  1. after 14 months of slow systemmatic and brutal documment harrasment and torture, my spouse came to the US with the 1 year stamp

    Aug 15 date of entry

    CR1 stamped on passport till 2017 (is this the validity of the GC

    the actual visa expires dec 2015 but it has a statement serves a green card for 1 year.

    there are so many dates its just confusing and stupid

    1. will we have any issue re-entering US from Europe

    2. green card in production status not changed from last 60 days. how long are cases taking from PORT of entry to getting the physical card

  2. No there is nothing that she can do to deport you. She is making empty threats.

    Only the government can deport you. since you are a legal permanent resident, I doubt they can revoke your green card without due legal process prior to deporting you.

    Tell your aunt that you are in America now, so she should work with you to resolve the matter amicably. However you must not forget she helped you get here, and that's the only reason you are here.

    In any case, remind her that for the next several years either a bush or a Clinton will be in the white house so deportation of anyone is unlikely. In fact expect comprehensive immigration reform very soon.

  3. good news. the NVC approved the petition after 60 days (58 to be exact) no RFE or additional delays.

    bad news. my letter and appeal to change the consulate from Mumbai which was incorrect based on residence of my spouse was not done. they simply ignored the letter or they can't understand it.

    the reason it was in supervisor review was to update the consulate to correct one from the incorrect one

    the next steps are:

    1. return to NWD for fingerprinting as its near my spouse home

    2. go to BMB for Medical as it requires a doctor in that jurisdiction. costly airfare hotel for 2 nights and additional harassment.

    3. go back to BMB for the interview.

    4. wait for the original passport to be issued back with the visa and packet.

    5. fly to the US

    6. further delay possible at port of entry

    I amd having same kind of issue with my tax papers. I was being told to file as a "single" as my husband does not live in USA. May b i need to go HR block and ask them under what law I can file as a single and if they can provide me any letter.

    if you are married, then you must file as married filing joint or married filing separate. YOU CANNOT FILE AS SINGLE AS YOU ARE NOT SINGLE IMHO

    married filing joint generally gives you the best tax break assuming your spouse makes significantly less than you

    more importantly you save $$$ on taxes even after paying turbotax or a CPA to prepare the return and paying $50 for the notary fee.

    I did it this year. applied for an ITIN for my wife while submitting 2014 return. ITIN takes 8 weeks

    procedure:

    1. get your spouse passport notarized at US embassy (not anywhere else, sorry cost is $50), you can get the original passport here and then notarized or follow any other ID allowed, see link below

    2. write letter to IRS for ITIN number. attach passport copy notarized or acceptable proof from w-7 form

    3. declaration to file jointly a letter written by you and wife signed by both to IRS saying you want to file jointly

    4. attach tax return showing married filing joint. include all her earned income as income and take the credit. this nullifies any tax on it, but you still get the married filing joint deduction and exemption

  5. called NVC again and the lady said DS260 is in supervisor review AND she cant give a timeline.

    it was put in supervisor review 2 weeks ago

    any idea what to do?

    Its just so frustrating that we are forced to endure this with no recourse to accountability or justice. all we hear is untrained phone reps saying wait 60 days. wait 30 days. wait 15 days. wait and wait

    is there even one lawyer here that can fight for fair and transparent system at NVC with ALL DOCUMENTS being submitted online and at once with originals being verified at consulate during the interview.

    if they had more staff then there would not be backlogs.

    can someone HELP??

  6. 42 days is the new 7 days. I can confirm that it does take 42 days. the new message is don't call us before 35 days are over. my case took exactly 40 days to get an email

    42 days does not include the 15 days it take to "RECEIVE" the file from Vermont to New Hampshire which is maybe few hours away

    the real time is more like 60 days to get a case number after NOA2

    the true processing time

    1. I-130 180 days ( 150 may be possible depending on your luck)

    2. NVC - 150 days (60 days to get case number, 7 days to process, 60 days again to process, 15 days for you to send/receive documents 8 days other delays by NVC)

    3, Consulate 60 days My estimate may vary on your country assuming no AP. AP refers to admin processing

    likely best case result 365 days from start of process.

  7. the country is India and the embassy should be New Delhi which is the jurisdiction for applicants from northern India

    they submitted to a far away consulate in the west of India in Mumbai which is several hours away from the residence of the beneficiary. We can go there but it is atleast two trips, via flight, hotels and hen we go there they might say sorry go to New Delhi. this is what worries me most.

    any idea what to do:

    As per NVC agent: (the Agent was somewhat nice given the level of normal nastiness we experience)

    1. submit an email request with case number in subject and copy of new passport to request that the name be changed to married name AND request to change the consulate to NWD.

    2. they said the time to reply to email is currently SIXTY DAYS, but I can continue processing of the case.

    I am very worried they will mess up or other wise engage in further mental torture by again delaying for 60 days.

  8. Case was completed Dec 15 at VSC
    NVC sends email 2/9/15 (over 60 days) with case number and invoice number. NVC claimed its within 42 days window

    I have some questions on the NVC process:

    Why can everything just be mailed in one step (why 6 steps)

    why do I have to wait for them to process my DS-261 why cant this be part of the application (unless I need an attrorney)

    why can't I pay the IV fees?

