  1. Hello friends!! 

     

    I ran into some questions while filling out the N -400. Please share your advise and thoughts. 

      

    My husband and I have been married for 9 years and have two children together. He has been here for 3 years as of this month.

     

    I'm trying to fill out the N-400 form and there is a part that's asking for Documents referring to "you and your spouse" based on applying on the 3 year rule.

    They've given us several documents to turn in :

    a. Tax returns, bank accounts, leases, mortgages, OR birth certificates of children or

    b. IRS tax returns for the last 3 years or

    c. An IRS tax return transcript for the last 3 years. 

     

    So, I have the birth certificate, mortgage info and bank accounts and 2016 taxes, we haven't filled 2017 yet and I've been having some issues logging into my IRS account to get my transcript for 2015. Dealing with the IRS has been a nightmare. My question is, do I need to submit the 3 years tax returns? Does everything I have on hand sufficient? Again, what I have on hand is:

    1. Children's birth certificate

    2. Mortgage that has both our names on it

    3. Bank account (I was going to turn in a statement with both our names is that what they're asking for or do I need a letter from the bank?)

     

    I hope that this doesn't come off as a dumb question. I'm just confused because it say's Or birth certificates OR tax returns.

     

    I'm ready to mail out everything like...yesterday. :)

    My husband was approved for the 601 & 212 recently and we entered the USA (we drove from Canada to USA) and stayed for about a month but had to come back to Canada. We've encountered some serious road blocks and we will need to stay in Canada for another 1-3 years.

    1.) Is it possible for him to keep his PR in the USA while living in Canada temporarily? How often should we visit and how long should our stay be? We have all intentions of moving to the USA but we have so many obligations in Canada that we have to settle before leaving.

    2.) Someone advised us that because we drove into the USA this will not affect us.

    3) Also, he has never received his PR card. He paid his immigrant fee in Jan/2015.

    Please advise

  3. Ah you needed a waiver and had to update the documents and medical. The visa should be a IR1 (depending on length of marriage.) Glad to know your journey is finally at an end.

    Thank you! But, it feels like this is a never ending wait! How long does it take to receive a Visa package from Montreal? It's been 3 weeks so far. What can I do to speed things up?

    Sending your package to Montreal? Your profile says K3. Why would you not do a CR1 if you have to interview in Montreal anyhow? You have no timeline?

    I wasn't sure which type of visa we applied for since it has been a while.

    We applied for the I-130 in 2009...we went for an interview in Montreal Jan 2014 and my husband was denied and was told to fill out the 601...a couple of months later we were then told to fill out the I-212. We were approved for both Nov/2014. We had to do all the medical, police reports to send to the Montreal embassy.

  5. So my husband went to Dr. Randall T. Lee in Toronto to get his medical and boy do we regret! The first time everything went smoothly but now it has been over 10 days and they still have not given us our medical records. Everytime we call they've given us different information. What to do???! This is this is the only thing holding us from sending our package to Montreal! ahhh!

    Hubby went for interview in Montreal in January 2014

    Sent 601 package March 2014

    after Almost 7 months of waiting I called USCIS and was told that no one has been assigned to my case!!!

    That's when EVERYTHING started moving really fast:

    RFE sent October 2014 ( to send in 212 as well) a couple of weeks later...

    Approved November 2014.

    1 week later Montreal sends letter for us to send passport, new police report, new Medical, and new affidavit

    Waiting on Police report to arrive to send immediately.

  8. Hello,

    Our 601/212 was just approved November 26 (it took almost 8 months). The Montreal consulate has asked us to send the following via Markham DHL:

    1.) Police records

    2.) New Medical

    3.) New Affidavit

    4.) Passport

    Because I'm sending all this information, would it take long to receive our visa? Also, what is the timeframe as of now for people to receive their passports back?
