My sister and her family came back to the USA yesterday, they had their immigration at philly. They were detained in immigration for hours due to the fact that they had travelled on an ESTA and not on their green cards. They never asked any questions besides place of stay, money. The computer work on their side took the longest time

They will leave on their 83rd day - they have been emailing and calling the US embassy in London but so far nothing.

They have been here for 3 months - their father is serious in hospital so they are wanting to comeback ASAP a week at the most.

Is there a minimum time they have to stay out of the US before they can return, trying to get an appointment at the US embassy London is impossible, booked months ahead. So they are going to return on the visa waiver program for 3 months

Thanks for your reply, I think they have decided to give up on renewing the green cards as there is very little chance and the length of time, I think just applying for visa at the U.S. Embassy for 6 moths and go from there.

They have been here for 2 months, they are due to go back in a couple of weeks, they went to immigration office in sfo and were advised apply to reinstate their green card back in the U.K. Now the worry is if they apply to reinstate and if they reject will they allow them to come and visit

if he has the money to sponsor them he can apply for them to adjust status so they can remain while it processes and if they do not want to stay permanently they can relinquish the greencards on the way out. to use vwp again.
His kids are still here unfortunately he is on a life support machine, slight improvement, so him sponsoring them would not be option

The children are over 21 now, does it make any difference that they were all under 18 when he became a citizen,
they all all had green cards but due to school unit they were coming and going from the U.S. When they graduated and got jobs they decided to stay in the U.K. Hoping their father would join them. Doctors have just told them this take months for him to recover and that is if he does. It's a tough decision for them.

He is a US citizen, his kids had green cards but they stayed out of the USA for too long due to work and school. I am not sure what choice we have other than a visitors visa.

Looks like it's going to be a long term - not even sure if he is going to pull through. I think she was looking at applying for a visa when she gets back to the U.K. - it's always a risk of them denying it.

My niece is visiting her father due to a severe illness, would it possible to extend her visa as her father is still in serious condition, they gave her a 3 months visa

thanks to all for your help,otherwise o would be still trying to register my children. I finally sent my off for the passports, i took a screenshot of the website and showed the post office what they needed. Thankfully the clerk was aware of the process.

I applied for a British Passport for my daughter who was born in the US, that was so simple.

I called the US passport office and they told me to contact the US immigration, They told me to fill out a N600 - and apply for a certificate of citizenship at a cost of $1200.

no one has any idea what should be done, Passport office in USA say call US embassy in Uk, There has to be a solution besides having to go back to the USA but then I guess some of the fees these people are asking it might be cheaper

yes they did enter on an esta visa, we were thinking they would automatically become US citizen since both parents are, but not the case I guess. They did not enter illegally as they have a british passport. but I guess could be illegal now.

sorry forgot to mention, we have british citizenship too, they entered in on the british passport, they are 1 1/2 and 4 years old

thank you for your reply Mark, thats what I thought but when I applied for a US passport and they told me I had to get a CRBA from the UK. I have downloaded the forms to fill out but not sure what to do with them, one of the passport agencies wanted $600 for just the forms.

How do you register children born in the Uk to US citizens now that we live in the USA. We didn't realize that we had to do this.

So today it was my interview day, I arrived at the San francisco office all excited 30 minutes early, the place was empty, that was a bit surprising, any way queued up at the reception, presented my appointment letter to the receptionist, She went through one list, then another list and then another one, then a folder, then to my horror she says there is no appointment for you. She had the Letter in hand with todays date the 8th June 2015 8am, today is 8th june 2015 7.45am. So she checked in the computer and said your appointment was cancelled cause we didn't receive your file or something, Something was a concern but thats all I could get from her beside the fact they called me and mailed me a cancellation letter which I never received or any phone calls from them. I made an info pass and saw a lady who was puzzled as I was and sent me back upstairs again, I spoke to another lady and she told me the same a letter was sent and the reason was maybe your finger prints were not back or not up to standard. Not to convincing- I called and spoke to a supervisor and he was unable to give me any information as to why it was cancelled. So I guess the wait is on again

So like I said in my previous they gave my sister and her family a hard time at the immigration in philly as to why they travelled on an ESTA visa instead of their green cards - I am guessing they saw the entry stamp from a few years ago or maybe the system alerted them. The immigration officer asked for their green cards and took them for a secondary interview. My sister explained to them they were traveling on an ESTA due to the fact they stayed out of the country for too long and were advised not to travel on their green cards by the US embassy. Not many questions but very harsh. After a few hours of wait and threats of refusing entry and explanation to 4 immigration officers they allowed them in. However the strange things is they withdrew the ESTA visa and let them in on their green cards. Gave my sister a good telling off for not traveling on her green card.
