  1. We are trying to get healthcare for the rest of the year and we're not sure if we're eligible.

    My wife just received her green card, and one of the questions is when did she get immigration status?

    Now, is that when she came here on the K1 visa, or when she received her green card?

    I've tried googling this matter to no avail. I wondered if anyone else had come across a similar issue?

  2. He has to be over now, not the near future.

    He is $1212 short. You can make up for the shortfall with savings (3x$1212) in excess of $3636. If he is not your spouse because it is a adjustment from a different visa, then it is 5 times the shortfall. Other than that he needs additional income before the deadline they gave you to respond or you need a joint sponsor who qualifies based on their household size.

    The tax return does not have to cover the required amount if you submitted evidence that the current earnings are more than was reported on the 2014 return.

    Their reference to the tax return is an example. People with employers get W2s. People who are contractors get 1099s. Both tell wages earned in a year. Not too many people have both. In addition to that the actual tax return can be very simple with only a form 1040EZ to more complicated with Form 1040, Schedule A, B, C, D, etc. Each of those schedules reports other income like interest, dividends, self employment, or itemized deductions. Form 2555 is when. The person has foreign income they wish to exclude.

    The point in the RFE is generic and not custom to you. It is saying send every single page of the tax return including additional pages that are called Schedule __ or Form __ IF those were part of your return. And send us the wage statement which may be a W2 or may be a 1099. If you did not send every page of the return and a wage statement for every job, then do so or they won't consider the rest until you get that part correct. Then of course, the concern over him not making enough income is a big one. You can get denied if you don't come up with something by your RFE response deadline.

    He has now got his raise which puts him at 20280 annually. drawback, we only have one payslip and we need to reply now. do you think they may consider this new increase in wage?

    Thanks for clarifying on the W2, etc. part. I can get that sorted.

    And if they will take my savings in to account as we are married then we should be okay to cover the difference.

    We may have to wait till January to respond as he will have his raise by then, and hopefully that paired with the fore-mentioned should be enough, fingers crossed.

  4. Is it just two in the household? Husband and you?

    Did he make more than $19,912 on his 2014 tax return.

    Did you submit anything from his employer stating his job and current earnings?

    Did you submit 6 months of pay stubs?

    A complete tax return includes firstly Form 1040, or 1040A, or 1040EZ.

    Which of those did you send in with the Affidavit of Support?

    - Yes, just two in our household

    - No, he didn't make that amount on his tax returns, it was significantly less. His current earnings though are about $18,700. so we're $1000 short-ish.

    - We submitted a letter from his employer stating his hourly earnings, and how many hours he works a week. and that he's due to receive in the near future which would put him over the 125% mark.

    - submitted the past few months of pay stubs

    After looking at the copies i made, i sent the W2s and it was actually the 1040EZ.

    If we can't find the 1099s, is this something we can request from the IRS? and also, i don't think Form 2555 is relevant as it says its for Foreign Income?

    Hope you're all well

    I've just received an Request for Initial Evidence for my AOS. The message reads:

    • ".. Submit all supporting tax documentation (W-2s, 1099s, Form 2555, and all supporting tax schedules) submitted to the Internal Revenue Service for the most recent tax year.

    the petitioner/sponsor must submit all supporting tax documents for the most recent year.

    • Based on the documents submitted with Form I-864, Affidavit of Support for the petitioner/sponsor, the income did not meet the 125% of the poverty guideline for the petitioner/sponsor's household size.

    Submit evidence of assets that meet the standards listed below or obtain joint sponsor...." etc.

    First of all, i did submit W-2s and 1099s for my sponsor. What is Form 2555 and can anyone expand on tax schedules please? and it is 2014's right?

    Also, I'm assuming this point is just for my sponsor as I haven't filed taxes here, as I've had no job in the US.

    And obviously the second point, my sponsor doesn't earn enough for the household size and his taxes don't meet the poverty line anyway.

    Can he obtain another job, and receive a letter from them stating his hours, wage, and along with his payslips? do you think that would be acceptable?

