  1. Class of admission is what visa he arrived on.

    You file the I-130 and I-485 together. It is true that the I-130 is from your point of view, and the I-485 is from his. But it is a huge package all sent together, in the same envelope, to the same place.

    The form I-130 to Petition - Item 15 is "Name and address of present employer (if any) and the date this employment began" Whose employer is this talking about ? It's under the beneficiary but would be the next logical number in the sequence for petitioner ...

    Part 3. Processing Information

    1. Date of intended departure – we don’t have any dates yet because we have not made plans due to the fact that we need to be sure he can get back into the United States

    And so on for the rest of the questions in this section as again – we don’t have plans set in stone

    Do I leave this part blank?

    Part 4 – information about your proposed travel? < do I just list what and where we’d like to go ?

  4. Form I-765- Application for Employment Authorization

    I am applying for:

    Permission to accept employment,

    Replacement (of lost employment authorization document), or

    Renewal of my permission to accept employment (attach previous employment authorization document)

    My spouse entered the US on a student F-1 Visa and now that we are filling out his information so that he may become a permanent resident we also need to file for work authorization. He previously worked at the University he attended under his F-1 Visa, and this employment was not good outside of the campus. How do we answer the above question as to what we are applying for.

    The paper we have from the school that allowed him to work has no mention of the USCIS however he was issued a SSN. The letter we have is an “On Campus Employment Employer Verification”.

    Thoughts?

  5. Yes, would still apply. Your just wanting temporary "parole", or the ability to travel outside the US, AND return until green card is received. Hopefully the wedding you will attend in 2015...green card will have already been issued.

    Just confused a little by the forms you are submitting at the same time. Specifically 130, and 485. 130 for married spouse to enter country. 485 to adjust status???

    He has been here since 2010- hasn't left the country. We dated for two years and got married on Aug 9. It is my understanding I must petition (I-130) and he must file the 485. Do I understand wrong?

    Meant to say...this 131...yes good to have even if you dont have definitive plans.

    Good to know! I was thinking of not filing that one but between you and everyone else, I guess I am going to file for that. I did fill it out .. well what I could understand any way, might as well !!

  6. Part 2 of 131 would be 1d

    Part 2 of 131 item 1d is - "applying for an advance parole document to allow me to return to the United States after temporary foreign travel" << I was confused by the term "parole" ... Basically we are married now, but we would like to take a honey moon next year, he would like to visit his family some time, and we have a wedding out of the country in 2015 . Would this still apply ? We have no out of the country plans yet - because we aren't sure if he will get back in! But naturally we'd like to start planning our honey moon.

  7. I found the information to answer that question .. my next question is this part 2 - Application type-

    Some background- We are filing the I-130, 864, 485. 765, and 131 together . Is he supposed to choose 1a "I am a permanent resident or conditional resident of the United States, and i am applying for a reentry permit"

    he has nothing to do with refuge, asylee, or parole statuses.

  8. Hi All! My name is Sarah and I hope to start this process in the next two weeks. A little background on us- I am a US citizen and my husband is not. One of my friends has recently gone through this process and she recommend this website. I don't understand all the lingo here yet but my husband came to the US on a student visa, went to school, graduated and we got married. (We have been together over two years now but newly married) So now I am filing the I-130, 864, 485, 765, and 131. The last piece of documentation needed to assemble the package is the certified translation. I can't believe how much trouble this bit is, I photo copied the passport and the pdf is 27 pages long of which on page is the front of the passport written in another language and the last page is just blank. Does the cover need to be translated? Does every single page inside need to be translated even though the only non-English writing is the writing that is on top of every page? That's 26 pages in the pdf or 51 passport pages (including cover) at $27 a page that's more than what it costs to file one of those forms. Any advice would be much appreciated.
