    I've tried to find an answer to my question but cannot find one for my specific case so I hope you can help me with this.

    I have received my approved K1 visa in September and it is valid until the middle of February. I am not planning on moving until the end of January/early February due to some work commitments.

    My question is, can I still travel to the US (by car) without using my K1 visa until I choose to move? Or will the border want me to use the visa upon my first entry. I was born in Germany and have a German passport as well, which I suppose I could use but I am wondering if someone has encountered this situation before.

    Answers I can find online are always referring to you already having used the visa and I know that I can't leave the US when I am there until I have authorization to do so.

  2. Hi there,

    I am not quite sure if your country will let you change your name for your Indonesian passport. I would contact them and ask if that's possible. My assumption is it shouldn't be an issue to change your name since you are legally married.

    I would also not worry about the name on your green card being different from that on your passport when you re-enter the US. Take a copy of your marriage certificate with you to be sure. If they have questions at the border, you can explain your situation, show them what you have and they should be fine.

  3. Tax and Immigration are generally separate issues.

    K1's are work authorised, they just do not have evidence and an EAD takes so long it is hardly worthwhile.

    In this case you do not need evidence so not a problem.

    So, do you think it is an issue to do the work for my old employer while waiting for the K1? Can you explain what you mean by evidence? Any time frame as to how long it takes to be able to leave the country if needed? I have both family and the office in Canada, so if something ever happened I'd like to be able to leave or go to the office if need be

    I'm not quite sure it would be an issue in regards to the tax situation. I would still be working for a Canadian employer and as such, file a Canadian tax return at the end of the year. I am just not sure if it is an issue to do it while waiting for my green card/work authorization.

    I don't live far from the border so I don't think it is that unusual to travel back and forth between the two countries. It has less to do with me becoming a American than to be with my new family and contributing. Once I am able to legally work in the US, I would stop working for my Canadian employer and find a job here. I am doing my employer a favour and they do me a favour in return :)

    I have a question and have been trying to find an answer but have been unsuccessful so far so I am hoping you can help me! I am a Canadian citizen and we applied for a K1 visa. My interview is scheduled for August and my current employer in Canada is allowing me to work from the States until I can find a job. It is kind of nice because it allows me to earn an income while I am waiting for paperwork. My questions are: 1) Is it possible for me to work remotely for my Canadian employer while waiting for the AOS/Green Card? and 2) if I needed to, is there any way in which I might be able to leave the US for a short period of time until the green card is issued if I needed to go to the office?

    Any help would be appreciated! I've been trying to find an answer but have not found a specific situation like mine.

  6. I received the official I-797 in the mail yesterday, 2-17-15. There was no need for me to call yesterday because my case had already been approved on 2-12-15 but I had not been notified. Apparently the notification system isn't working properly or there is a five day delay so maybe others are approved and don't know it yet!

    The same is true for us! Got approved on Feb 12 and didn't get a message until Feb 18.... Anyway, we finally got approved!!!! They sure took their sweet time!!!

  7. I have a question regarding this as well. I am Canadian but was born and raised in Germany, so most of my vaccinations were done there. I have the booklet with the dates etc. and translated it to go over it with my doc who determined I wouldn't need anything else from the list for the US. When the time comes to get the official medical done, should I get this officially translated or get in touch with the physician in Montreal to see what exactly is sufficient for them? Any ideas anyone?
