  1. Do you know that your immigrant spouse can still file for Removal on Conditions on 2 year green card even if the marriage is annulled?

    None of the criteria apply to my situation. So the removal of the conditions will not be taking place.

  2. I'm going through the exact same thing right now but he was not a compulsive liar just a opportunist. You are not on the hook for the I-864, If you are granted an annulment then the marriage never existed and he gets deported. That voids your obligation for the 40 quarter, 10 year support agreement (I-864). I am using a lawyer whose specialty is immigration and family law. I went in seeking a divorce and she said after hearing my story (similar to yours) that I had grounds for the annulment. An annulment is the ONLY way to void the I-864. My annulment filing has been accepted and i will get my hearing date by the end of next week. Feel free to message me privately if you would like.

    I also had a pre nup so he is entitled to nothing, he leaves with what he came with which is the clothes on his back and the wedding band he got from our ceremony, lol

  3. Call the NVC and get your MNL# so you don't have to wait for packet 3 which usually never comes because Philpost is not reliable. See my website below for additional steps you can be taking now. The link is at the twisting arrow. Your wasting time waiting when you can be proactive and save 2 months off the processing time.

    If you look at his time line you will see that he hasn't received his NOA2 yet, so no he has not had the interview yet.

    CEAC is the best sight to check for processing through the Philippines. Your link leads him to the steps to determine what visa he should apply to and he has already submitted is application to USCIS and is waiting for his NOA2. Besides your link is in Spanish and the Philippines is not a Spanish speaking nation.

    The process for the Philippines is different. The beneficiary needs to pay the visa fee and then schedule the appointment online. They do not go to the Embassy at this stage.

    Your steps are out of whack.

    Don't wait for P3 as it never arrives

    First call NVC and get your MNL#

    Then go on line and print off your visa fee payment receipts

    Go to the bank and pay the fee

    Wait 24 hours then go online and schedule your interview appointment

    Complete your DS-160

    Start gathering your documents for the interview (use the Embassy Letter for you checklist)

    Once you have schedule your interview date then about 7-10 business days prior to your interview go to SLEC and complete your medical

    It is the correct site because you log in to your account and on your dashboard it gives you every step of your case from start to finish and it lists all the dates as your items were processed. As far as the language you select the area of your country on the map that comes up and you can choose the correct language for that part of the world from the drop down menu. I just went through this process on Monday and I have the approval paperwork from the interviewer at the embassy with that site listed as to check when the visa is ready. Santo Domingo does everything online maybe the Phillipines are different..

    I scheduled mine back in mid July and the earliest date was August 5. But I scheduled mine for September 23 due to work schedules for both of us. When you go on it will show what is available and you can pick and choose from the open dates and times. I even had to change ours one time because my fiance's bosses wouldn't let him off for the original date we had picked. Hope that helps.

  5. Yes, the child needs a passport before he gets a visa- he will get a K2 visa. A medical should be done before the actual interview in this case since he is 3, he may not be required to appear on the interview ( check with your local US embassy) but still there are medical requirements prior to Visa issuance. Check the local US Embassy requirements for ages 14 and below.

    Please note, follow-to-join K2 visas can only be issued within one year from the time the parent was issued the K1 visa. After one (1) year, they will no longer be able to derive immigration benefits from the I-129F petition and you or your spouse will have to file an immediate relative or second preference petition for them to qualify again for immigration benefits.

    If you apply for his Visa now, it will also be valid for 6 months only. He can apply later within one year from your fiance's visa date issuance.

    Cristina, Just to be sure where you said "He can apply later within one year from your fiances visa date issuance" is that still the K-2 visa or is that the immediate realtive petition? Any idea how long the immediate realtive petition takes?

    His mother wants to keep him til he is 5 (he turns 4 this September) then we would bring him here in time for Kindergarten to begin. Would we wait to do his medical when we do the immediate relative petition or do it now when my fiance has his.

