  1. So does that mean I wait for something in the mail? I am just not sure what to do. I've had the NVC case number for two weeks but did not do anything with it because I did not know what to do next.

    Yeah should mean you will receive a packet but that depends on embassy. Each do it differently. Mind send a packet 3 with instructions etc.

    You need to go fill out DS-160, and make sure all documents are sent to beneficiary from petitioner for the interview stage. Check the general guide here and also the embassy info for more on what your embassy wants specifically. :)

    Detailed list in here. Looks like they don't send instructions prior to interview date looks like you get it with your interview date. So make sure you start getting ds160 filled and paper worked organised etc.

    NOA2 October 22nd. Since then no movement. Case still isn't at NVC as of today.

    Keep ringing. They won't do anything until its pasted 30days but then you can ring USCIS and talk to t2.

  3. It is not illegal to date other people if you are separated from an ex but you may be open to more questioning at interview stage. You can't apply for a K1 until you are officially divorced as you need to be free to marry. Me and my fiancé were together before divorce was final and thank goodness because the ex dragged it out for almost two years lol. We got final decree in august and filed in September.

  4. My fiancé has been trying to call for the past couple of days, several times and in different times (all working hours according to the website) and all he gets is a busy signal. Is that how it is? Would we get the case number any way else, like mailed to him (the petitioner) like the noas?

    We got approved on Nov 3rd and according to the USCIS website the process was forwarded to the NVC on Nov 10th (Monday). USCIS won't give us more updates now that the process moved to the NVC, correct? Or should I keep checking their website for updates?

    Yes busy tone is very normal. My fiance like many had to ring 40-50+ times before actually getting through. He rang 50+ times one after the other on a Monday morning and got through was on hold for 20mins and then got number.

    They wont reply to emails forever if at all. Calling is your vest option just stick at it. Best of luck

    Received nvc number tonight. Don't know what's next.

    I got case number today...after approved 29 days. Thanks all people helped me so much....hope the onea who are waitting case number will get case number next week.

  5. NVC hasnt received my paper and they requested me to send scanning paper of approved notice to their email. I'd like to know can beneficiary send this email or petitioner send? And After sending this email I can make online service request in USCIS website or not?

    I'd presume petitioner would send scan as they would have been the ones to receive hard copy etc. But I'm sure if the email body has both P&B names, USCIS number and scan it wouldn't matter which email account it came from.

    Personally u would send email and then leave it a couple of days then ring NVC again and if still nothing then I would contact USCIS. As NVC request you to do so and would give them a chance to do what ever it us they need to do once email is received.

    Wow that is rather a long time to post something have you rang since getting number? Ours was in transit the day after we got there number. Could be a glitch I have seen some people go from "at NVC" to "ready" with nothing in between, but may be worth ringing if you haven't already :)

  7. No, should be no problem. My son has his father's surname and we were not married. Also I do presume you have researched all avenues of permission to take child. It varies country to country so I don't know how it works but if you haven't just double check everything as if its need and not gotten no k2 will be issued. For example I had to get letter from father stating permission even though I have all rights and sole custody of child, and if I didn't know/have contact with father I would have had to get the courts to give me permission to take child. But as I said different for every country.

If he wanted to file for a K1 visa so that his SO can see what life is like before getting married in his home country it is possible. Do I think it is stupid? yes. Is it a waste of time and money? Definitely. However, in no way is he breaking any laws by doing what he plans

    The K-1 visa permits the foreign-citizen fiancé(e) to travel to the United States and marry his or her U.S. citizen sponsor within 90 days of arrival.

