You did your taxes wrong. He is not a resident as defined by the IRS and can't file with a resident. Non residents have different forms and taxation. Because you are a USC, you may file jointly if you each sign a statement saying you choose for him to be treated as a resident alien for tax purposes. And If you choose to do that and file jointly, then both have to include "worldwide income" meaning US and DR.
You are probably getting back more refund than you should, had you followed the tax laws. Will the IRS catch you? Probably not.
I had no idea..I am new to filing taxes. How do I amend it?

My husband moved here in October (K1 visa) we were married December 3rd and he got a social security number and health care in January. I picked married filing jointly. Is that right? We are waiting for his work authorization to come in so I only had my W2's and income entered. I just read on this forum that my husband has to include the income he earned in the DR? What if I already sent in the tax (e-file) with only my income? He does not have income in the USA. He just moved here in october and cannot work yet?

Hey Y'all,
On the social security card application which box do I check off:
1. legal alien not allowed to work
2. or legal alien allowed to work
My husband has not received his work authorization papers yet

So you don't have to be married first to get a ss#

We got our ssn in 5 biz days and AOS getting mailed out next week. How about you?
We are getting our AOS mailed out next week too. How do you have a social already? My lawyer said we have to wait after we submit the AOS papers to get a ssn

I think yours is coming!!! The fact that the embassy was closed the 9th and 12th has slowed things down. Did you try the passport tracking option? That updated before my travel docs account.

Just the normal process. That is what it is supposed to say. Does it say at the top immigrant or non-immigrant? I read it is supposed to go AP then READY then AP then issued.. On the second AP it is suppose to say non-immigrant at the top.. Mine still says ready but was updated today.
it says non-immigrant
