  1. Hi All,

This might be a stupid question, but I can't seem to find an answer anywhere...

When are you eligible to file for N-400? I know the requirement is 3yrs, but I have seen timelines with people filing less than 3 years since receiving their greencard (I think I heard something about 90 days rule similar to I-751)

My permanent residency started on 7/12/06, does that mean I am eligible to file for N-400?

Also does anyone know how long it takes from filing to oath in NYC?

    Thanks for your help.

    Alex

You should be eligible to file since you're in the 90 day period before your 3rd anniversary as a PR. I'm also filing in New york  and the processing times are very variable from what I see on this forum. The initial processing up to the interview is an average 5-6 months but the oath ceremony will really depend on your local office, frequency of ceremonies, number of applicants,etc..

    Good Luck on your journey!

I just went over the application again, and lo and behold, the 90 days rule that missed the previous time is right there, so I will be sending in my application in the next couple of days.

    Thanks

  3. Hi all,

I got my CG about 4 months ago, and now I have a really good business oportunity to go to Germany to implement my research. I would go there for about 6 months (don't think it's a problem with my greencard, and I will be making multiple trips to th US while in Germany). I would also get paid by the German company while there. I look everywhere, and I can't seem to find if I have to pay US taxes on income earned while in Germany, I know that US citizens have to pay taxes if they stay abroad for less than a year, but I am not sure if it is the same for permanenet residents. If anyone has any experience or knowledge of this please let me know.

    Thanks.

  4. It is farily straight forward. She needs to apply for I-130, and I-485, and if she wants to travel and work, AP and EAD. As for the timing of it, they can wait as long as they want since her student visa will be valid until 2009, or until they file AOS. One thing to keep in mind, as soon as they file for AOS her student visa is no longer valid.

    Good luck.
