  1. Congrats!! That's nice to know, and btw the embassy contacted me on dec 23 to let me know they changed the interview date from May 10 to January 4th, so I'm just days away from my second interview, I don't know if that's good or not! Lol your husband is here in Guatemala also right?

  2. Last night i had nightmares about the whole ap process and a possible visa refusal and today I decided to check the status of the case. It was still under AP.

    But a few hours later I compulsively checked again and surprise surprise! We got approved. Im soooo happy and my husband is too. We are excited to hear back on when we can finally pick up the passport and all.

    Thank you so much VJ! This has been a very supportive and informative space. I appreciate everyone whom I ran into in this long journey (which is not over yet, but we are close). :)

  3. Thanks for reply, the problem is the CO told me

    To send all the docs with cargo expresso but he gave me another interview date, and from what I've read it takes up to 60 days to review the docs, so I'm just really frustrated because I am the only one working at home, we can lose everything what we had work for! It's just frustrating! :-(

    Im sorry, its very frustrating. Try calling the embassy and tell them you would like to reprogram your interview and bring the documents with you. See what they say. I hope they give you a positive answer. hang in there, at least you got an interview date. Me and my husband are still on AP, the black hole, lol. Anyways remind positive.

Hi, I'm in the same boat, I had my interview on dec 9th but I think I got to nervous at the interview and the officer ask me for more forms but he gave me a second interview for May 10, now my question is did your fiancé got a second interview date? Or they just ask him to mail them his birth certificate? I'm very confused of what happened in my interview and I don't know what I'm going to do in the next 5 months over here! My wife and son are in the U.S. And it will be very hard for me to not see them! :-/

    Maybe you should call the embassy to reprogram the interview date sooner, just have all the forms and everything ready before the interview date. That way you wont get a 221g form. Wish you the best of luck. :)

  5. My husband finally get to talk to a supervisor (Justin) reviewed it for just couple of minutes. And he said for us to wait an email. And he said that the case is closed. Did you get the same answer from a supervisor? And should I just wait an email after a week?

    congrats! I hope he said your case is complete and that you will receive a email from the NVC stating the same thing. I got the email 8 (business) days later, It will read the following:

    Dear Sir/Madam,
    All documentation necessary to complete the National Visa Center's processing of your case has
    been received. As soon as an interview date has been scheduled, the applicant, petitioner and
    attorney (if applicable) will be notified.
    The applicant should NOT make any travel arrangements, sell property, or give up employment
    until the US Embassy or Consulate General has issued a visa.
    The US Embassy or Consulate General may require additional documentation at the time of the
    interview.

    Director
    National Visa Center

    It will have the visa type, case number, beneficiary info and priority date info on the email. Good luck! After that you will have to wait for the Eembassy to schedule an interview date (dont try to schedule because it might cause delays and confusions). Im guessing you might get a date for february or late january!!. :)

    I got a 221g form the day of the interview, the CO asked for a joint sponsor (my last tax period was low) and I sent it the documents which was "received" at the Embassy Nov. 30th. They touched my file this monday which gives me some hope..still on AP. Hope to hear some great news soon. :goofy: The wait is killing me .... :clock:

  7. I recommend your co-sponsor request tax transcripts, because it contain all information that was submitted to the IRS. The problem with using the actual tax document (besides the 1040 form) is that you need all the back up documents that's was submitted to the IRS. It's not just the W2.

    What do you mean by "back-up documents"?

    I sent in my a co-sponsor's: W2, a copy of the 1040, a tax transcript for that same year and a copy of his passport.

  8. Hi . I m new to this forum . My applucation for cr-1 got approvedd and my interview is scheduled for jan 11,2016 at mumbai consulate India. I want to know whether its ok to do biometrics on jan 10 or should i do it earlier. ?? Someone pls guide me on this.Also could someone tell me the link to schedule for biometrics.Pls reply. Thank you all.

    Good luck with your interview and biometrics! It would be good if you get the biometrics out of the way. :)

    Just an update: The embassy "touched" my file this monday the 14th.... but im still on AP

  9. I think you may have to call the Embassy and ask, to see if they can help you with that question. Just say you are preparing your documents and would like an answer (they may or may not help you). I would check and attach a letter explaining everything (like you mentioned) with all the documents. Also I may suggest finding another sponsor for Plan B. I'm still under "AP" at the embassy because the CO would not accept my current income and I had to find another sponsor. Good luck to you!

    My hubby also got a 221g form. Just stay calm and give them what they requested. I'm still waiting for a reply (it's been 5 days since i turned in the forms they requested.)

    I wrote to see what was the status of our case and received this reply:

    Dear Ms. Calavera,

    We have received your husband’s documentation on November 27, 2015. His case is under the final stages of processing. If everything is fine and complete, his passport will be returned to him at the office of Cargo Expreso that he selected at the time of registration.

  11. Well the Consular really did not care about my current income, or my employer's letter...he really cared about last year's taxes. I have been at my current job for a year now and make enough. (My last year's taxes were 1000 shy of the poverty line...)

    So my advice to everyone is to have a plan b!!
    Talk to anyone who is willing to be a joint sponsor and have that handy for the interview, JUST IN CASE (with the required 1040's, W2's, Proof of employment, proof of citizenship, and a signed I-864 from the joint sponsor). You never know...

    A 221(g) is only a "maybe" if it is stated on the refusal worksheet that something is needed to be done by them or the applicant.

    The exact wording of the refusal worksheet: 221(g) given to my fiance at his interview, asking for more documents was:

    [X] Section 221(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigration and Nationality Act or regulations issued pursuant thereto. The following remarks apply to your case:

    [X]Further Consideration will be given to your visa application after you obtain and present the documents following: Affadavit of support I-134 from Joint Sponsor and support financial documents to meet HHS guidelines.

    But if it's just a 221(g) flat out, then it's a refusal. In that case it will say something along the lines of the first part of what I posted, along with something about the visa application being refused under 221(g) and that it will be sent back to USCIS for further review and to wait for further information in the mail.

    Again, there's 221(g) with further consideration and 221(g) the refusal.

    Don't take the 221(g) with further consideration as a NO, it just means they need more documents to essentially give you the YES! If they wanted to say NO, they could have found a way. =D

    For us, it only took 6 days for our visa to be issued once the consulate received the documents they requested on the refusal worksheet. Mind you though, that was a very fast response.

    I returned documents a week ago, so I'm just hoping for the best. Yesterday it appeared on the CEAC website that the case was updated with yesterdays date (still under admin. processing).

    We got a 221g form during my husbands interview (Late September) and had to wait for our joint sponsor to get his stuff together. The whole process is frustrating but hey, at least we weren't denied! So we finally were able to send everything to my husband. My husband dropped it off at Cargo Expreso on wednesday, they told him that it could take a week or 15 days for a response......anyways we will see what happens.

    I went with my husband to his interview at the Guatemalan Embassy last month. All went well until he told my husband that he was giving him a 221(g) yellow form because I did not meet the income requirements. My last tax year was low, i will admit that but currently I meet the poverty guidelines, it's almost the end of the year. He refused to see the checkstubs and the employers letter (he kept the letter).

    The CO was quite rude and told my husband to get a sponsor. Should we do that? Should I contact the embassy and try to fight it?