    And if not, then we need to find a co-sponsor. Does the co-sponsor need to meet the guidelines on their own, or is it jointly with the original sponsor?

    Also, I applied for employment aswell, will this affect that? if it comes through in time, can my husband's income and mine be joint and basically co-sponsor myself?

    Okay, so we got Approval for the K1 Visa on Friday after the interview and am just waiting on my passport back. :dancing:

    But it's dawned on me: now what?

    I've been told i have to travel before my medical expires which is the beginning of September.

    What items should i bring with me? what do i do once we're married? what do i need to start working?

    I'm sorry if these are silly questions, and i do have a bit of an idea but i want to make sure i've got my facts straight so i would really appreciate any help you have to offer.

    Your proof is the employer letter.

    Scratch what i said before, it still wasn't enough and we've been unable to find a suitable co-sponsor which apparently means i will not be invited to my interview.

    So, i have no idea what we do now.

    Further to my previous posts: As of the 26th Jan we've had a raise in income which would mean we would have enough for the 125%. However this won't be shown on his tax return till next year.

    Would proof from the employer be enough, saying how much he is currently earning?

  9. London *might* allow 100%, as well as the beneficiary's assets. It is up to the officer.

    So income of $14,000 and $15,730 poverty guideline.

    The shortfall is $1,730.

    3 x $1,730 = $5,190 is what you need in cash assets.

    For the adjustment of status application (and permission to work and live in the US)

    Income of $14,000 and $19,662 poverty guideline.

    The shortfall is $5,662.

    3 x $5,662 = $16,986 is what you need in assets.

    As a married couple, your assets can be combined as jointly owned money.

    For a joint sponsor who does not have enough income, the multiplier is 5 x the shortfall. A fiancé or spouse uses the multiplier of 3 for assets needed.

    It would be kind of futile to squeak by London only to fail on getting her legal residence in the US.

    If the visa is somehow approved by the embassy though on those grounds, am i correct in saying the beneficiary has 6 months in which to travel to the US?

  10. A K1 visa holder will not be eligible to work for many months. She is allowed 90 days in the US in which to marry. That's all she is given on her entry documentation. 90 days entry. She has to apply for a greencard and work authorization and wait for approval. That requires an even stricter affidavit of support than the one for London.

    You need to budget for the costs associated with her immigration. Your savings may dwindle.

    K1 London route = $1705 + £290

    $340 (USCIS) I-129F petition

    £45 (ACPO) Police certificate just before petition approval

    £245 (Knightsbridge Doctors) medical exam. Pay at exam.

    $265 (Embassy) Visa fee prior to interview. Online pay.

    $30 Courier fee if home delivery, $0 to pick up at a depot. Online.

    $1070 (USCIS) Adjustment of Status/Work Authorization/Advance Parole

    Transportation to London twice

    Airfare to the US

    Shipping her belongings unless everything fits in one suitcase and a carry on bag.

    There is actually a formula for the support. If you say what the actual petitioner income is, then how much savings you will need can be calculated for you.

    Your response was helpful, we weren't clear on the working situation.
    In regards to the other expenses you have mentioned, we have taken them in to account and our separate from our savings, so we can pay them as and when needed.
    plans B & C are still viable though, but that won't mean much when it comes to the interview, so unless we find a co-sponsor i guess we won't have much hope at all. which pretty much answers my question.
    And the Petitioners earnings are just under the $14000 mark. so for 2 people at 100 percent, would be a grand a half more. but 125% we're looking at needing 6000.

    I think me and my Fiance may have hit a bump in the road. We've received our NOA1, NOA2, NVC letter and the UK embassy has now contacted my Fiance and she needs to go for her medical.

    We have been told that the Petitioner must earn $15,730.00, which on his own he doesn't earn, and therefore we will need a co-sponsor.

    The Petitioner lives on his own, he's father has died, and his mother wouldn't be an appropriate co-sponsor either. There isn't anyone else who would be able to do this.

    And so, does this mean we'll be denied? What should we do?
