  1. I was going to do the same next summer (go home for a trip) but decided to call it off just in case I get through this then end up waiting on a US Passport. That'd just be my luck.

    Yup, thats my worries... but I have to go every year and cant chose the time. And with my well known luck I probably have the interview right at that time... oh well. Im not in a hurry at all, just want to get it done and over with..:)

  2. Sounds normal, they debited by credit card on 10th and it wasn't until 16th that I got an email and text informing me they had received by application. I've not yet (18th) seen a hard copy NOA in the mail and don't expect to see one for a week or longer considering we have the holiday season upon us once again.

    Cool, I will try to stop worrying. I have planned a vaccaction by mid June and then a trip back home in August so I really hope I will have done the interview by then, as I would so hate to re schedule...

  3. First you needed to send form G-1145 e-Notification of Application/Petition Acceptance along with your application. If you didn't send it, once you receive the NOA, you will get your receipt number that you can then track online on https://egov.uscis.gov/casestatus/landing.do. If you don't receive the NOA in a reasonable amount of time, you can request a copy of your receipt on: http://www.uscis.gov/e-request

    TombRaider, I tried this link to request a copy of the receipt but I cant fill it out and send it as they ask me for a receipt number, which I dont have....

    called service center but they said oh, wait 30 days... blabla

  4. I filed today and according to the processing time it seems it will be about 6 month till i have the interview. My question is, how long in advance do you get the appointment letter for it? I planned to travel for vaccation out of the country mid June, so that would be 7.5 month from now. I now worry about booking the trip as the interview coould be later on, exactly the week im gone, would hate that! So maybe if they send the appointment letter way ahead I can book then... once I know.. Any ideas?

  5. I am starting to prepaire all the documents i need to get my citizenship. Now I wonder if my daughter will recieve it automatically once I got it, like it was when I got my greencard? Do i have to fill a separate form for her? Or do Ihave to wait till I got it and then apply for her? My daughter was born out of the US, father is non US citizen, Im divorced living here in the US since 10 years, having sole custody.

  6. I have been told that Good contuct counts for the 5 years, is that true? Also, I read that they will have a harder application process from May 5th this year, if I apply now, will I be able to go to the interview before May 5th?

    My daughter is 12 and got the greencard together with me, will she receive the citizenship if I get it also?

    Thanks for all the info, really interesting.. kinda weird, so if I dont have a job, they will get back to him if I get food stamps, but if I end up in a hospital, and cant pay the bill, I am on my own... well, at least I will try to get my little girl in a plan over the social security program, I think they do this for children...

    I still would hope that it is possible in NC to file for divorce before the separation period is over.

    Unfortunately, the law is different in every state, and the OP is correct about divorce law in North Carolina.

    The only two grounds for divorce in North Carolina are 1 year separation, or your spouse is insane (the insanity ground is available in most "no fault" states, but very rarely used). Separation cannot simply be when they were no longer sharing a bed. They must live in different residences. This is the law in North Carolina.

    Yeah, you guys where all right about the 1 year separation. Today is exactly one year over with me, so the law sais it has to be 1 year and one day... so from tomorrow I could file, and I guess I will, even if I have to pay again alot of money to my lawyer, beacuse my ex will definitly not file, even though he still has to pay our health insurance of over $ 400 a month, and that should hurt.. oh well.. he wants to safe at least the expenses with the divorce... all I can hope now, is to receive the divorce decree withn the next 30 days, or my chances are over and I have to go to immigration court, I guess... crazy law.... but what to do... thanks for all your support!!!

  9. I can't remember your exact circumstances, so please fill in the blanks for me.

    Did you send a waiver I-751 in December? If so, did you check box "d" only, or did you also check the box that indicates that you would suffer extreme hardship if removed from the USA?

    Aliens are often under the impression that they can only mark one ground for a waiver, when in fact, they can use all that apply.

    Is the deadline for submission of your I-751 July 20, 2009?