    Sorry for so many questions. Neither of us are in the DR at this time so when we go I want to be sure I have all my ducks in a row. Thanks for your help. I really appreciate it.

  6. We have done the K-1 visa and included my fiances child. Our interview is (September 23, 2015) His child will be coming later but Im wondering does the child need a Dominican Passport before they will give him the American Visa? He is only 3 years old. Also does the childs medical need to be done now or before he actually comes to the US a year from now?

Hey..I assume you have your NVC's letter with a case number and that the case is being sent to the US Embassy/consulate in Santo Domingo..right? .....check this link from the US embassy in Santo Domingo http://santodomingo.usembassy.gov/iv-required_documents.html ...it explains all, even what is in the packet iv. You may get this packet in the mail, but if this is meant to be sent to your fiance, it would be at his address in the DR. The packet iv was or is a list of the documents that your fiance needs to present the day of the interview and the interview letter as well. But with the new process, I am not sure if they are still sending the packet, a friend of mine did not get it and her interview was last march or april. You need to send your fiance affidavit of support, it will be needed the day of the interview.. (I see they are requesting the I-864 form instead of the I-134 form)

    The medical is a walking in basis, your fiance should be there before 11am. If your fiance is between 19-64 year old, then the fee is about US$289.00 according to the Consultorios de Visa's website; it includes the consult, vaccines, x rays and blood work.

    Not that I recommend this hotel, but it is the closest.

    The link that I gave you, check where is says "K Fiance applicants...new steps..appoitments VAC and Embassy"..it has instructions as well fees. Your fiance has to create a profile in the usatraveldocs website. Remember, both appointments are scheduled at the same time (but different dates), so your fiance should be ready with his documents, aka birth certificate in extensa, certificado de buena conducta from la procuradoria, etc. because he can either have an appointment right away or wait a couple of weeks, depending on the availability.

    The questions would be different according the case, but the main questions are how did you meet, if visited each other how many times, met each other's family, future plans, etc. check the visajourney's consulate's reviews where you can read some of the interview experiences from VJs users.

    Yes, we have scheduled his VAC ( the paper calls it a OFC appt for some reason) and our interview both in September. Hes flying home the end of August and i wanted to be sure he had his Medical done in enough time before the interview. How many weeks before the interview should he do the medical to be safe? Is there a hotel by chance that you would recommend?? Thanks for your help, I cant wait for this part to be over :)

Im so confused at this point and things are even harder due to the fact that my Fiance is employed in the Bahamas and has to fly "home" for all of this. Needless to say we want to be sure our ducks are in a row since we are both flying there for the interview.

    Is the OFC appointment the same as what I see referred to as the VAC appointment?

    How do you schedule your medical appointment? I went to the 2 medical places online to choose from and it is all in Spanish and my fiance does not have a computer to translate it for me..

    When should I expect the Packet 4 in the mail? and will he get one too? (I just saw someone say there is no packet 4 from DR anymore??)

    Also can you recommend a hotel close to the interview site to stay in?

    I already paid the fee to schedule the interview at the Banco Popular. What money does he need to take to the OFC appointment and what money to the medical appointment? Are there any additional fees the day of the interview?

    What kind of questions were you aske in the interview?

    Does anyone have a complete list of all the items needed fpr these 3 appointments? Everyone I read is different.

  9. Whomever answered the phone didn't get the memo that Packet 4 is no longer mailed, so now the appointment letter is only obtained by printing it. The change is only a few weeks new so some people may not have been updated. Please don't wait for them to mail you something because they no longer do this and you and your fiancé will never get anywhere.

    Ok so Im a worry wart, So there is nothing that will be mailed to either of us? We just use the appointment for the OFC appointment, the medical and the interview?

    Also can someone suggest a good to the point list of the items we need to provide at the interview? Everyone I've found is different and I want to be sure since we are both flying to DR for the interview. I want to have everything and not make any mistakes.

