  1. It took 8 months they approve my I-130. My service center was Vermont and they transferred my cases to California Service Center after long time passed. Normally it takes 5 months but if i were you i would call and open the inquiry regarding your case status.

    I know waiting is killing you but there are not much things to do other than waiting or keep asking them what happened. You are not done yet after your case approve. I am still dealing with the NVC stage. I wish you good luck with that.

  2. So my OPT is over at the end of June. According to my lawyer is already to late to apply for another F1 visa now and in October when my number <1000 is going to be called, how am I going to justify the fact that I want an immigrant visa when a couple of months earlier I applied for an non-immigrant visa. Now, I want to do it the right way and not have any issue. I trust the lawyer, he has a lot of experience and he had a couple of customers that change their status in September and they were called for an interview in November and the immigration officer asked them why they apply for another F-1 when they already knew about being dv lottery winners.

    If I go back in August, I'll have enough time to prepare the file for the interview.

    When do I need to file the DS-260? I know I can't pay the fee here, but at the American Embassy in Bucharest.

    It freaks me out and I don't know what to do.

    Hi Laura,

    I was on student F1 visa and selected for 2009 lottery. I've changed my status here and it was really stressful for me. They lost my files, late response and so on. I did go through with my lawyer and she got interview date in last days to end 2009 fiscal year. I highly recommend you to go back your country and process everything via US Embassy in your country. Trust me it's going to be so efficient and easy. Unfortunately you may faced with some issue ( status conflict) since your OPT is ending. You have to have legal status until interview date and meet all requirements. I mean i was on student visa and USCIS officer asked me all F1's, transcripts, letters from school and took his time and reviewed carefully.

    I had a same situation. Trust me you are lucky but don't risk anything and have your interview in your country. Also if you leave US on time that means you are reliable person about your visa status. This is my recommendation to you as a person who had a similar situation.

  3. Hi Guys,

    Sorry i wasn't really responsive these days because of busy with the paperwork. Unfortunately I can't call NVC since i had a little argument with my lawyer about crossing the line (long story). Anyways, i am doing it with my lawyer so he said he will let me know once he gets any news from NVC so i can't really say anything about if NVC received my application or not now. You can update the record with Approval date is April 2, 2015. I'll keep you posted once i hear something from the lawyer.

    I crossed my fingers for my wife and for you guys. I hope NVC process will be easy and fast for us.

  4. Well it depends on a lot of things. What is your priority date, what was the other person's priority date. What was that person's service center? Regardless at this point, now that you have been transferred to CSC, your case will progress faster and you won't have to wait for your PD to be current. You're eligible for a visa as soon as NVC finishes processing.

    My PD was July 29,2014 and her's i believe Feb 2014 but we upgraded our files around same time in November 2014. It has been a week they haven't updated status since i received transfer notice in email. How long do you think transfer these files from VSC to CSC?

    I see here almost all of you guys in F-2A visa category. I upgraded my process to immediate relative on November 23, 2014. It seems weird to me because i know someone who has same situation just like mine and she has approved same day i received my files transferred to CSC. Is here anyone who upgraded petition to immediate relative earlier and transferred files from Vermont to California? or only me...

    Please let me know.

    I am sorry I forgot to give you detailed information. PD is November 23, 2014 (Date of upgrade my petition to immediate relative) and my case has been assigned to CSC, and still waiting.

    I got hard copy today and it says my case transferred to California Service Center but since then i haven't heard anything from service center.

    I applied form I-130, Immigrant Petition for Relative as a green card holder in June,2014 and I’ve upgrade my petition to immediate relative on November 23, 2014. It has been almost 8 months and I received notification below.
    Case Was Transferred And A New Office Has Jurisdiction
    On March 24, 2015, we transferred your Form I-130, Immigrant Petition for Relative, Fiancé (E), or Orphan, Receipt Number EAC…, to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case. Please follow the instructions in the notice.
    I have no idea what’s going on. Is there anybody who know what it is or happened before? Is it good or bad? Please give me detailed info if you have any.

    Our PD is July 29,2014 but i applied as green card holder and then i got my citizenship and upgraded the process couple months ago. My lawyer called them and they only said we updated your case and still in processed. It has been 6 months. Getting worried about it. Anyone knows if there is any backlog? I need to wait since i know i can't call USCIS that i used my chance once Outside Normal Processing Times option. Please let me know if anyone has any information.

    Don't be terrified. Be cool relax this is not end of the world. If you freak out, officer might think something wrong and will give you hard time.

    I think you will be faced with how you guys are going to take care of living expenses. You should answer this question clearly. I don't think it should be a big deal for rejection. I am not saying "lie" to them but as an idea :idea: I can give to you that you can say you are going to work and she maybe willing to work you can mention about it. Also (i don't know what you are doing for living) tell about your profession and it shouldn't be a problem. 50K is enough to be a sponsor for you. I don't know in detail but if you guys live with her family for a while that should save you guys time to find job and settle down. That would be another option you can provide them.
