  1. Get a lawyer! I've just came back, from Brazil (also), due to my mother's death. I have a valid GC. In July, following advices of this site, I've asked for a Re-Entry permit, my mother was still alive. In September I've went for the biometrics, fingerprints & pictures. Mother's health got worse, I've traveled in November. My Permit only arrived by the beginning of February. I was able to get back in, on February 10, due to the Court of Appeals putting a veto on the ban. But I was scared.

I was in Brazil, already planning my comeback. With the new President and his Ban, any border patrol can prohibit anybody to get in. There is no Civil Rights at the border. Border Patrol can do anything, exactly: can do anything to anybody that wasn't born in the US. They are making GC holders sign papers giving up their permanent residency in the US. Texas is one of the worse places to get back in, it is a republican state that support the new president and his ban. The "Muslim" ban put any non US citizen, coming to the US, on the same 'limbo'.

I feel sorry for you and your spouse! Get professional counsel for that, because the risk is enormous, specially on your particular situation.

TRANSLATION: We had problems in the past and had to start all over again! As we are above 50s, and it is being difficult to stay away from our grand kids, this time we hired a lawyer. Its office is specialized in immigration, they understand and speak Portuguese, and also receive our USCIS/IV mails. But this office is in SLC/UT. It is not cheap, but it is good choice due to the peace of mind that it gives to us! We chose them by an indication of a friend, and also because of good evaluation from avvo.com. Good luck and all the success for you guys!

    Ok! Translation provided!
  3. Question: If we have an attorney, taking care of our immigration process since the beginning (I-130), when it comes the time to choose an AGENT (DS 261) our attorney will be automatically put as our agent, or do we need to fill up the DS 261 and indicates our attorney as our chosen agent?

  4. We just started out CR1 and our I-130 was suspended for RFE.

We both live in Brazil and our NOA1 and RFE never arrived in the mail. When filling out the Non-delivery of notice it has a subsection entitled `form sub type`which none of the options applies to us. Do i leave it blank?

It also asks for a mailing address with only american states listed. We live in Brazil as I said before so what do I put? Or is that supposed to be the Chicago lockbox address?

    HELP!

  5. Does anyone have any idea what application date the Nebraska service center is processing? We filed in July for I-130 (spouse) and wondering if we think we will hear back before our 5 month approximation (Dec 14).

I'm in the same situation! Priority Date July/2014, 5 months are gone and no NOA2 yet! Good luck for you!

  6. Same here. NOA1 9 July, Nebraska. Been on 'case being reviewed' (before website update) and 'your case has been received' (after website update) ever since.

Never got an email, text or even a hard copy for the NOA1. We had to ring them to find out the package has been received.

Within the following months my wife rang USCIS twice to request the hard copy but both times they informed her that 'the hard copy isn't needed since it says the same as the status update on the website.' Not too impressed with that but what can you do.

    Hello, by the way. :)

    Hello! B-)

Have you guys checked if the address in the US is correct? We have a daughter in law getting mails for us!

    B-)
