    Question about the DS-260. My partner including myself have lived all over the world and allot has been done while backpacking from place to place, for six months to 2 years at a time during our 13 year partnership. Now I am trying to fill out this form with the most complete honest answers, as totally crazy hard as that is, and when I leave a gap longer one month they wont save the application which means they probably will not accept it, right? So...............they also say they don't want any transit vacation motel addresses, well....then....what in the world am I to do??? i have just spent an hours worth and it will all be lost which is one thing but not to be able to fill it out is much worse. (((!!!HELP!!!!))) :crying:


  2. I am glad, you get it corrected, using my post.

    Well there are some of the things I would like to explain you, which I have understood from VJ's like NRL and one other VJ , I forgot the name but he/she is from Argentina.

    PART 6 ITEM 5: Here you need to put individual annual income of sponsor and if you are using co-sponsor.

    In case the case of only sponsor if this income is combine income of someone other person in a house ( in case income is not enough 125% of above poverty line) then we need to fill his/her name in PART 6 ITEM 6 and so on.

    Same as if some one is taking help of co-sponsor.

    Now PART 6 ITEM 13.a: Here many people are getting confused.

    So here you need to fill the Gross income ( which is line 22 of 1040).

    In case, co - sponsor filling tax jointly and if co-sponsor is making majority of income then there is no need of I-864A.

    But if co-sponsor is not making majority of income then it is mandatory to fill I-864A by whomsoever is sharing that joint income ( which needed to be mentioned PART 6 ITEM 13.a).

    Along with I-864A there will be need of W-2 and US citizenship proof of that person.

    In case if income mentioned in 1040 line 22 is joint tax income, it is advisable to fill i-864A. Of course there is will additional paper work but it won't hurt in fact chances of getting REF will be less.

    If sponsor or co-sponsor is filing tax using 1040EZ, then NVC needs adjusted gross income. that is line 4 of 1040EZ.

    I think I got it all. I will just go ahead and have my step father fill out the I-864A and add his retirement forms and passport copy. Was not sure on the last part either, so thanks for that as well. Wishing you great luck and super success with all this crazy process...and Thanks again for your time.

    I have read and re-read so many different and conflicting answers so i am just going to ask these few questions myself and see what I get before I send these off and get a check list. So thanks in advance for any answers that you feel could set me straight and assure me I am sending in the correct paperwork.

    1. For the joint sponsor's (mom) I-864 form, if she filed jointly and with a 1040, first...do I use the entire joint income which is both her's and her husband's? and then submit her

    W-2's? and then this would mean I can't use the transcripts, right because it doesn't divide the income?

    2. And so...if she makes over and above the amount needed to sponsor my husband, do we still need to get her husband to sign the I-864A?

    3. When submitting the AOS package do I need to send my (petitioner) original birth cert plus copy? Original Marriage certificate plus copy? Original divorce decree plus copy? Or are they asking for these forms from the beneficiary in the IV package? And do we need to send them in twice if so, once in the AOS package and once in the IV package? And the all need to be originals? Do we get these back at the end of the process? Does the joint sponsor need to send these in the packet these as well?

    4. Do I need to send my divorce decree as well if I am divorced? And which do the above papers belong with...the AOS package or the IV package?

    I am sure there are more questions but this is what is on top of me at the moment. Would love to know correctly without going to a lawyer, but maybe they will prevent a check list and longer processing time?

