  1. Dear all,

here is my current situation and question:

My wife and I successfully submitted all paperwork which had been approved.

After about one month I received my travel and work permit card.

Recently we had the interview and all went well and they told me the card should be mail to me within a month or so.

Now I used the travel permit and went to visit my parents in europe for 18 days.

Now I am curious with the following situation:

What if the greencard is getting mailed to my home address in USA while I am still outside only traveling with the travel permit.

Is there any trouble if I did not wait for the GC?

I was not sure when it would be mailed to me and therefore I decided to travel.

    It all went very fast.

    As always, thx

  2. Hello,

    here a little background:

I am from Europe, my wife a US citizen. Me and my wife are a couple since 5 years. I proposed to her during my second to last visit in the US but we never really rushed with a wedding ceremony.

I returned back to Europe but soon after I had another free time-window where I could visit her.

I travelled to the US again on ESTA and she convinced me to start our wedding planning and to get married.

After the civil wedding we were undecisive if I should go back to Europe and apply for the GC through consular processing or stay and do all the paperwork. We decided to do it here because I we read it is much faster.

Luckily, due to my frequent traveling and a previous research scholar in the US I had all the paperwork ready for the AOS.

We successfully filed I-130, I-485,......and got the interview notice after about three months time.

Now here are the important questions:

The intent of my most recent visit was only to visit her and we decided afterwards get married and to proceed with the paperwork in the US. What would be the best way to explain this situation if the question arises.

Also, I had all my paperwork with me. That is just what I do all the time. I always carry all the diplomas, degrees, certificates with me. How would they approach that explanation.

    THX

  3. Hello,

thanks for the answers so far.

    I am a bit confused, the CR-1 is the I-485? I haven't read about CR-1.

I can imagine if we go with option A it takes avery long time but having the possibility to travel and visit makes it a lot easier.

If I travel to the US while I do the consular processing / I-485 but back from Europe, do I travel to the US on ESTA again?

In the long run we would like to stay in the US and our main motivation was to deal with this paperwork as soon as possible.

    THX

  4. Hello, I need your advices, please read my current situation:

Me and my girlfriend decided to get married after a four year relationship.
I entered the United States under ESTA and now we are waiting to get the approved marriage license back.
Now we are discussing two options and need your experiences:
    Option A:
Submission of I-130 now, then return to home and do the rest of paperwork by consular processing.
    Option B:
Submit I-130 and I-485 together in addition with travel permit and work permit.
Issue: Wedding license might get back by mail after my 90 day stay.
    Questions:
1.) If we proceed by option A, I think we do it the more official way but it probably will take longer?
2.) In option A can I go and visit my wife on a ESTA visa? If not, are there alternatives? Generally how are my travel options during application processing?
3.) In option B I feel I am staying in the US without occupation which is stressful. How do you deal with that?
4.) Is a possible overstay from the 90 day period a real issue or not?
5.) After receiving the Green card I must stay in the US? Or how in general are the possibilities to be in and outside the country? Is there a minimum amount of time I need to stay inside or outside the country?
    THX in advance
