Hi everyone,

Our AOS interview was this past March and because of a missing court letter our case was delayed until November to continue the processing.

Well after waiting for this court letter to be available we then finally sent it in to Federal Plaza where we had our AOS interview to complete our case and a week ago we got the notice of approval via email and then received the "Welcome Letter" and then the green card arrived.

What surprised us was that instead of my husband gettiing a 2-year green card as we thought, he got a 10-year green card!!! Is it possible to get a 10-year green card before our second wedding anniversary 6 months before the date of our anniversary?

I don't know much about this specific situation, but I can just tell you that the law states that if you have been married for less than 2 years, you can only get a conditional green card, meaning a 2 year one! Your green card can be a mistake and if so, you are still required to file for the removal of the conditions. But double check with some immigration officials!

BTW - if you tell the US embassy that you have a girlfriend/boyfriend in the US you probably won't get apporoved for a tourist visa. That's what happened to my fiance.

Now we're doing it the right way considering our situation by doing the K-1.

He doesn't need a visa as he is French. He can just use the visa waiver program unless he has some restrictions on that.

But I just wonder what could be a problem if he tells the US immigration officer" I am here to visit my fiancée!". I know that the DHS officers have to right to accept him or not into the country, depending on what they hear at the port of entry.

First of all, my case may be uncommon to you guys, but I hope some of you can help me.

I lived in the US for 8 years to finish my degrees on a J-1 visa or the Exchange Visitor Visa. the thing with this type of visa is that, once I am through with school, I am required to return to my home country (or a 2 year Home Resident Requirement --HRR) and to physically be present there for 2 years. During this 2 year HRR, I am not eligible to apply for any type of US visa.

I am now doing my second year of the 2 year HHR in my home country. My 2 year HRR will end on Sep 1, 2007 (as i returned home on Sep 1, 2005 --> the date stamped on my passport).

My fiance who is a US citizen plans on filing a K-1 petition around March of next year. If things go as usual (on an avarage of 4 months), the approved petition should be sent to the US embassy in my home country around July. Then I will send the Embassy all required documents along with an application, which is likely during the time of my 2 year HRR (that is before Sep 1, 2007). However, by the time I have my interview date set and actually go in for a visa interview, it should be after Sep 1, 2007 (or after I am done with my 2 year HRR).

My question is whether or not "my submission of the application of a K-1 visa during my 2 year HRR" will be a problem? I am aware that I am not eligible to apply for any kind of visa during my 2 year HRR. However, if they consider granting a visa based on the day I have an interview, I would definitely be eligible then to be granted a visa.

Please help. I would appreciate your inputs, comments, information, anything.

You can apply for the k1 during the last year of the "two year rule" but it will just postpone the "results". I was subject to the foreign residency requirement which was to end, back then, 7 month later. During those 7 months, we got our petition approved in 28 days but the K1 visa appointment was on the same day I was done with the rule(the consular officers selected that day on purpose as they knew that I would be eligible to receive the visa). So it means that I could have got the visa 5 months earlier but I wasn't eligible! I don't know if it was necessary or not but we included every possible info about the 2 year rule(Certificate of eligibility, Record of Departure from the US) in our application for the petition.

From what I heard, once the case is approved and a case number is assigned, the case will be valid for 4 months. Is that correct? If so, it means that I have 4 months for waiting on the package 3, prepare all required document, submit an application, and set up an interview date. What if my case happened to be approved unusaully fast and I got package 3 too soon and it would be like 5 months until my 2 year HRR is over? Would I be able to wait that long? my case would become invalid and we would have to start the process all over again. Do i understand this correctly?

The validity of the petition should be extended by the consulate! They did that for me! For some consulates, you can be required to ask personally an extension but it should be automatic! Anyway, you can go ahead with your application but you won't have your interview before the 2 years is over...That 's from my own experience!

I think I made a big mistake!

I sent off my whole packet and they received in 10/17. Well for whatever reason I didn't make a copy of the forms I sent in. I sent in an AOS for my wife and another for my Father in Law as the joint sponsor. Now they told me they didnt get one for my wife who was on the I130! I am certain that I included them both! They also said that I wouldn't get an EAD for at least 90 days after they received this initial evidence. I am so frustrated that they said they didn't get it because I DEFINATELY SENT IT IN.

1) Can I call my service center (MSC) or the national helpline and just tell them they have it?

