I am American and my fiance' is South African.

We are planning on getting married in Costa Rica and want to start filing for his K-3 visa immedietly.

Problem is that there is not a consulate here, only a US Embassy.

Are we able to process these documents by sending them directly to USCIS and when the interview comes he can return to his home country and then return to Costa Rica where we are working?

My fiance' and I are currently living in Costa Rica.

I am American and he is from South Africa.

He has a tourist visa for the USA to enter 6 months at a time and he has had the visa for over 2 years.

We plan on returning to the states this summer and getting married, then applying for a Visa.

We have heard many stories that this is not ok (Visa fraud) as well as that it is possible to marry while he is on a Traveler's Visa.

Any advice on the subject?

Also, if we get married here in Costa Rica and apply for a K-3 do I have to return to the United States? Or can we both stay here in Costa Rica and wait out the Process??

We plan on getting married this summer in the USA and he will enter in on a Traveler's Visa.

Does anyone know if this is considered visa fraud or the implications in which to make the transition easier?
