  1. Both the I-130 and I-485 packets are to be mailed to the Chicago PO Box? I cant just drop by a USCIS Field office to drop them off eh? If I do have to mail, it says to use USPS but its a different address if I use express, (UPS/FEDEX?). Can i use the fastest USPS Express service to the PO Box?

    You have to mail it to the Chicago Lockbox, you cannot drop it off at your local field office. You can use what ever service USPS offers to deliver your package to the P.O. Box address. The reason UPS/FedEx have a different address is because these companies do not deliver to P.O. Boxes.

    We worked out that she earns over $50k alone, as she works several jobs. So it would be great not to have to fill out a supplemental form if there isn't a need for it.

    I also heard that although supplying the 3 years wasn't necessary, that it can help to prove that the income is steady and would be able to support me. I compiled my checklist based on several other AOS ones I'd seen in the forums, but if you think it's overkill then I'm more than happy not to make additional expensive copies.

    It's over kill. Some people go overboard with what they send. I'm glad to hear that your sponsor makes more than enough. It saves you the hassle of having to fill out another form.

  3. The tax transcript is used in case you don't have your return. It serves as a substitute for both the return and W2. You only need to send last years return and W2 OR the trascript for last year. No need in sending three years worth of inforation. Also, no need in sending 6 months worth of pay stubs, just the most recent (around 4-6). Now-a-days USCIS electronically verifies all of this information with the IRS. For a household of 4 she would have to make $30,312 on her own. If she doesn't meet the threshold on her own then she can include her husband's income. He would have to fill out form I864A.

    1-Regarding class of admission, MY visa class is B1B2, on I-94, it says B1. What should I type on the application forms?

    2-Should I write something on the envelope contains all applications from outside ? Like the address of postal office in Chicago, the sender's name and address or anything else ?

    1. You're over thinking this one. Both B1 and B2 are combined into one visa. Ones for leisure and the other for business. Enter either b1b2 or just "visitor visa" or just "visitor".

    2. Write return address in case the post office needs to return it to you. USCIS recommends that you write on the envelope itself as to the nature of your submission. For example, "AOS for immediate relative of a US citizen."

    5- I still don't understand the payment method of forms I-130 and I-458, how can this be done in case I want to pay by check ?

    6- Regarding the cover letter, should I create cover letter for each form ( and its documents ) Or one cover letter for all the package including everything ?

    7- The brief summary of our relationship, should be written by petitioner or beneficiary, which is better ?

    1. Don't include a letter. The passport can be submitted as evidence of citizenship in lieu of a birth certificate.

    3. Why not get both? The more evidence you provide the better.

    5. Send one personal check for the total amount of $1490. Some people send multiple checks thinking that each application is a separate process. It's not, it's all one process. A personal check is better because you can track the payment.

    6. One cover letter is sufficient. Again, many people think that each applications is treated separately. Both the I-485 and I-130 will be processed together.

    7. Don't waist your time with a summary of your relationship, USCIS wants evidence.

    Also, print your photos on a 8.5" X 11" piece of paper. You can do two per page or you can enlarge them to cover the entire paper, your choice. They hole punch the top of each paper and they put it in a folder. They can't do that with small 6" X 4" pictures.

  7. Hello everybody, I am a B1/B2 visa holder changing status inside the US to GC through a US spouse marriage.

    While I am filling my application forms, I got hesitated at these points, hope I can get right answers asap please:

    Regarding from I-130,

    1- what is Alien registration number ? I don't know how to get this and how to answer ? I am here in US as a tourist.

    2- In this part of application ( list spouse and all children of you relative ( info about relative), what does children of your relative mean here ? The US spouse's children ( petitioner ) OR the Alien relative's children (beneficiary) ?

    3- In this part of application ( if your relative’s native alphabet is other than roman letters....etc), my native alphabet is Arabic, so I have to fill this space, But I don't have Arabic keyboard, what should I do then ?

    4- In this part of application ( if your relative in USA and will apply to adjust status at LOCAL OFFICE in ,.…City,..…State. What does it mean by local office here ? I live in Seattle, WA. Is that correct ?

    Regarding form I-485,

    1- In part 2 of the application ( I am applying for an adjustment of status to permanent resident because.....?) I am a B1B2 Visa holder and changing status inside the US, I don't see any right choice to pick to my case, other than OTHER. But what to fill correctly ?

    Regarding form I-131,

    1- The question asking for class of admission, I am a B1/B2 visa holder, but I realized that on my I-94, it says my admission class is as B1.

    So what to pick B1/B2 or only B1 ?

    2- Date of intended departure and expected length of trip ? I don't have any intention to depart soon, no plans, so how to fill this part ?

    3- Proposed travel information. The same I have no plans, so how to fill this part ? Or do you think not submitting this form basically ?

    Regarding form I-864,

    1- In the part of ( sponsor's household size: Persons Not sponsored in the affidavit: 1- Yourself, 2- If you're currently married; enter 1, dependent children ). Now the question is, does my sponsor count herself ? And my sponsor is married to me, so she enters 1, correct ? My sponsor has 18 year old son, is he considered dependent or not ?

    Regarding form G-1145,

    1- Should I clip completed E-notification to the first page of EACH application form or ONLY ONE for all ?

    Regarding form G-325A,

    1- What is meant by maiden name ? Is that like middle name ? What if I don't have one for my mother's name ?

    2- Employment last five years. I've never worked before, I was only a STUDENT. Being a full-time student is considered an employment or not ?