2) Should I just resubmit it (this will take some time as I don't have copies)?

3) Can I request that they continue to process the EAD despite the "lack of initial evidence"?

This is so incredibly frustrating I can't believe they lost that AOS...everything else in the packet has been taken care of...what can i do?

It would be wiser to just resubmit what they are asking for. I don't think that the questions 1 and 3 are available options! Sometimes the guys at the USCIS loose or overlook stuff so you might just be required to resubmit what's asked in the RFE...

I think it would be more prudent to get your birth certificate translated by a professional in the US... That's what I did!

By the way as I saw some questions in this forum about the medical form to use for the AOS, I simply used the DS3025 and got no RFE for it...I don't know the USCIS policy in this regard

No touch, no transfer, nothing after a month?! The same thing almost applies to the adjsutment of status except that that I had an update only to state that they received my RFE response and that the preliminary processing is done.

What can I do to have more current info?

What explains that for applicants it takes only 1 month and a half to get through the entire process and get approved?

It typically takes more than a month & 1/2 to get through the EAD process (average 70-100 days), not sure if your confusing EAD processing with AOS transferring to CSC.

Most likely progress would have been stalled on your EAD pending response for your RFE. Spokane is processing EAD application for 7/30/06... so you have a bit of a wait ahead of you, and the next step would be getting your biometrics completed (some other rare occurences may be different than this). Your EAD application does not get transferred, and you can follow current processing dates on the USCIS Website.

Also note some people get online updates, some do not. Just keep tabs on your case by way of processing dates.

I am not mistaking AOS for EAD. I was thinking about AOS for the whole transferring process, sorry about the confusion.

I already got my biometrics! I guess what baffles me is that only the "snail mail" route seems to be working so far. I am just feeling lost because of the the lack of efficiency for the online update...

Hi everyone,

I went to my initial interview today and it has been approved! I am very happy and thought to share my interview experience with you.

My lacal office is Chula Vista and the interview time was 8:45 a.m. this morning.

We arrived 5 minutes before the interview, went in the office and waited for about 10 minutes until they called my husband's name. In a little room where the interview was take place, a lady (interviewer) asked us questons such as : if I have ever arrested, convicted, our home phone number, address, where we met, what kind of ceremony we had and what we do together on weekends and etc. As she was going through our application and supporting documents, I was very nervous about what would come next. But she gave me a stamp in my passport after about several minutes and told us it's been approved!!! We didn't even have to show our pictures! According to her, we were the first couple who got approved at that point, she had a few interviews before us but their FBI name check have been pending. I am sure that most of you know but it seems that if you have the same name as someone who has a criminal record, you might be stuck in the FBI name check. Luckily I am from Japan and my name is a little bit unique.

Anyways, just wanted to share my story with you. Good luck for those of you who are going to interview soon!

I did get an RFE which I reponded to. But in my understanding, before they even got my RFE response, they completed my case. So it is like"oo, after all that RFE wasn't necessary!" It just baffles me to know that the RFE wasn't required.I am probably inventing my own story for the meaning of the message...

You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates."

I was wondering if you could give me an input about its real meaning: is my case still pending around at lee's summit or did they move to the next step? What is the "remaining processing time will be less than the maximum stated in this message", I don't see any maximum time anywhere? And did they just realize that it was not that necessary to request more evidence for my case?

I got an RFE for the I485 right after my biometrics appointment with no previous notice online...

I called the customer service but the lady said that she had the same info as the one I have online: no update!

I am a little bit stuck here due to some questions in regard to the form I 864:

1- Is it obligatory for my fiancée to complete the I 864 as she is a full time student? Can just her Dad sponsor me?

2-My fiancée has filed tax returns for only the 2 last years, not 3, so what should be her answer for that question? She told me that she didn't qualify for tax return this is why she didn't file it... So should she check the box on the form still or just leave it blank?

You didn't answer Yodrak's question entirely: when did she leave?

the two year rule starts from the day she left the US to go back to her last legal permanent residence country. The last legal permanent country should be stated either on the DS2019 or the annotations of the J1 visa.

She got a tourist visa because this kind of visa doesn't fall under the restrictions of the two year rule, just like the F visa. But the K1 does...

She has to be physically present in the last legal permanent residence country stated on the DS019 if available or the country in the J1 annotations for at least 2 years before she is eligible to get a K1 visa.