    Right now: I am stuck please help with next steps as its not clear what I need to do

    1. Paid AOS fee $120 (IN PROCESS)

    2. Completed DS-261 (PER NVC AGENT THEY NEED TO ACCEPT THE FORM, OR SOMETHING LIKE THAT)

    1.What can I do next?

    2. WHERE DO I GET THE AOS FORM?

    3. what other forms need to be sent its just so confusing

    4.once we submit how long to wait?

    IMPORTANT:

    1. THE NVC ASSIGNED THE WRONG CONSULATE in the same country. this is just unbelievable

    2. how to change my wife's name on the application to her married name? (per NVC need to send an email with her new passport copy scanned)

    Is it only me feeling this or is this process really badly designed and intended to exert maximum torture on the applicants slowly and painfully at every stage by delays and slow processing

  9. yes, I understand that passport and PCC should match up. but can this be done at the interview stage rather than at NVC stage as waiting for a new passport then applying for PCC is a big pain

    so can we submit the new passport and old pcc at NVC

    or

    submit the old passport and old pcc at NVC

    then in the interview stage submit the new passport and new PCC

    the main requirement is to get a green card and SSN in the new name

  10. my wife got her police certificate in her old name before we got married when she wa applying for her fiancé visa.

    we subsequently withdrew the fiancé visa and applied for a spouse on a I-130 which was approved (very fast as they saw they had tortured us long enough)

    now waiting for case number to be assigned (already 32 days since case reached NVC) case was approved at USCIS in mid December (per NVC they got the file after 15 days)

    can we submit the VALID police certificate in her old name (prior to marriage, its still valid) to NVC

    she will get a new police certificate before the consulate interview as she is getting a passport issued in her new name, so its a matter of time before they issue the PCC (india)

    Is there a comprehensive checklist (easy to understand of every single document to be submitted to NVC?)

    also assuming we get a case number on Feb. 10th how long will it take for the case to be sent to the embassy (we will finish whatever steps they ask in 24 hours of being asked)

  11. I still ant get through. there is no option to wait USCIS approved a NOA2 for my wife and its over 45 days and we can't proceed.

    I am about to write to the senator to demand there should be an review as to how the NVC operates. No outsourced company has the right to simply disconnect the phones.

    Also a reasonable processing time for immigrant spouses needs to be established from application to arrival at port of entry.

    first of all I am confused as to WHY THEY DONT PROVIDE STATUS UPDATES OR CASE DETAILS ON THE WEB. is some company making a profit by forcing us to call them. why cant we check the status online?

    why does it take 45 days or more to ENTER THE CASE in the system. why do we have to wait to submit the forms. why cant we submit everything as soona as the I-130 is approved? why are they making the processing steps so filled with delays and multiple unnecessary steps each with its own delay

  12. I-130 approved in Vermont - Dec 15

    called NVC once in early jan

    they said wait till feb 6th before calling again for case and invoice number

    It reached them as per their claim on december 30

    Questions:

    1. can anyone advise me on the fastest best case scenario to process through NVC and the file to reach the embassy?
    2. How do you know when NVC assigns the case number?
    3. Also are original documents required?
    4. IMPORTANT : in I-130 my wife used her maiden name in NVC we want to use her married name and also get her passport changed so her legal name changes on the visa and then on her social security card and everything else. PLEASE ADVISE what needs to be done. She is applying for a new passport in her home country and should get it in 4 weeks. Can we use her married name in all NVC applications?

    I guess some more questions. NWD is apparently asking for secondary evidence for some applicants.

    1 Notarized explanation from you and your petitioner of how and when you first met and why you decided to get engaged.
    2 List of all engagement ceremony guests,their relationship to you,their addresses and their phone numbers.
    3 Itemized emails and/or postmarked letters or cards between you and your fiancee.
    4 Photos of you and the petitioner before,during,and after your engagement.
    5 Notarized statement signed by the applicant's parents discussing their views of the engagement.
    6 Notarized copy of your fiancee's passport.
    7 Voter's ID card and Voter's list for the past 5 years of the beneficiary

    anyone know what a voters list for 5 years is and how to get it

    anyone know the FAM sections that explain how they process in new delhi.

    can we get a letter from the senator before the interview addressed to consulate and submit this to avoid additional harrassment

    if they deny us what options do we have for appeal or review immediately.

    if we decide to just get married immediately in india if they reject, is this possible without waiting 30 days as i cant keep getting vacation. we prefer a marriage under US laws and may want to invite my friends and colalgesues as well as her friends.

    also, if a fiance visa is issued, is it mandatory to get married in the US, i mean can we get married in Paris on the way to the US. It is after all a romantic city

    if the visa is issued, how long does New Delhi take to stamp the passport. tickets are expensive if booked at the last minute

    finally looking forward to hearing from anyone who has gone through rejection for a visa and how they overcome it.