    Regarding supporting bona fide documents,

    1- We have prenuptial agreement, do you think it is a strong supporting document we should attach or Not ?

    2- Can I attach my Bachelor Certificate and training program qualifications I've received here in US as a supporting document or Not ?

    3- How many wedding pics/ general pics should we send ?

    I-130

    1. If you have a visitor visa you do not have an A-number, write none.

    2. I-130 is supposed to be filled out by the petitioner. You are the petitioner's relative. It's talking about your children.

    3. Complete as much as you can on your computer, print, and then manually complete the form with a black or blue ink pen.

    4. Seattle has a USCIS field office so you it will process your application.

    I-485

    1. a. An immigrant petition giving me an immediately available immigrant visa number that has been approved.(Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved)

    I-131

    1. Visitor visa

    2. Unknow or TBD (to be determined). You'll have to write it in with a pen after printing.

    3. Unknown or TBD

    I-864

    1. This form is supposed to be filled out by your sponsor. So, enter "1" for "yourself" do not enter anything in "spouse" because you are already being counted in box #1. In regard to your spouse's son, it all depends if he is a dependent of on the income tax return.

    G-1145

    G-325A

    1. Maiden name means last name before it was changed through marriage.

    2. "Student" is not employment. Enter "none"

    Bona fide documents

    1. NO, come on now. A prenup is a document that list how property will be distributed after the marriage is dissolved.

    2. USCIS doesn't care about academic accomplishments in this instance, no.

    3. Around 6, not as important as other docs that should be included.

  8. Thank you for your informative answer. Sounds like I am not candidate to fill out these two forms in the package. That's a relief!

    Regarding the birth certificate, I have only one original official governmental English translation, beside the original home country language one. Do I have to send the original or just photo copy of each one ? Thanks again

    When you say "two forms", I'm not sure which other form you are referring to. If you are referring to form I-485, you do have to fill it out and send it.

    The translation must be the original signed by the translator. A photo copy of your birth certificate is sufficient.

In the US people cannot file for adjustment of status if the individual was not inspected by an immigration officer, worked here illegally, or went out of status (the last two are forgiven if the petitioner is an immediate relative.) They have to leave the US and process their case from outside the US. In the 90's congress passed a law, 245(i), that allowed these individuals to adjust status in the US as long as they paid a fee. The law expired in 2001 and it sounds as if it doesn't affect your case. Only people who are grandfathered into this law fill out I-485 Supplement A. In regard to your marriage certificate, you only need to send a photo copy. Take the official copies to the interview.

When you apply for adjustment of status the petition from your relative proving your eligibility to obtain permanent residency (I-130) and your application to apply for permanent residency (I-485) will be processed together not separately. I think that the confusion is arising from the fact that it seems that you separated the forms and therefore you consider them to be two separate processes. If they've already scheduled an appointment it means that they have gathered all the information that the officer will need to review your case and make a decision on both forms at the same time. If you are granted permanent residency by default it means that you qualify to be petitioned by your relative, therefore, I-130 was approved. Usually you will notice an update shortly after the interview.

  11. So he didn't have any income in the past 3 years. And I was quite certain we already included a letter explaining why he didn't file tax returns as a full time students in the past 5 years.

    We consulted a lawyer in the past and he said just in case we should get a joint sponsor, which was why we asked his sister & her husband who also put their house down as asset to help me out...

    I ment to say joint sponsor, sorry about that. Did you include joint sponsor's 2014 income tax return, W2, and pay stubs?

  12. I filled papers to sponsor my mom in Dec. same thing as him and I came here on visa waiver and overstayed. excpet i got citizenship thru my husband who is a u.s citizen

    The fact that your brother has been approved for DACA is a great start. It is a faster process if your mom sponsors your brother once she becomes a permanent resident. Since your brother will age out once he turns 21 his category will change meaning he will have a longer wait. He would be looking at a 7 year wait after your mom sponsors him. It is a much faster process compared to you sponsoring him.

  13. Part 2 Application type: "a"

    B/C15: I think you are referring to form I-130 Section C: information about your relative. The title says it all ;-).

    G325A (petitioner): If you've never had an address outside of the US or worked outside of the US then you would write "none." Don't leave the box blank. The officer won't know if the answer is "none" or you just forgot to fill it in. This application is all about you. So if you don't have an A number put "none.". His A number should not be on your form at all. He has his own form with his own information.

    G325A (beneficiary): his USCIS number is his A number.

    Putting his mom's info on this form will in no way affect his mom. Do not worry. Nothing will happen to his mom.

    He had an address outside of the US so "none" would be an inaccurate response. Either go with unknown or just fill in the information you do know, city, state, country, ect.

    If he never had a job outside of the US then it would be "none."

  14. Okay so i have to file the i-130 first then once pending or approved i then file AOS??? or do i file both at the same time? on uscis it states that ou file the i-130 then once pending or approved you can file AOS and some other forms to show youve been approved the i-130?

    okay so what else do i need to file and how do i file these? do i send all these papers in the same envelope to the USCIS office? including the Affadavit of support AOS I-130 and any other forms i need do i file them altogether in the same thing or seperate and seperate times? the damn uscis website hasnt got it written out good and doesnt give enough information, if i do this wrong then i gotta do it all again and i dont wanna do that..

    You will need to send both the I-130, I-485, and all supporting documents and forms together in one package. The guide (http://www.visajourney.com/content/i130guide2) will instruct you step by step on how to prepare your package and what forms you will need to include. Read the instructions for each one of the forms line by line and follow the instructions.
