  1. Hi all,

The VisaJourney AoS checklist for K-1 visa holders ( that " The fee for I-485 applications includes the cost of the I-131 and I-765 (no need to pay for them if filed with or while your I-485 application is pending adjudication)."

But, I cannot find any evidence of this from USCIS. The instructions on Form I-765 say that there is no fee required for ©(9) category if it is a renewal EAD, only. If Visajourney is right, can anyone point me to an official source that verifies it? Or does anyone know from experience that Visajourney is wrong?

    Thanks!

  2. Hi all,

I am a US citizen and currently in the process of applying for a K-1 visa for my fiance. She has a 4-year-old son but has never been married and has full custody of her child. They will both come to the US when the K-1/K-2 visa is approved. I want to formally adopt her son so that we are both his legal parents, but it has been difficult to find information about this type of situation. Do I need to adopt him from his native country (Mongolia) or can I adopt in the US after he is a permanent resident?

    Thanks!

  3. Thanks for your reply Owen.

I am a US citizen. I have filed tax returns for the last three years. I am wondering about filing my 2014 tax return (April of next year). I thought about this because on the form I-864 you are instructed to enter "total income" from Form 1040, which is near-zero if I file for the foreign earned income tax credit, but it is sufficiently above 125% of the poverty level if I do not claim exemption for foreign earned income. I just wonder how USCIS would look at this situation.

  4. Hi All,

I'm an expat, have been working abroad since mid-2012 and now am trying to bring my fiance to the US. I'm trying to figure out the best way to prove that I can support her given the US-earned income requirement. I had the idea that if I file my 2014 tax return as a US resident (I've maintained a permanent US address, and am paid into a US account by a US company), and pay taxes for the year (don't exlude my foreign earned income) then maybe that would be sufficient for the I-134 even though I was actually living abroad while earning that money? Has anyone tried this or has thoughts about whether this is legit or could work?

    Thanks in advance!
