  1. I feel bad for you, CBP does have the number for the Montreal consulate and could have phoned them to inquire further. When I crossed into the US the CBP officer who was handling my paperwork had a concern and called them to straighten things out.

    In case anyone else is curious, the Montreal Consulate has been sending out modified packets (I don't know what the modification is) and that was what the CBP officer in my case was concerned about. He was confused, as to him some information was missing.

  2. Hello, I hope that everything worked out for you! I am in a similar situation. I was missing an original document at my interview and was told that as soon as I sent it in things would be approved/completed.

    My question is, how long from the time you sent in your document did it take for you to receive your visa?

    Loomis shows that my document was delivered to the consulate on July 03/15.

  3. I had my interview on June 26th, my case was put into AP as I did not have my husbands original divorce decree at the interview. According to Loomis, this document was delivered to the Montreal consulate on July 03rd. I know it's still early, but I have not seen the status on my case change as of yet.

    I will keep you posted as to how long things take for me. I plan on sending the consulate an email on July 17th if I haven't seen any update by then.

  4. So today was a disappointment.

    I got to the Montreal consulate, was called to the first window and, among other things, the officer asked if this was the first marriage for either of us. I stated it was my first, but my husband's second. She then asked for the original copies of his divorce decree, which I did not have!

    We had submitted a copy of this when we filed the I-130 and once we received our NOA2 and sent all our other forms and supporting documents to the NVC, we did not send it again. The NVC accepted this packet and did not send any sort of RFE. Then when I received my interview letter from the NVC with the required visa interview documents listed, the marriage termination documents were not listed as required!

    So then I get called up to be interviewed and the interview was really easy, everything was stamped as approved, but because I did not have this divorce decree, my case is now in AP and will not be completed until I send in the original decree. The officer said everything else is good and I can be very confident my application will be approved, but this delay could mean another 6-8 week wait.

    I am beyond frustrated and upset!

    Another frustration is that they kept my passport and my current job requires that I travel to the US once a month. This wasn't going to be an issue, but now that I cannot travel for work in August, I won't be able to keep my job.

  5. Update: I called the NVC tonight and I learned something new. The NVC simply reviews the package you send in for completeness and to make sure that all the forms are filled out correctly. They do not pass any sort of judgement on your case - that is where the embassy comes in.

    Therefore, by the time I have an interview scheduled my husband should have secured his new position and I can bring that evidence with me to my interview.

    For anyone who may be interested in how that turns out - I will let you know!

  6. Thanks for the feedback. As I noted he does have an income for 2015 which is above the poverty guidelines.

    He had a salary from his previous contract and he is entitled to unemployment income, making his total income for this year $23,955.

    I have done a bit of research (mostly on this forum) in regards to what counts as income, and the consensus is that unemployment income does count.

    My main concern is whether or not his past employment history is enough for the NVC to disregard his current unemployment and conclude that he is someone who will once again be gainfully employed.

    Has anyone else experienced this?

    My husband is the petitioner and I am the beneficiary.

    He is currently unemployed (a previous contract ended), however, he is also at the start of the interview process for a new full-time permanent job. The interview process at this company can take up to four weeks.

    He made more than enough money in the last three tax years (about $62,000 a year) to meet the minimum income requirement. If he remains unemployed in 2015, his earnings this year will be $23,955 (this includes his contract earnings and the unemployment income he is entitled to).

    Our I-130 petition is approved and at the NVC. I have all of the supporting documents, I-184 and financial evidence gathered and ready to submit to them.

    Should I submit our documents now? Or should I wait to see if he is successful at securing this new job?

    If I file now and the I-184 is not approved, do we have the opportunity to resubmit our package? Or would our case be closed?

  9. My husband and I were recently married after first meeting over seven years ago! We met August 18/07, had our first date September 21/07, were engaged July 06/14 and married August 24/14. Of course, a lot has happened in between all those dates!

    Our I-130 petition was just delivered to the USCIS Phoenix Lockbox yesterday (August 27/14) and my fingers are crossed that the process goes smoothly.

    I am currently living in Edmonton, AB and he is in Seattle, WA, which is where we will reside once I have my visa in hand.

    We plan to file for a K-3 visa as soon as we are in receipt of form I-797C.

    The only issue we could be dealing with is that I travel monthly to the US on business and I hope I do not come cross an unmoving CBP officer when I do so.

    I am prepared to show that I do plan to return to Canada after each visit, and will remember to post any issues I may face.
