Just a couple of quick questions - I'll be arriving in the states in 3 weeks time and getting married 3 weeks after that.
I won't be flying into JFK so won't get work authorisation. I can apply for my SSN after around 2 weeks right? What about my drivers license - can I apply for that when I receive my SSN?
Can I apply for my EAD before we are married or does it have to be after (when I am applying for AOS)?
Also how long after marriage can i apply for AOS...it may sound stupid but it states that a certified copy of the marriage certificate has to be sent with the package...

Hi Sam,
I arrived in the US from the UK in September 2005. As you are coming on a K1 visa you will marry within the 90 days. Regarding your SSN you can apply for this after you get married and they will type on it - that you are not authorised to work without permission from homeland security. I suggest you apply for your EAD and AOS after the wedding as you will need to put a copy of your wedding certificate.
Don't get anxious - because you will need to concentrate on settling into US life. You will also find that things here take time - this has been my experience. For example we got married in Nov 2005 (I arrived here in Setpember) I applied for EAD in Nov 2005 and still waiting.

Hello,
My wife is about to apply for her employment authorization. I have two questions.
1) We are going to apply for the EAD this week and then her Adjustment of Status in two weeks (financial reasons). Is this a bad idea to apply at seperate dates?
2) On the I-765 question 10 asks "Alien Registration Number (A-number) or I-94 number (if any)." My wife has her I-94 stapled to her passport but a few numbers are on the paper. Is it the number hand written on the back starting with A.

Q1 - it makes no difference - we like you applied separately.As long as they receive all the information and payment. That should be alright.
Q2 The A- No in your passport (printed) is the one that got your wife into the US. Immigration will have another number but use the one in the passport. When I went to info pass they provided me with another number which they use and not the one in the passport. I was told the one in my passport was to get me into the US.

I would make another infopass appointment and tell them you have not recieved the card and you want it replaced.....
do not accept if they say their is nothing you can do.... ask to speak with an manager....

Thanks I will request to speak to the manager - but will they allow me to speak to one. As at the appointment info pass says the card is ready!

I am in the same boat as you I applied in November 2005 - and we just have to hang on in there. It so frustrating - but what can we do. Organise an appointment with info pass - they are helpful more helpful than calling 1-800

I am writing because I am really getting to the end of myself with this process. Any adivce would be appreciated.
I applied for authorisation to work in November 2005 - I have had 3 info pass appointments to get up to date information and every time I have been - they say the card has been authorised since the 1st March - but I have not received it . I have rang the 1-800 several times (10 times to be exact). Each time they review the situation - they still don't know what to say.
Any advice you can provide or if anyone is going through this - I would like to hear from you.

Hi - I had the same problem - providing your passport is up to date you can travel anywhere in the US. I recently returned from Atlanta & Miami on my british passport and everything was fine.

I applied for my EAD in November 2005. I had my biometric done on 1st March 2006 and have been informed by the immigration office that it could take up to 60 days from the biometric test. I was told by my local immigration office that I could have contacted them to orgainse a biometric interview - although in their letter it says that they would contact me. So it is just a waiting game

I was looking through alot of peoples post and its seem like everyone gets the bio appt for the ead /aos very quickly ,Well I havent recieved a bio appt and it has been 2 1/2 months I was just wondering if this has happened to anyone else.
Hi - since you are over 90 days go to www.uscis.gov and go to info pass and book an appointment with your local immigration office

Hello all,
My husband had his biometrics appointment on March 21st and he called USCIS, and it's going to be at least another 2 months(I think) before he even gets anything saying he was approved or his EAD card. What is the interim EAD I keep seeing talked about? My husband NEEDS to be working right now. Is there anything we can do so he can start work sooner? If anyone knows, please respond. Thank you
I filled for my EAD in Nov and now it is April. I had my biometric done on 1st March - on Friday 31st I went to the immigration office to see if I could get a temporary EAD as my EAS was over the 90 days. They informed me that my EAD was approved in Nov and they have not sent me anything - they could not give me a temp one as my EAD has been approved so hopefully it should come int he post.