    I don't know what to do, so closed to get my divorce, in 3 days my 1 year separation is over and I can file for divorce, but i am afraid I dont have enough time to submitt the divorce papers until july 20!! To go to court and get the divorce is not that fast....and my ex might even ask for an extention.... the letter from immigration sates, if I dont submitt the evidence, I will be put in removal... oh my God.. and I have built up a life here with my little daughter.... any ideas or advise what I could do? Thanks so much....

    No, its more complicated.. I sent the I-751 last december, then got a extention for a year after acceptance. They accepted it even thought I had only the official separation agreement and not the final divorce, because in NC you have to wait one year for divorce. So I thought all is fine and I got enough time within the year to get my divorce. But then I kinda "woke up" the sleeping lions, because I didnt get an appointment for my daughter for going to Biometrics like i did and I called service center about it because I payed for my daughters Biometrics as well and her card expires in july... well, they couldnt help me and sent me for an infopass appointment but they coulldnt help me eighter and just informed the USCIS... I hoped to get finally the appointment for my daughter to get her Biometrics and extension letter as well, but no.... all I got was this awfull letter where they write me, "Request of evidence" the final divorce is missing and I have to submitt it latest by july 20 or I will be put under removal... no word about my daughters situation..... it sucks... and I am scared...... it is not my fault that NC has a year separation time! And is not my fault eighter that my soon to be ex was a complete jerk! Am sorry..........thanks

    Nope, I HAD to check only one! Before I tried to check to, included the extrem hardship one, but they have sent me the petition back with the remark, I can only check ONE..... so I decided to try the dirovce one, because I knew I will get it, earlyer or later... and I was lucky they accepted the petiton even without the final divorce.. well, guess not so lucky after all now.......

  12. I thought I had to share this in here, I was so hopeless when I sent my petition begin of this year with only my court papers from my separation. But, they accepted my petition and gave me the 1 year extention letter and Biometrics to go. So, guys, don't loose your hope, if you havent received the final divorce papers yet!!!

    Dont be confused, I just never updated my profile in here, was not online for a very very long time.. so many problems to solve.... sorry, I have to remove the conditions on my 2 year greencard by myself now, due to separation. Mid june I iwll be separated 1 year officialy and able to ask for my divorce.. so complicated...

I filed for removal of conditions by myself with waiver due to separation and waiting for my divorce now ( NC law 1 year waiting time) I got the extention letter for 1 year and wait now to send my divorce papers as soon as I get a divorce. Now I got laid off and have no job. I am a single mom without child support or alimony. I thought about going to social services to apply for help. But I do not know if I am eligible because my ex signed the affidavit of support when he married me. ( But he made me sign in the court papers that I wont go after him if I need help from governement) So, if I am able to get help, would it affect the decision if I will get a 10 year greencard? I dont want to take any risks, but I am desperate as well...

  14. I thought the same before, but they returned my petition 2 days ago with the remark, I can "check" ONLY ONE not more.... so I choosed the "good faith" . Guess I should have choosen the 'extrem hardship" instead and wait until I file again for the other one when I got the divorce decree in hand..

    Can I widdraw the first petition anytime, when I receive the divorce decree and file new again??

    The instructions on form I-751 are fairly explicit. It states that the alien should select any of the grounds that apply. One can select more than one if more than one apply. The problem that I see is that without your marriage being terminated, the "good faith" ground does not apply yet.

    I acctually sent the petition with both reasons marked, one for extreme hardship and one with divorce decree.. but, they have sent the petition back to me, with the note that I can only remove the conditions for one reason, not more. So I thought let me resend it and mark just the one which needs a divorce decree, hoping they will accept it. Anyways, I guess the best I can do for now is, wait until they send it back once more and probably try the extreme hardship.. Question: should i still send all my copies to proof the marriage in good faith and all the statements of my friends? Or wait with all this until I can file again when I got the divorce decree in hand?? Thanks so much.. its crazy..
