  1. You would think so, but apparently no.

    I went through the same process of trying to prove "Intent of Restablishing Domicile" and sent everything I could think of. Both trying to show my husband kept all of his ties in the US and also prove of our future plans.

    During the interview what the Consul seem to care most about was prove of our future plans, well his, as to make sure that he is indeed trying to reestablish his domicile in the US.

    Since he was a student here, we should that he is planning on doing some post-graduate training in the US, showed a letter of acceptance to that program and also showed that he is taking the boards to validate his studies in the US.

    SO try to show as much evidence as you can of your future plans there.

  2. One good approach when applying as a University student for a B1/B2 Visa in Colombia (from what I've learned so far, personal experience and friends) is to do it as a dependent of your parents. They will be able to show more ties to Colombia than you... for example properties, a job contract, etc.

    I she can't apply with her family group, then she could try to get some properties under her name or really at the beginning of the new school semester, so it is not so close to her vacation period.

  3. The embassy will probably want to see the advisory opinion from the State Department. Once they see you are subject to the HRR, or you fail to provide the opinion, you will likely have to serve the HRR.

    I just check my visa status on CEAC and I got the great news that my Visa was ISSUED =).

    Such a big relieve, which means that the advisory opinion didn't pose any issues for the process.

  4. Hello all fellow VJ members,

    I have a pretty complicated situation in my hands that is driving me crazy.

    I just went through the whole IR-1/CR-1 process and had my interview at the embassy on June 18th and the consul said: "Congrats, your Visa was approved". (Best day ever by the way).

    SO the problem is as follows (please, bear with me):

    On 2013 I was in the US under a J1 Research Scholar Visa. Both my visa and DS-2019 said that I was "NOT subject to INA 212(e)" (i.e 2-year home residency requirement).

    I actually talked to the embassy before starting the process for my CR-1 and asked them if I was good to apply for a immigrant visa if all of my paperwork said that, and they said yes. SO I went ahead and started the process..

    But midway through the NVC stage, I was advised to request an Advisory Opinion from USCIS regarding the J1-requirement just to be sure, so I did.

    The NVC process went smoothly, my interview did too and just TODAY (AFTER my interview and the approval from the US consul), I received the final decision from USCIS saying that I AM SUBJECT to the requirement, which would mean that I am not supposed to get an immigrant Visa.

    I know this is kind of a particular situation, but I just can't seem to find any info that can help me think of what to expect.

    The embassy has my passport and my Visa is supposed to be returned to me soon, but I am concerned that it will be denied given this new piece of information.

    Does anyone have any experience or advise or opinion on what I could maybe expect or do?

    Congratulations to all of you on your approvals.

    I had my interview on the 18th and was approved too.

    I have a questions regarding the recent hacking issue and the difficulties all embassies are having with Visa printing.

    Have you received your passports and visas?

    After you got approved, did your status on CEAC change? Also, are you able to track your passport on DHL or through the ais.us-info.com?

Yea me to thanks its not denied at least right just in administrative processing status lol tryibg to look at the bright side ? just need a sponsor and need to send it sucks cause today's Friday but fI scan all stuff In during the weeks so hopefully it can be al in by and processed Monday depending on how long it takes for them to do that

    Sorry to hear that, but yes look at the bright side. But, how come you went through NVC without an issue and now they ask you for a sponsor?

    Did they explain this to you?

  7. Hi, I'd appreciate any feedback on this potential situation. I am the USC and my husband's CR-1 visa was just approved. We are both living in Mexico and are planning to move to the States within the next couple months. I'm wondering... if he has a job interview in the US before we move together, can he travel in and out of the US while I'm still here in Mexico (before we make our permanent move)? Will he have a problem at the POE? I will certainly travel with him if necessary but we're just wondering if it's necessary. Anyone have any insight about this? Thanks!!

    I don't know if the question on how to register your appointment and choose the DHL office was answered before, but I will just share how I did it in case anyone still has any doubts.

    1.) Go on the following link: https://ais.usvisa-info.com/es-co/iv

    (If it comes up on the non-immigrant visa window, just scroll down to the lower right-hand side of the page and you will see an option that says IV and NIV.... so go ahead and choose IV and it will take you to the right page).

    2.) Create an account (or sign in if you have created one already). Choose the option that says: register an interview appointment (or something along this line)

    3.) Initially I kept getting this message: "Case number not ready to schedule". So I followed their instructions and emailed them with my info and they got back to me in about 2-3 hours (they say 3-4 business days though) and said it was ready and I could try again.

    Subject line: Case Number not ready to Schedule

    Include full name, dob and case number

    4) Once I got that sorted out, I was able to register my appointment and select the DHL office where I will pick up my passport and also select the date for the CAS appointment. (FYI: all dates from today to my interview date were available, so it should be pretty easy to find a convenient date for you guys).

    Well, I can't answer all of your questions but I can tell you a bit about my experience, maybe it would help.

    My boyfriend (now husband) and I were engaged for a while. I travelled to the US for a wedding we were attending together and just to visit his family in California. I travelled alone, and at the POE they asked why I was coming to the US and I just answered for pleasure (Visiting friends and family and going to a friend's wedding). The officer seemed satisfied with the answer and in general, every time I travel (even now with the whole process going on), they never truly ask much more if you state that your main intention is to just visit and so forth. She can definitely have some documentation proving her ties to her home country and bring anything she believes may help proving she will return to China. But I think that they won't go as far as to ask if she has a fiancé (at least that was never my experience). Just tell her to give the officer her main purpose for this trip (visiting friends /family and her children going to summer camp).

    I also got married in the US with my B1/B2 visa and went back home. We were not planning it before going, we decided it once we were there (Getting married in Colombia requires soooo much paperwork is crazy, so it seemed easier to do it over there). It was not an issue for my entrance that time and it hasn't been an issue since. my thoughts to you is to make sure that getting married and applying for the CR-1/IR-1 visa is your best option (in my case I sometimes wish I didn't do it that way because it has made some other things difficult), but that is something you need to evaluate for your specific situation.

    I really really need some help, maybe someone had similar experience or knows something that may help me.

    I am at the NVC stage of my IR-1/CR-1 (Sent both packages and paid all the fees). My USC husband and I live in Colombia.

    I was in the US for over a year with a J1 visa, for neuroscience research, and my VISA says I didn't have a 2-year home residency requirement (Both my VISA and DS-2019 say the same). Nonetheless, my country is listed in the "Special Skills" list, so I was told that they requirement may still apply to me because of that, independent of what my visa says.

    I am now thinking of starting the waiver process, but don't know if that could may things worse by putting a big "red-flag" over my head or if I should wait for an advisory opinion (which can take 6 weeks) and then see if I need to start the process

    Any opinion or help will be greatly appreciated.

  11. Hi guys,

    This may be a silly comment, but just want to get some input to ease my nerves:

    I first sent my AOS pack (Scan date 3/25) and then my IV pack (still no scan date - it arrived friday). --- This was a silly decision, thought I had to wait for IV fee to clear before sending second package.

    Anyways, has anyone done the same and had any issues (like checklists for nor sending them together or just in general any issue at all) or do you know of anyone?
