  1. When is the proper time to file an i-601 waiver form in order to avoid immunizations? Our i-130 has been approved and we are at the AOS stage. It seems that I need to have my initial interview, get denied and then apply for the i-601.

    In the event that my i-601 is denied, what are my options?

    I know the topic of immunizations is a very controversial one but lets try and keep that debate out of this thread. If you feel you must say something, please private message me.

  2. Due to changing circumstances my wife and I would prefer to live in Canada instead of the USA. We applied for a green card for myself about 8 months and are still waiting for approval of the I-130. We are considering withdrawing it and then having my wife apply to be a Canadian permanent resident.

    How would this effect me travelling to the USA? I have lots of family down there, as does she and we will want to go down and visit them regularly. Will this raise any red flags at the border when we cross?

  3. Our NOA1 was issued Apr 25 and we have not received our NOA2 yet. We called, and they sent us a letter stating that our case has not cleared all required security checks at this time.

    We also sent in the I129F forms and that seems to be sitting at the same place. Both cases show a change in status on May 15 but no details are given.

    I've read a bit on the forum about a delay in Nebraska? Is that what is causing the problems here? What do I need to do now?

  4. I'm putting together my evidence and want to make sure I have everything covered.

    My wife will submit:

    Form I-864

    letter stating that she did not file taxes because she was below the threshold

    My father-in-law will file:

    Form I-864

    photocopy of transcript for 2013

    photocopy of Form W-2 and 1099 for 2013

    photocopy of recent pay stub

    photocopy of birth certificate or passport (complete passport of just picture page?)

    Everything will be put together in one envelope. Her I864 and supporting doc will be paper clipped together and his I864 and supporting docs will be paper clipped together. Case number will be written on the top of each page.

    I'm filing the forms out online and will be printing them off. That fancy barcode isn't generating, which is good because I don't have my A number yet. I also will need to fill some parts of the form out later by hand. Will this be an issue?

    Is there anywhere on my wife's I864 that indicates that her father will be filing an I864 as well or is the fact that they are both sent in together enough?

    Is there any real benefit for attaching copies of the 3 most recent tax years if my father in law is making over the threshold? Under what conditions would this actually make a difference?

    Answers:

    • The unborn baby is not included in the household count. If it is born prior to the interview, an updated I-864 reflecting the change in the household count will have to be brought to the interview.

    In regards to the baby, will we need to bring in 2 I864 forms if the baby is born before the interview? Hers and her dads?

    In regards to her dad's I864, his dependents will be the ones that he will/did put on his taxes for 2013 or 2014?

  6. My wife has filed an I130 for me and we are getting the AOS part ready but I am a bit confused.

    My wife does not work and has no recent tax forms. I understand that she still needs to file a I864 for me.

    My wife is 5 months pregnant. At the time we will be (likely) filing the I864 she will still be pregnant however depending on how slow things go getting the NOA2 and other paperwork she may give birth before our interview. Do we need to count our unborn baby as a dependent? I realize if the baby is born before we send in the I864 that we need to include it on that form as a dependent, section 5 number 4.

    My wife still lives at home with her family and her father has agreed to help sponsor me. My wife is 25.

    On my wifes I864 for section 5, our answers should look like this (right?)

    3. 0 (We don't put 1 here because I am counted in #1 correct?)

    7. 1 (this would be her dad?)

    Or, do I need to fill it out like this since she has siblings. I don't think this is correct but if using the above option, there is no place to list the number of dependents her dad has that I can see)

  7. I'm not sure if this is the right section. If it's not, please move this thread to where it should be.

    I don't even have my NOA2 yet but I'm trying to decide what to do with all my tools.

    Officially I'm not a mechanic but I have used my tools in the past to make a living. I don't plan on using them in the USA to make a living, they will be used to fix my car, and family member's cars.

    Should my tools be classified as household goods and therefore free of import taxes or will they be considered tools of the trade and need to be taxed? If they will be taxed, how do I assign value to them? Is it based of what I paid for them or what I could sell them for? Tools are often twice the price in Canada vs USA so selling them and buying new tools in the USA isn't out of the question but I'd prefer not to go through the hassle. Do I need to get the HS code for each tool if it will be taxed? The new value of my tools is around $3000-$5000 cad. Used I'd be lucky to get half of that I think. By the time I get my visa I'll have owned them all over a year.

    Any insight would be appreciated.

    I'm in the process of getting my Green Card. We filed the I-130 back in April and this is all we have heard so far dated April 25, 2014:

    "Your case has been accepted and routed to the USCIS Nebraska Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number LINxxxxxxxxxx. With the official Receipt Notice (Form I-797) you may visit www.uscis.gov where you can check the status of your case using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status.

    This confirmation provides notification of the date USCIS received your case. This notice does NOT grant any immigration status or benefit. You MAY NOT present this notice as evidence that you have been granted any immigration status or benefit. Further, this notice does NOT constitute evidence that your case remains pending with USCIS. The current status of your case must be verified with USCIS.

    PLEASE DO NOT REPLY TO THIS MESSAGE"

    A few days after that we received the I-797.

    That's it.

    From what we could gather the next thing we would hear would be in about 5 months, however I've been reading on here a lot lately and it seems that that is not the case. I'm pretty sure that we should have heard something else by now.

    We were married on Jan 12,2014 and decided to take a 3 month honeymoon in Israel, (where we met) while we were waiting out the 5 months. We are presently in Israel. We have people checking for mail to us regularly back home and signed up for electronic notifications.

    What do I need to do? We've been checking out case status and it says "Initial Review"