    Requirements

    • You intend to marry within 90 days of your fiancé(e) entering the United States.
    • You and your fiancé(e) are both free to marry and any previous marriages must have been legally terminated by divorce, death, or annulment.
    You met each other, in person, at least once within 2 years of filing your petition. There are two exceptions that require a waiver:

    How do you define intention? by a letter? One thing for sure is that his intention is to marry his SO. what if the OP decides to change his mind and get married to her in the US? What if they want to get married within the 90 days, yet they do so outside of the country? Technically, if she were to come to the United States for two weeks, leave, and get married to him in her home country, she would have abided by the requirement of getting married within 90 days upon entering the US. Yes, it is a technicality. And granted, she won't receive any immigration benefit if she were to do so, but by reading the actual text on the US Department of State website, the couple would not be breaking any laws and/or misleading anyone if they chose to go that route.

    Having an intention is meaning to do something, preplanned. USCIS just want it on paper. OP does not have the intention of marrying SO during this 90day stay. he has the intention of figuring out if he wants to marry SO. Two different things. so signing a letter stating "I the US petitioner, intend to marry the beneficiary, within 90days of their arrival" so is 100% misleading and against the requirements. So his really letter should say "I US petitioner intend to marry beneficiary within in 90days of the arrival after second K1 visa we apply for providing the first one works out how we intend" pretty sure that not going to go down to well.

    Also If they left to get married after receiving K1 like you suggest as a theory they would not be abiding any requirements because there would be no requirements because SO left making the 90days null and void.

  9. Welcome. Right now you just wait, and depending on several factors that wait varies, from whether you are sent the CSC or TSC, whether you get an RFE and so on.

    Once you get your NOA1 which should only take 2-3weeks you will see where your file goes this will give you a better idea but not guarantee.

  10. Don't waste any more money on lawyers at all. As stated going with the intent of getting married and staying is fraud, getting married and going home is not. Read through all the guides here etc and you will get everything you need to know.

    Apply now and touch wood you could have your visa by summer time if not sooner if you would fall in CSC area.

    You can still visit in January absolutely. Just prove you have a life back home. And yes be honest.

    only NVC to ring and the tier 2 USCIS if your waiting over the expected time. You are still in that time frame so not much extra help will come yet. They said to us at least 30days and have said to others more the 30days from reading this thread. People have rang everyday and there is no point in doing so, my only concern with ringing everyday is you will just stress yourself out. Maybe every 2-3 is OK.
  12. Well some of vaccination records got lost over the years, and I have had to get them over. if this happens a lot of time the county health clinic will give them to you for a small fee.

    Also my fiancée will need a lot of hers for the rest of the process when she gets here, I pay a premium for good health insurance so we plan to get married as soon as we can upon her entry into the U.S. to get her on my insurance, then we will start to make visits to the doctors office to get vaccinations.

    Also, if the US Sponsor has health insurance have them contact their provider to see if it is covered by this or if at least part of the costs are covered by their insurance this part of the law http://www.hhs.gov/healthcare/facts/factsheets/2010/09/The-Affordable-Care-Act-and-Immunization.html

    Not a direct answer to question on how o get a round it, but maybe it will help on how to help to keep the costs down for the ones you have to get.

    no unfortunately not unless it is expedited cases. i believe they are still on june or just hitting july either or :(

    hope your not left too long. for more piece of mind and for september filers waiting for TSC to do something there is a september TSC discussion. this one is mixed TSC and CSC although most TSC moved there.

  14. And yes, I would get them for the sake of it if I couldn't prove it.

    exactly if you couldn't prove it, i said if there was a possibility of proving you had them. meaning you could prove you didn't need them but got them anyway for the fun of it.

    im not anti vax at all, my son has had every single one available. i even stated in my original post that i had already planned on getting the ones i needed at my medical rather then get them in US for AOS.

    i was simply looking for help in how i could go about finding out which ones i had if at all possible which for me it wasn't so i will be getting boosters for all.

  15. There really isn't a reason to not just get them again besides the cost. Why not just do it and not have to worry about it?

    thank you for your useful input. i don't remember stating i wasn't going to get them if needed, but please feel free to find someone who would get injections for the sake of it, even if there was a possibility of proving they did not need them.
