  1. We understand that we need to take the full responsibility for failing to notice the mail addressing the appointment time, but we hope that we can get some suggestions here in order to know what our next step should be. We have been in panic since we realized we missed this important appointment.

    We have a few questions:

    (1) The biometric appointment date was October 20th, but it is already December 26th today! Will our case be abandoned?

    (2) We also called the USCIS today, and the representative gave us the official answer: mailing the original copy to reschedule an appointment ASAP. However, we also found people online saying that it is better to walk in and ask for an reschedule. Is there any walk-in service existing?

(3)If there is any walk-in service, can I go to the offices in other states (ex. NYC) for help? p.s.The ASC I was assigned for the biometric check is in East Hartford, CT.

  2. I have a few questions about my situation after reading some articles from visa journey...

    (1) An article on Visajourney says "Entering the US on another

type of visa, such as student (F-1) or H1B, followed quickly by marriage to a US citizen, and then followed quickly by an application for adjustment of status might be construed by the USCIS to be visa fraud. "

I have held F1 for three years. I haven't left the U.S. since 2011, and my OPT will be expired on September 31, 2014, and I am still waiting for my H1B approval (I got the I-129 receipt in mid April). My husband and I just got married last Saturday. Should I wait 60 days after I get my approval/denial of H1B before I start the AOS?

    (2) An article says that I can still have my H1B and I don't need an advanced parole to leave the U.S. if I DON'T USE my EAD card. What does "don't use" mean? Does it mean not to change my tax form? Not to apply for a new SSN from SSA? Not to apply I-765 while doing AOS? or anything else?

More and more questions pop out...but so far visajourney has helped me a lot on other questions, i.e. questions about I-130. Hopefully we can send out the AOS forms without asking for a laywer's help.

  3. There is another question we have for AOS.... Since my husband-to-be might need to travel around, he set his permanent residency to his parents' place, Missouri, and pays his income tax to Missouri. I am not a resident, but I work in Massachusetts and pay tax to this state. Do we have to keep our permanent residency the same? He is an occupant under my apartment lease now, by the way.

Also, while we fill our addresses in the AOS forms, which address should we use as the address that we intend to live, my current address or his permanent address? I might just stay in MA for 1-2 more years and move back to the South with him. It might not be Missouri though.

  4. Thank you very much for the answers!

2.He might be. He is not sure. One of his coworkers is sent to South Africa this month.

    3. Should I wait until the effect date (Oct.1,2014) of the working visa? I am worried that I might not be able to work if the work permit does not be sent in time.

Also, are USCIS Form I-485, USCIS Form G-325A, USCIS Form I-765, USCIS Form I-131, and USCIS Form I-864 all I need to send?

  5. I have browsed the threads on this forum for a few times, and I am still overwhelmed by the information. Therefore, I hope someone can help me to realize if we need a lawyer at this stage.

The reasons why we think we need a lawyer:

    (1) My husband-to-be is a U.S. citizen, and he just started his work this February. We are not sure if he will meet troubles while being asked to submit the IRS tax reports for the past 3 years since his past income might not be high enough.

(2)We stay together now, but his company might send him away to other customer companies for 6 months or 1 year soon, which might make the whole process more difficult, so we want to find a lawyer, in the hope that the lawyer can tell us what to do with this situation.

    (3) I am waiting for the approval of my H1-B, and I am not quite sure whether I can start to apply for the change of status.

We will appreciate any experience sharing!