Hey guys!
This maybe a stupid question, but I have to ask it, because when we applied for SSN they told us to use her maiden name even though we were already married.
In question #1 on I-765 it asks for the family name. Should my wife use her new name or use her name before she got married. Then she would use her maiden name under that.
Sorry for the stupid question, but I just want to be safe.

As far I as know I used my SSN is in my maiden name (even though) I am married - as all my supporting documents are in my maiden name. So as I receive my official documents I will change into my married name.

Thanks for your help and support at this time. I write to keep you all updated and also share my latest information. I came from the UK in September 2005 and got married in Oct. We filed for my authorisation to work in November. Six months on did not hear anything and was getting concerned so I called immigration who provided little or no information. Even basic information they did not know. Then I arranged an appointment through 'info pass' (go to the USCIS website). I went for my appointment on Friday at 7.30am.
If 90 days has passed and you have not heard from them you can arrange an appointment on line with your local office.
Now this is where it gets interesting. I took my biometic on 1st March 2006 (for adjustment and authorisation to work). I ask the officer why has it taken so long for me to receive authorisation to work. She said my authorisation has been available since Nov 28th and she cannot understand why I had not received it - she said that I should have called to get my biometric test done earlier. I said to her that your letter clearly states that you will contact me - she said the letter needs to be changed. I was so mad because of their lack of organisation I could have my details sooner. So the morale of this story is not wait on immigration for info - because their info is not always correct - but to ring up your local office and find out what is going on.
So to all of us out there - don't give up

As long as you don't leave the country, you should have no problems. From what you wrote, it sounds as though you're still in the country legally. The only time you should require a visa is when you're actually entering the country. Any other time, you'd just be using your passport as photo ID.
I am only planning to travel to another state for the weekend - so you are saying I can use my passport as my K1 visa expired on 10 Feb - when I spoke to the lady at immigration she said i could not travel even though it is internally which I found strange

I need your help. My family are travelling to Miami from the UK and I would like to go and see them. However, I am getting mixed messages from immigration - my cases is currently pending - I had my biometric test and am awaiting my EAD and AS - the EAS is already over the 90 day period and they had advised me to get a temporary EAD.
My question is : can I travel to the Miami - as my visa which I received with K1 has expired. No one seems to know and immigrations are giving me the run around

There is an adjustment of status forum exactly for posts like this. Maybe next time you should consider posting there since there will more folks going through AOS who can help.

They called me in at 9.45am everything went well until I noticed that they had the wrong year of my birth - so I am glad I bought with me my passport and birth certificate so everything got sorted. Also because I had two differents appointments one for Authorisation to Work and Adjustment of Status. I bought the letter with me explained the situation at the information desk and they were able to process both letters so I do not need to return for the other appointment. I was out by 10.12am so it all went fine.
Went to the information desk to find out then next step they said I should receive my authorisation to work in 1 weeks time and if the paperwork for adjustment of status is fine and in order I could receive a letter in the post confirming this and might not need to be interviewed. So things I moving on.

Apply after you get married - make sure she brings her passport and also wedding certificate. The process does not take long - I received mine within 2 weeks. Once received she cannot work - until she receives permission from homeland security - it will state this one the card.

Thanks everyone - I rang the embassy they said I should mentioned about the second interview date to see if they can do everything together - which I hope they will. Hope long do you have to wait for the interview for the greencard and what is the process like - thanks again

I have 2 biometric interviews one on 1 March and the other on 6th March - can I ring them an ask them to allow me to have 1 interview instead of two. What happens after that? What happens at the next stage - is it the final interview and what do I need to bring - thanks again

I have some good news to share. I have received my authorisation to work and after one week of receiving this have been offered a new job which I will start on 12 June and also I have a date for my final interview which is 1 August. So just to encourage everyone there is light at the end of the tunnel.