  6. Hi may i ask how long did u get ur CASE number after NOA2? And did you call nvc for case number? If so, hoa many day before u call from the date u got ur noa2? Thanks :)

    We received the NOA2 on 8/20/2014 and never called to get the case number just waited for the email and received the email NVC Welcome Letter (ACL) dated 9/15/2014 with the case number and the IID number with all the instructions on how to proceed. The Form DS-261 was available today which is the first day I had access sense receiving the email, because we were camping and out of range...bummer, but maybe it just gave them time to process it and then it was available when we got home. Now we will wait for the available access to Pay Fees and submit the AOS package. We are a bit slow on this, so we will not be ready to send right away. :oops:

    • Note: if you're getting an error message ("Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time…" or "This case is in the process of termination. Fee payments and online forms can no longer be accepted…" or "You cannot make online payments for your case at this time. Please contact the NVC if you have questions or need further information."), do NOT panic. This is actually good news! If you just got your case number, then this message means NVC is inputting your case in their system. If you get this message a few days after case number generation, then it's a good possibility that NVC is invoicing your AOS bill. And if this message appears a few days after DS-261 acceptance, then there's a good chance the IV bill is being invoiced.

    Got our NVC case number and went and filled out DS- 261. Once completed I went to pay fees and got this: This case is in the process of termination. Fee payments and online forms can no longer be accepted. If you believe you have received this message in error, or to resume processing of the case, please contact the NVC immediately.

    So What the hell does this mean??? Should I get worried?? Tried to call and they aren't open yet....hope this is normal somehow and we can pay and move on with sending the AOS package.

  9. Ah, wow I really had no idea they expedite the ones living abroad with their spouses, I actually heard the reverse,but yeah we all live over here in Israel. Happy to be where I am in the process regardless of the reason, we still have a long road before us, just nice to have this much done so speedy. I just hope for the rest of you separated from the one you love the speed we received. Don't loose hope Lera!! xxxfigers for you all!!!

    NOA2 arrived today in the mail!

    That's about 3 weeks or 23 days to be exact, for us from the priority date of the NOA1! Things are moving indeed, so excited! And we're not from the Philippians with expedited process, so as I have been hearing they are moving faster these days, especially from the California center.

    Looking forward to celebrating with you all soon!

  11. @Lera66 Thanks for your response! That is what we planned on doing, just going in a being open and honest about the situation, bring a little human to the story.

    Congrats on getting your NOA1 for everybody!!! And it took us a few days until we could see anything in the computer as well. Be patient and you will see it there very soon!!! Your in and that's the exciting news after the stress and worry you had before you can now rest a bit and await the next step like the rest of us!!! YAY!!!

  12. Greetings fellow July filers!! So gratefully to have this forum of support through what can seem like a long lonely process with allot of misunderstandings a confusion. Have this website and this forum makes it feel like so much more of a community process which I love and deeply appreciate.

    I , a USC, live with my three children in Israel with my husband of five years. The kids are already USC so we have only him to visa and process, thank god! We sent our papers in July 21 and received our NOA1 hard copy yesterday August 10 th but we had the email received within four days of sending it off. We are now with the California center and waiting like you all for the next sign of movement towards NOA2. I am divorced with one child from that marriage which was also someone I helped immigrate back in 2002 from India. So I have actually been through this whole process before which gives me some benefit of feeling less intimidated by the whole process, but it has also changed a bit sense then. As we could file and do the whole process from India in those days. That time it took us 4.5 months to have his visa in hand. Home by christmas was all I kept requesting them. And it worked. We had no information in this days and no help via forums or internet, and we made it just fine.

    This time....I hope that first process doesn't make them look twice at me?!? And my husband and I spent 1.3 yrs in the states and of that he overstayed 8 months. This was over five years back and the statue on that is suppose to be five years which is why we waited here in Israel so long. We requested an extension to his tourist visa paid $350 and were denied. I needed to stay to complete custody court case and divorce from my previous partner whom had long sense returned to India and wanted nothing to do with us. I could not return to Israel without those papers and we had a new baby which he wasn't about to leave. So.....overstay was for us unavoidable.

    Anyone have any experience or read about this kind of situation here somewhere? Would love to have a heads up before going into the interview , knowing what to say and what not to say, knowing that is a while in the future, just wanting it all settled in our minds before hand.

    Long post, not wanting to bore anyone, just share and be more transparent about us and our process, so we or others can benifit from it someday.