  12. I'm hoping someone in this string can help me with a DS 160 question as well. I spoke with the embassy in Santo Domingo, she told me to go online and find my case and then I could schedule my interview. I went on there but it directs me to fill out the DS 160. Who am I filling the information out on, myself the US citizen or my Fiance? I got 3/4 of the way through it and it starts asking for someone else's info so I started entering mine and it said do I have children im bringing to the US with me? I stopped at that point totally confused. Also why is it asking for all the same info from the original petition? should they already have all of this. Thanks, any help would be appreciated

  13. Our case status says that "on June 16, 2015, we sent your case, Receipt Number SRC.......6, to the Department of State for visa processing.

    but nvc and dos have not the case yet. Can anybody advise what we should do at this point of time

    I have the same type letter. Mine was sent on June 8, 2015 to NVC. I havent heard anything after 30 days so I tried to call today and got a recorded message and at the end it just disconnects me. I used the number 603-334-0700. I read the other day that their computer systems went down the end of May and they are trying to play catch up. It said they worked over the 4th of July and processed 410,000 applications. Im assuming they are just back logged but not 100% sure. Im getting concerned and dont want to be sitting here not doing something I should be doing. Maybe someone can give us some guidence thats dealt with this previously ?? Are we supposed to be waiting for a letter and case number from NVC via mail?? Id like to know as well klu and mna :rolleyes: Good Luck to you!

    Yes there is hope but I really want them to move a lot faster than this. Once they get all you couples approved and out of the way maybe they will get to our approval..LOL

I am still waiting patiently for our NOA 2, I am starting to feel very discourage and after reading so many post, I don't understand why their are such a time difference in processing between service centers. It is going on the 7th month now since i received my NOA1. Well enough of my wining good luck to us all. :ranting:

    Don't feel bad John I'm feeling the same way as well. It's stressful and most days I do good but every now and again I'm ready to scream and pull my hair out!!! I'm really hoping we all hear something from TSC this month!

  16. I know how it feels. Our case also in the same progress like you. TSC has received our case on 17th Nov and since then there is no news at all. Been 6 months and we are really frustrated.

    Anyway, we are going to have a Muslim Wedding Ceremony on 30th May and will have reception right after that in my country in Indonesia. He will return to US a month after the wedding and we will come back to wait the Visa till we get to stay together and get to sign the marriage paper in the US.

    Lets pray the best for all of us who haven't received any progress about our Visa. Keep the finger cross!!

    Yes, the frustration levels rise and fall. I was really hoping at the 6 month mark there would be some news. Congratulations on your ceremony! Im sure you will enjoy your time together. I haven't seen my Fiance since October 2014 because I didn't want us to both have to make two trips there due to the cost. My Fiance works in the Bahamas right now, so we will go to the DR for the interview and medical etc. I'm thinking now I'm going to have to make a short trip :dance:

  17. So yesterday was 6 months since we filed our I29F and not a peep since it was received on 11/10/14 at TSC. I submitted a inquiry and got a automated response that it was not outside the normal porcessing time. The page with the processing times has not been updated since February 28, 2015 and it says the last application processed was August 23, 2014.

    Im frustrated to say the least because how can they say its not outside the normal processing when they havent even updated that chart since 2/28/15. On top of that on February 28th they had only processed through August 23?? Really... you've got to be kidding me. I see people all the time getting their interviews just 3 short months after they submit their application...

    Sorry for the rant and I know all the, it takes time and be patient comments but im at my wits end, im tired of waiting. :( Has anyone in that time frame at TSC been approved lately? Any other suggestions of ways to get info on where my app stands??

    I filed my petition for my fiancé on November 17, 2014 and received notice of NOA 1 on November 19, 2014. We are still waiting on approval. Hopefully it will come soon. ??

    Yes, I hope so too! My Fiance is having trouble at his job because it was rumored to his boss that he could be leaving the company. They are treating him badly so for his sake I hope it comes soon so he can leave. Hopefully, Texas will put the pedal to the metal soon and get these cases moving along so we can all be with our loved ones!
