  1. Hey everyone, just have a couple of questions if anyone can shed some light on them.

    I have completed the biometrics, and am currently waiting for the notice of my interview date.

    However even though through the USCIS website, it says, that they are ready to schedule the interview, and that I should receive a notice for the interview date, by December 26th, if not then I have to request it!

    Well its December 28th, have not received anything, so I have sent for request.

    my question is:

    1. has anyone else had this problem of not receiving the notice, I haven't moved addresses or anything,

    2. they said I should have a reply from them about my request by January 17th, is there no way to find out sooner?

    3. what if I miss the interview date due to them not sending/me receiving the interview date!

    Any other info would be greatly appreciated, thanks for reading.

    My date (December 26) also passed without an interview. I also sent e-request. I'm in Phoenix and I read another couple (also Phoenix, Sept thread) and who is a over a month ahead of me in their timeline (their notice should have arrived Dec 1), still hasn't got their date yet so I think we are all just a number. Just have to wait your turn.

  2. I didn't add my wife to my work health policy as she will be out of country until her CR-1 visa is issued. I don't expect her to arrive until the second half of the year. Will I need to get one of the Obamacare policies to avoid a penalty once she gets here?

    You should be able to add her to your work health insurance plan but if not you can buy insurance on the marketplace as this is a life event etc. This has to be done within 60 DAYS OF ARRIVING (visa arrival date in her passport) or else she will have to wait until November (next enrolment date). They will ask her for her A# and she may have to provide a copy of her visa etc at some future point in time. Just went through all of this! Shop around if you buy on the marketplace - you don't necessarily have to buy on the marketplace you can buy directly from the insurance company. They will all ask for the same thing (A# and date).

  3. My poor husband is all upset because his Australian drivers license expires tomorrow and we have to have the I-551 stamp before he can get one in Tennessee. He's, also, freaking out because our I485 still shows "On September 15, 2014, we accepted the fingerprint fee for your Form I-485," blah blah. Any tips on if there's something I should do now? We're having to send his EAD back since it's got the wrong bday on it, they did email us about it on Dec 13th.

    I live in AZ and you are required to have a SSN in order to get a DL. After waiting and waiting for my EAD from immigration I called up DMV (pretty ticked) and asked why should I be penalized because immigration is backlogged (also mentioned that I was here LEGALLY and had done everything asked by immigration).

    They told me to go to the DMV and "do a walk in appointment and speak to a Supervisor". I had to bring all my paperwork (797 showing I filed for AOS etc, along with Alien & Departure numbers). The supervisor issued me a temporary (2 year) DL. I had to pass the written test and I was out the door in 2.5 hours. I also showed them the 797 showing that biometrics had been done (stamped). Maybe worth a trip down to speak to a supervisor!

USCIS service centers will automatically schedule a district office interview in cases where legal status must be validated, identity must be validated, there is evidence of fraud, the person has a class A or B medical condition, there is doubt about the person's qualifications or admissibility, or this is the second time the I-485 application was filed.

    Interviews will not be waived for cases involving entry without inspection (EWI), otherwise known as illegal entry. If you did not provide evidence with your application showing that when you entered the US, an immigration officer inspected, paroled, or interviewed you, the case will automatically be scheduled for an I-485 interview. Interviews will not be waived for cases filed with I-485 Supplement A, or in family cases where one of the applications does not meet interviewee for criteria.

    This is some information about interview waivers that I have found online. It's hard to anticipate if you'll get one or not. There were couples with a baby who still got an interview, even thought one might think they are for sure a real couple since they have a baby together.

    It does seem that if you have an interview you get your green card sooner than with a waiver based on the experience of other forum members. Therefore, I'd prefer to have an interview.

    Today I have opened my social security account online as I'm hoping to be able to find out when my name changes in the system this way. The only way I believe I could verify this online is by pressing the button "Get a Benefit Verification Letter" where you are referred to in your full name. They are still referring to me in my maiden name. So I believe it was still not updated in the system. I'll check it every day until I get my new card in the mail. So curious of when is going to change online! The mailing process must take at least 2 days I believe.

    I did not receive an interview waiver and I've been married to a US born citizen for 24 years! Our children are dual citizens and attend university in the USA. We got stuck in the backlog in 2013 and waited 13 months before we finally got a K3 in 2014. Applied for 485 and still waiting (even though I-130 has been approved). You would think this process would be faster! I've just given up trying to figure out how they process our files.

    As my interview is getting closer, I wonder if someone can tell me if they require from you to translate your French documents when you go through your interview in Montreal? Since the Quebec is a French speaking province...

    Cause I have a document in French that I am going to take with me at the interview and I wonder if I should translate it or if it is not useful...?

    If someone went through his/her interview here in Montreal with some French documents and can help me? :)

    I had my interview in Vancouver and it wasn't required. They said the french birth certificates are easy enough to understand (he actually laughed).

    Sent AOS papers in with Fr. BC and still no RFE. Got my interview coming up.

  6. Hello Guys I got my EAD combo just now and I will be rushing to DMV, Bank to open an account and go to my new employer to complete my document tomorrow. I am so happy and got teary eyed and I hope everyone of us will have a Merry Merry Christmas!

    I went to the DMV in AZ yesterday and got my license. I do not have a SSN as required etc. All you need is your Arrival Departure number/passport and your I-797C showing you've applied for your AOS. (Nobody tells you this and it's not on the site.) The Supervisor had to approve it. I just explained to them I am a LEGAL resident in the USA and I shouldn't be penalized because of Immigration backlogs. I had to take the written but I left with license in hand. They folks at DMV were very nice. Brought ALL my paperwork with me (just in case). So aside from my library card I now have a DL!!! Yahoo!

  7. We changed our mind twice! I just stopped responding and then they sent me a letter telling me I had within a year to respond etc. They sent a final letter after a year telling me the application had basically ended and that I would have to submit a new application if I wanted to move to the US. In both times I never had to show anything at border crossings (probably cause my car and house were in Canada). People change their minds.

  9. I sent package (i-130, i-485, i-131,i-765) october 22th, arrived to chicago lockbox at late afternoon on friday they received formal online on monday October 27th and biometrics appontment was on November 24th, 2014.

    on December 1st they change status on my 1-485 to Ready To Be Scheduled For An Interview, one week and no news on my mail, I dont know if is delayed in scheduling an interview for christmas season or Phoenix office is very busy (my biometrics appt took 1 hr to wait in the line, so crowded with people), no changes on my i-130, AP or EAD only case was received.

    it says on my case status:

    Case Is Ready To Be Scheduled For An Interview

    As of December 1, 2014, we are ready to schedule your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSCXXXXXX, for an interview. We will schedule your interview and send you a notice. Please follow any instructions in the notice. If you do not receive your interview notice by December 31, 2014, please go to www.uscis.gov/e-request to request a copy of the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

  10. We got a letter this weekend from USCIS that said two important things:

    (1) We have been flagged as a potential interview waiver case. (No interview needed.)

    (2) Due to a workload problem, there may be a significant delay in processing the case. The anticipated delay is six months from the date of letter.

    Wow! Six MORE months? We filed in July. Anybody else get this letter about the workload delays?

    So when you get this letter, and your file is now delayed six months, will you be required to submit new tax transcript for 2014?
