Are you a hundred percent sure? I could fix it by just not taking the deduction as I haven't filed my taxes yet. However, it would cost me about $2,000.

It was from a Canadian firm that 1099'd me in the USA.
I'm currently in Europe.

I'm working on the I-864 right now, Affidavit of Support.
In my situation I must show $19,912 worth of income. Since I've been living outside of the country to be with my wife it makes things a little bit complicated.
On my tax return on my 1040 line #12, my business income was $25,561 - more than enough.
Line #13, capital gains $969
However, on line 21 I took a Foreign Earned Income exemption for $19,862. I was able to do this because I was outside of the USA for more than 330 days last year.
That puts my total income, line 22 at $6,668.
My question is would I be able to sign the I-186 with my income like this? And specifically what line number are they looking at on the 1040 to determine if I'm above the poverty line?

I filed for both I-129 and I-130 and and waiting for our interview.
I believe I had misunderstood the procedure and I'm getting worried. Once we get approved I had understood we had 90 days to get married in the USA.
Within those 90 days I planned on going to a lawyer and getting a prenup drawn up and signed. Pretty much we just want to keep assets separate.
We have already gotten married over seas, she's in agreement with the prenup but we did not sign it before the overseas wedding (we're waiting to come back to the states). Is it still okay to get the prenup after we get back to the states? Or perhaps draw it up now and and bring it with us to the interview?
Affidavit of support income requirements question

On the affidavit of support they ask for income from the sponsor for the past 3 years. Must all 3 years exceed the 125% poverty line threshold? Or are they just looking to see that you exceeded it in the last year you filed taxes?
I meet the requirements for 2014, but not for 2013. Just wondering if this will be a problem.
