  1. The NVC contacted us to say that the income we indicated in box 19 of the I-864 did not match the Adjusted Gross Income on line 22 of the 1040, so to send the I-864 again. I tried to point out that since they have the 1040s for the last three years, they know the Adjusted Gross Income and don't technically need a new form, and also that the reason why it does not match is because we were living abroad, so the petitioner earned an income that is NOT reflect in the Adjusted Gross Income on line 22 (and the latter being very low, would disqualify us, even though the total income earned is more than enough - which we had explained in a letter we attached when we sent the AOS documents).

    Does that mean that we are back at the bottom of the queue and we have to wait 60 days again for the NVC to take another look at our application, and possibly come back with another request?

  2. They are just notifying you that your case has been updated. You are at NVC. That's their standard letter for address change. .

    For your peace of mind why not call NVC to verify if you have case complete by now. And not until you are assigned interview date is your petition sent off to embassy. NVC just completed most embassies November scheduling.

    All the France folk got their interview dates on 10/7.

    "All the France folk got their interview dates on 10/7." - So I guess my REPEATED attempts to have my case expedited (we are in the middle of an international adoption, started in March 2013, and in November if we can't file an extension on paperwork, which requires us being residents together, we will suffer a very significant setback) were ignored!! Do you know when the next batch of interview dates will be sent out? Will it be for December?

  3. Same here. Our 5-year anniversary is in 10 days, it looks like we're going to spend it apart. And we're in the middle of an international adoption which we started in March 2013 - and we're coming up to a deadline 11/2, which will cause us to suffer a very significant setback if we can't file paperwork by then (and the paperwork requires us to both be residents in the place where we are adopting, namely the US). I really feel like my life has been arbitrarily put on hold. And I'm quickly running out of savings. *SIGH*...

    Hang in there. I know it's no consolation, but you're not the only one.

    My case was moved from USCIS to NVC in late June - throughout August and September I filled out the DS-261, the I-864, and the DS-260, paid all the fees and sent in the supporting documents. My understanding was that my case was going to be processed (eventually) and then forwarded to the nearest American embassy (Paris for me) for my interview.

    However, today I am receiving a message from USCIS saying "Your Case Status: Initial Review. On October 14, 2014, your address was changed relating to the I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN that you filed.". ("During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.")

    I'm not sure what this means - am I back to square one? Have I just lost six months or so??? We contacted USCIS 6 or 8 times from April to June to try to change the address, since we had to leave the country in which we lived when we filed the I-130. Apparently they finally got around to it, but the case has been out of their hands for 4 months!

    I'm really starting to panic :-/

    Are you currently residing in Canada or just visiting?

    I was driving (it happened at the Blaine border crossing). And I was visiting.

    I was actually residing in the UAE until April, but when my wife and I left our jobs in Abu Dhabi our visas were cancelled, so I don't reside there any longer. Luckily I have property in France, so I guess technically my residence is in Paris - even though I don't actually live there. I'm staying there with friends until my IV is processed.

  6. Unfortunately I'm one of those who got turned away at the border. My wife filed the I-130 in December 2013. In July 2014 I tried to go visit because her mother was dying. She was in Seattle at the time and I was in Vancouver. The officers at the border interrogated me for about two hours before turning me away. They also cancelled my ESTA (I am from France so VWP) and put a big stamp on the back of my passport that says "Entry refused in accordance with INA section 217". I was told that I was denied re-entry into the US pursuant to 212(a)(7)(I)(I) of the INA, as amended, as I am an intending immigrant without a visa. I was refused entry into the United States in accordance with 8CFR section 217.4(a)(1) under the Visa Waiver Program.

    I eventually received a B1/B2 visa from the embassy because of the medical emergency my mother-in-law was in. I eventually was able to cross the border, but the officer at the border almost didn't let me in. I really had to insist on the emergency, and he insisted that he shouldn't let me in and that this is an exception.

    Frankly, after that ordeal I'm not ready to apply for a B1/B2 again before my IV goes through.
