bills/ chat logs/ emails.

    - Do recommend hand-written love letters, post-card, special event greeting cards. They read that kind of stuff during the interview and they help out tremedeously with your case.

    - Packet-3 will be sent to your wife and in there it will list all required documents for the interview. What you can do now is calling and chating, writing love letter (MUST) to her regularly!!! She can bring those to the interview as proof of REAL relationship...

    Anyway... you can email too, but their mindset on email seem to be: well, too easy, hand-writen letter is more passionate..."

    Your Co-sponsor would be enough. No tax return for you since you did not have any income? Write in a letter explain it as you did to us. If you can, ask your "Publisher" to write an official letter states that they are commissioning you to write this book for them.

    As for HCMC, you're right, they are denying more K-1 Visa than they approve them. I see that your timeline isn't filled, it makes a little bit harder to guess what stage are you in right now... but in any case... be prepared for the worse and hope for the best.

    You and your parents MUST fill out the I-134 forms. Give them what you got, do not make up things. 2 years tax return and a SWORN STATEMENT that you are writer who did not make any money last year... you know to explain it :)

    That's the truth and it's simple.
