    I just did the vaccinations too, Hepatitis B is mandatory here in the US, vacciantion for the "varicella" how we call it in Europe is included in the MMR vaccination which they gave me too ( allthough I had had measles when I was little, and allthough they had already given me vaccainations at the US consulate before getting to the States, but since I had no records of it they had to give it to me again).

    It looks like this doctor doesn't know what he's doing, did you check with the INS to make sure this doctor really works with immigration? When I picked mine, his name was on the INS website, but I called to National Number just to make sure.

I don't know if this would apply to your case, but I know of somebody who was stuck out of the country because traveled only with an extention of K3 status ( k3 visa expired) thinking that would be enough to come back into the country, that didn't work........in the end I don't know exactly how, she got back into the country requesting permission to the local custom border protection......you may want to check into that

    I think that's what I'm going to do , contact a congressman.

    I wouldn't think my application has been denied, because in February the Missouri Center was still processing applications dated Dec 2003, that is 8 months away from the date on mine.......that's what happened for you too? Or your processing date had been already passed when you checked?

    But anyway I will take no chances and try to take care of this ASAP.

  4. Hi everybody.

    I was wondering if somebody could tell me something about this.......

    The last time I checked my case status online for AOS, it said that the last notice they sent to me had been returned to the INS as undeliverable by the post office on October 12 2005.

    I found out this in November, since then I called the National Number 6 times and everytime they told me a referral had been made to have that notice resent to me, but since the month of october I still havent' received that letter yet.........I made an appoinment with the local INS office, and all they could tell me was the same thing ( they had sent me a notice that was returned to them on October 12) so I wrote a letter to the Missouri National Center, where my application is, explaining the situation and asking them to resend me the notice.........I know they got the letter, because I received a return receipt, but it's been a month and I still haven't received anything...........I checked with the post office several times to make sure, and everything is right.........I am worried, becasue the processing dates for AOS in Missuri was only 6 months before my date, so it's getting close, but I don't know waht they wanted from me and I don't know if there something they were telling me to do since the processing date is approaching.............basicly I don't have a clue on what's going on with my case........all I know is that the processing date was someday in Dec 2003, and my application is dated August 2004.......should I contact a lawer or my congressman?

    I hate to waist all this time, if there is something I should be doing instead, the officer I talked to said that maybe they were telling me to proceed with the medical examination......but there was no way he could see what that notice said......has this ever happend to somebody else?

  5. I think you should go personally to the local INS office to tell about the situation, I don't know if where you are at they accept walk-ins, here they don't....so make an appointment through infopoint.

    At the same time I would write a letter, explaining the situation, and mailing via express with return receipt to the office processing your EAD application.....it seems that now they don't do appointment for fingerprints anymore by phone, usually they send a letter, but apparently you never got it!

    I could speak in Italian, since I'm from Napoli! But I guess I'll write in English.

    Well, I did my K3 visa in Naples too about three years ago......I've been in the States for 3 years now, but anyway it's not really an interview, unless things have changed, you go there, do your medical examination, bring your two pictures and they give you the visa the very same day, at the time we just waited in the visa section waiiting room and they called us by name and gave us the passport with the visa stamped on it....that was it, no formal interview at all.

    So it was pretty easy and I do think they were really nice and professional people. Let me know if you have any more questions.

  7. Hi, I am very pleased to say that after extensive waiting on the embassy in London.... I finally have my wife here in California.

    Yet now that she is here, I am not sure which forms I need to fill out next. Especially pertaining to 1-ability to work, and 2-social security card (this is especially important because we can't sign her up for health insurance without one)

    Anyone out there with some experience and/or knowledge on this, I would love to hear from you.

    Something else, we have already had the I-130 approved and have just recieved a letter saying that I need to send in another $70 for the affidavid of support. Do I need to do this if we just send in an adjustment of status application? As you can see, I am getting myself a bit confused here. And what does EAD stand for? I know it is to work, but I don't know what the acronym stands for. and I don't know what I need to do to apply for it.

    I came to the U.S. with a K3 visa too. When I arrived my I-130 had not been approved yet, so I could not apply for Adjustment of Status yet. But I could apply and receive with no problem an EAD (Employment Authorization Document) and Social Security Number.

    So to answer your question, send in the money for the Affidavit (regarding form 1-130) and at the same time apply for Adjustment of Status ( I-485) and for EAD (I-765) once you have EAD you can go and get a social security number.....it took me a little less than three months to get my EAD

    today I finally got to speak to an immigration officer in person.....he said it doesn't matter I obtained a K3 status extention, I don't need to worry about that, since I have an adjustment of status application pending, therefore I do qualify for a Travel Document. So I can go ahead and file form I-131, I still wont' be totally relaxed untill they actually issue it for me......but at leas things are more clear now............so unless you have not applied for adjustment of status...........you DON'T NEED to extend your k3 status!!!!

  9. That is probably what I will do, allthough I can immagine somebody seeing that K3 status extention and quickly and automatically dismissing my application telling me to obtain a new K3 visa overseas at the local consular authorities.

    I will write a detailed letter with my application, if they deny it, then I will probably see a lawyer.

    In any case I will keep you posted!

    I have one more question, is somebody allowed to apply and obtain Advance Parole only once? Or is it something that once expired can be renewed and obtained again?

    So basicly you are saying, that allthough I obtained an extention of K3 status ( valid untill August 2007) I can still apply for Advance Parole? I coud just show them my I-485 is pending, without sending a copy of the letter of K3 status extention. Or should I wait untill this extention expires and then apply for AP, if I have not received my green card yet? If I had never applied for the extention I wouldn't have this problem now, basicly I thought I was doing something right, but I really didn't.

    Concerning that stamp, I strongly suspect it's the I-551 stamp too.....so that won't apply to me yet.

    I am in the same situation, I entered the country with a K3 visa and applied for adjustment of status, but it's been two years and I still don't have my green card. My original K3 visa expired in August 2005, I wanted to go back to my country for a couple of weeks, so I applied and obtained an extention of K3 staus ( form I-539) thinking this would give me the same rights as my initial K3 visa. But that was not true, the INS said the extention of K3 status document is not sufficient to be readimetted to the States if I leave the country and that once in my homecoutnry I should obtained an other visa at the local american consulate. Well, to make sure I contacted the consulate overseas and the State Department here in the States, and they don't know anything about it, they say that it is not up to them, they issued the k3 visa the first time and now I should receive a stamp in my passport from the INS before leaving the States that allows me to come back. Well that is not what the INS is saying.

    I cannot apply for Advance Parole, because that doesn't apply to people in K3 status .

    Basicly this is a "crack" in the system, they give a K3 visa valididy for only two years, because they assume in two years one would be all set and get a green card, but they didn't assume that would be such a backlog in processing times in certain cities, I leave in Orlando, and the processing times are extremely long.......so basicly it seems I am stuck, there's not even a low that applies to my case, if I hadn't applied for extention of K3 status, at least I would have been able to apply for Advance Parole, now I have to wait to get my green card to be able to visit my country and family again, and the process doesn't seem to be near to a conclusion any time soon. At this point I would like to know what are the benefits of a K3 status extention?

    your wife will be able to go in and out of the country as far as her K3 visa is still valid, after that apparently she won't be able to leave the country, but hopefully by the expiration date of her K3 visa she will alredy have a green card.
