  1. The current annual income does not have to match the income from her last tax return. She files jointly too, so it won't match anyway. Her income is combined with her husband's on their joint taxes. Just take all her incomes and combine them. Use that amount and provide all the documents you just listed, plus perhaps some pay stubs and pension benefits letter to prove the incomes. It also can help to provide bank statements to show how much income is deposited each month, especially if any of the income is non-taxable.

  2. Yes, she files an I-864 and her husband provides an I-864A to go with her I-864.

    If she earns more income than just the pension, then why only list the pension income? Put her total current individual income from all sources combined together. Provide documents that prove all the incomes.

    I was actually thinking about putting all her total individual income. But I am having a difficult time figuring out how it doesn't match the total gross income stated on their jointly filed ITR. She has a W2 which is from her part time job, 1099 R from her pension monthly ans 1099 misc from Assisted Living Professionals LLC. I don't understand those forms. If I add them, it doesn't match the total gross income on their ITR.

    Pls help!

    I have a question:

    So my mom in law is the co sponsor. She is a retired nurse and she filed tax jointly with my dad in law. Both of them are retired already. Mom in law will file i864 and dad in law will file i864a, right?

    Qestion:

    On part 6 of my mom in law's i864, will she put her annual individual gross income there from her pension? what if she has any other sources of income declared on her income tax aside from her pension? would it be okay if she will just enter there her gross income from pension as long as it exceeds the income requirement?

  4. Is someone going to fill out an I-864A to go along with her I-864? If yes, then put a 1 there and fill out the person's info on the I-864 where it asks. If no, then you would not put a 1 there.

    yes, it's my dad in law since they filed ITR together with my mom-in-law. he will submit form i864a. btw, which part of i864 about him my mom in law would fill out?

  5. Husband/petitioner/primary sponsor = I-864

    Mother/joint sponsor = Own separate I-864

    If the mom is married and files taxes jointly, her spouse can fill out an I-864A to go along with her I-864 and their incomes will be combined to act as joint sponsorship.

  6. If the husband and his mom are financially tied (one claims the other on the tax return), use I-864A for mom. Otherwise, use I-864 for both, as just living together doesn't mean you are a household for sponsorship purposes.

    The only requirement is that they make enouhg and can prove it with pay stubs etc, and that they are a USC or greencard holder living in the USA (show passport).

    I don't think my husband is a dependent on his mom's ITR because my husband is working too (it's just that he doesn't earn much) and doesn't claim his mom as a dependent either on his ITR. So it means they will both use form i864? :)

    What if my husband's / mom in law's passport has expired, can I still use their passport biopage for submission?

  7. Hello everyone!!! We're preparing the documents needed for the Adjustment of Status. My husband's income doesn't meet the Poverty Income Requirement. My mom in law will be the co sponsor and we're living under the same roof. Her income exceeds the income requirement under 5 household size. She is also the co sponsor when my husband petitioned me under fiance visa.

    Question:

    - What form should my mother in law fill out? Is it the Form I864 or Form I864A?

    - What are the other requirements needed for a co sponsor?

  8. My wife just had her interview in Manila on the morning of April 15 (Philippines time). By the end of day (Philippines time) her visa status changed from "Ready" to "Issued".

    wow!!! congrats!! my status is still READY. I dunno what's happening. I was not under 221g either. Hope it will be issued this week

  9. Hello everyone!!! I had my interview last Monday, April 13, 2015. I just checked my visa status online but it's still on "READY". How long does it usually take to have it issued or delivered? Your answers are greatly appreciated. :goofy:(L):idea:

  10. Most file electronically these days, so no issue. The actual ITR is on record with the IRS.

    Oh I see. I was really worried and had argued with my fiance. I thought his signature is needed for the ITR. Such a big help. Thanks!! :) Yea, his AOS has his signature on it as well as his mom's.

  11. The tax return and W2 are listed in the embassy instructions letter, if you are asked for these and do not have the ITR you will get a 221g, not everyone is asked for these lately. BTW if your fiance has not filed his 2014 ITR then he should send a copy of his 2013 as that is the most recent tax return (until the 15th of April, unless an extension is filed)

    My fiance has sent me thru email his 2013 ITR, does he need to attach a signature? Some people say no need to coz it's electronically filed. Can someone please enlighten me on this? His mom's ITR also has no signature on it.

    thanks guys! hope so the consuls won't be asking for an ITR or any other documents. Geez! I'm nervous! My interview will be on April 13. My fiance just sent me his 2013 ITR coz he started working 2011 or 2012 I guess. Do you think I'm already good to go?

  13. The embassy instructions letter states - most recent tax return and W2. Employment letters, pay stubs and bank statements are secondary and usually not asked for.

    EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form may be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You may also be asked to submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

  14. Hello everyone! please enlighten me. I only have here a copy of my fiance's 2013-2014 W2, pay stubs, letter of employment, bank statements and affidavit of support. He said he doesn't have an ITR and he's still working on his 2014 ITR. Do you think I'll be under 221g or denied due to lack of ITR? TIA

  16. If the sibling are no longer dependents but simply live at home they are not counted in regards to the I-134, but if they are all still claimed by mom on her taxes she must also list them as dependents on the I-134, along with you.

    but is it okay if her mom is a retired nurse and depends only on her monthly pension for her income? She has assets too and is currently self employed on their nursing home. would it help? thanks!

  17. Does his mom claim the siblings as dependents on her taxes or do they just live at home?

    That I will ask from my fiance then. Btw, how does it work if her mom declared as dependents her children including my fiance and if they only live at home? Thanks!

  18. Thanks guys for your replies. It helped a lot. Another thing that concerns me though is his mom is a retired nurse and apparently depends on her monthly pension for her income. My fiance has three siblings all living in one household under his parents and I'm wondering if it's possible for her to qualify as a co sponsor. I would really appreciate if you guys have any idea about this. Thanks! :)

  19. Hello everyone! I am planning to have my interview at the Manila US Embassy in April. I'm wondering if they accept co sponsors? If they do, what are the requirements that the co sponsor needs to submit? He's planning to have his mom as the co sponsor because his 2014 annual income does not reach the 125% in Poverty Guideline. I am worried because they might look for the documents. Thanks in advance! :goofy:
