  1. That's insane! Surely it can't take that long to read an I-864 and see that it is all there and correct? How can it be that they can send the Visa to you just a day or so after the interview, and yet in this case, when they already have had the documents, they could take that long? What are they doing in there???

  2. Sorry, I have just read a couple of threads that seem to have similar difficulties with London/SMS recently. I perhaps should have just replied to those.

    But please can someone still let me know what options I might have available to me?

    What is the thing about getting the USC to call the department of State? Is that likely to help in my case?

  3. Hi there.

    I had my CR-I Visa interview in London on Nov 1st. Whole thing seemed to be going swimmingly until the Consular Office said "Well, your application appears to be fine, except...."

    Turns out that because my wife (USC) had not filed taxes in the last 3 years (she was a student, in the US then UK), they were not willing not accept her as a sole sponsor - despite the fact that she has been earning double the poverty limit since February, and we had lots of documentation explaining why she did not file, a letter from her employer etc, and had even seen stories on the forums of people who had not filed but we now earning enough who had been approved! However, whatever I said, the guy wouldn't budge, and he sent me home with a blue form saying my application has been 'suspended under section 221(g) etc'...

    So, I immediately called my wife and told her the news, and she got her dad to fill out an I-864 as joint-sponsor and overnighted the documents to me. I have now sent them to the Embassy to process, and then hopefully they will send me the Visa... but when????? The Consular Officer made out as if all I had to do send the documents, then they'd read them, and send me back the visa in a couple of days... hasn't happened...

    I tried calling the information line and the guy i spoke to was obviously not at the Embassy but in a call centre somewhere (in Scotland, i imagine, since everyone i speak to on the Immigrant visa line seems to be Scottish!), and he told me that he didn't have that sort of information available, but that it would probably take them 10 working days to process!

    Why such a big discrepancy? And does anyone have any idea of what I can or what number to call to actually talk to someone at the embassy who might be able to confirm what's actually going on and maybe speed it up???

    I was really hoping to be able to spend Thanksgiving with my wife and her family in the US for the first time!

    How can I access where the law/regulation you quoted?

    I don't really know what you mean - are you making a subtle joke/hint? If you are, those things don't translate so well when one is so nervous about flunking the interview!

    That definitely would be a good way to word things though....

    Did your future employer really give you unpaid research work to do, or did you start doing some research on your own to prepare yourself to 'hit the ground running'?

  5. Hi everyone,

    I am due to have my K-3 interview in London on November 1st, and firstly, would appreicate it if anyoen could give me some quick tips on what to take with me on the day.

    Also, and here's where things get a bit complicated.... i am actually here in the US visiting my wife, and have been since September (having been barely asked any questions at the airport - I got an immigration official who was more concerned with making jokes than asking me about why i was here). During this time, I sent my resume to a prospective employer who has since interviewed me, and decided that he will employ me if my visa application is succesful. Since then, he has been introducing me to people at the production company (he is a film and tv producer), allowing me to sit-in on meetings, and also giving me (unpaid) research work to do - basically an unpaid internship in all but name.

    Now, with my interview pending, he has kindly offered to write a letter stating that he woudl like to employ me in the future. However, I am unsure of the legality of what I have been doing, and at this stage I don't want to further jeopardise my application.

    So, do people think the letter of recommendation will help or hinder my case? Do you have any suggestions of how it might be best to word it, or has anyone done anything like this before?

    My wife (the US citizen) and I have sent off our DS-230 and I-864 forms on our visa application, and are waiting to hear whether they are forwarded to London and i get an interview date etc...

    But then, I just got an email from USCIS yesterday, stating that our I-129F petition (which we filed around the same time as the I-130) has been approved.... so what does that mean?

    I have seen some other people with similar timelines to ours (notable simple_male) cancelled their I-129 a while back - should we do this also, and what are the consequences/benefits of having both tracks running together at this stage of the process?

    Sorry, i know i should look this up but your responses are also so much more direct and helpful!

    Is that the actual copy of tax return, or will the transcript be enough? Sorry, i'm sure this has already been addressed elsewhere, but in the light of all this new form/old form confusion i'd like some clarification.

    We also received the old I-864, but with instructions that say it does not have to be notarised (although did anyone else think this was very sneakily put it only one line of the instructions, with hardly any fanfare, so it could be easily missed?!). So i guess we will follow your lead, simple male.....

    Tax transcript from IRS will suffice it? Did you get it from IRS?

    Yes. Well, we have asked for it - it hasn't arrived yet! But, hey, what's one more delay...? Grumble, grumble...

  9. My wife and I are now at the stage of completing our I-864 form. But there is a possible snag we're not sure about, and now i feel rather naive and stupid for not resolving these issues sooner, but.... please help!

    My wife is 23 (i'm 24), and the US citizen. After completing her undergraduate degree in 2004, she then came to England for a year on a student visa, where we met. Then, on Jan 28th 2006, we got married in the US and filed for a K3 Visa for me. Since then, I have travelled back and forth to the US on the Visa Waiver scheme when i can, while my wife started her first 'real' job in early Febraury in Chicago.

    However, (and forgive my rambling), what i'm trying to get to is the fact that, until this year, she was listed as a 'dependent' of her father on her tax returns for the last 3 years because she was a student or abroad, and never earnt enough for it to be worth her filing on her own. She now earns double the '125% of the poverty line' specified on the I-864, so we should be ok and there shouldn't be any need for a joint-sponsor, if we can explain the situation in a letter along with the form, i hope, but.... has anyone else been in a similar situation???? I feel that the I-864 form is not very clear about what to do in such a situation and would love some guidance or even examples of what people have done before! Thanks.
