  1. This morning I called the NVC to ask how I should asmwer the question "Is this child immigrating to the U.S. with you?" (Concerning the child over 21 years of age). The rep said to answer NO b/c he is not listed and if the US Embassy determines that he is eligible, then we can file a DS-260 and pay his IV fee at the time of interview.

    I just submitted the DS-260 online and sent in required documents.

  2. I am on the same boat with you. Our PD is 8/16/2002. One of the 2 children is now 21 years 7 months old, so his name is not listed on the IV application page (it shows up, but it says "not available"). I called the NVC (at 7am E.T. to get to a representative) and she said to file the AOS application without that child's name to not delay the process and we can petition for him to be included at time of interview.

    Later on, in the letter received by NVC to pay IV fees, they recommend to write a detailed explanation of CSPA eligibility and it will be forwarded to the U.S. Embassy or Consulate for a decision.

    I am in the process of submitting DS-260 and is now stuck on the question "is this child immigrating to the U.S. with you?" Not sure if I should answer yes or no since we are attaching the letter with our DS-260 documents (as well as sending it in an email). If anybody have went through this, please advise on how to answer this question. I will also call NVC tomorrow morning for advise.

  3. Hi, I'm in the process of completing the DS-260 and stumbled on a question that I do not know how to answer. The beneficiary's son is now 21 years 7 months old, he was named on the petition back in 2002, and we cannot file a DS-260 for him b/c he has "aged out." We are writing a letter to the NVC to explain his eligibilty under CSPA, and the NVC will forward the letter to the U.S. Embassy or Consulate for a decision(?). In the meanwhile, the question on the DS-260 asks "Is this child immigrating to the U.S. with you?" I want to answer YES because we are hoping the Consulate will agree that he still qualifies as a child and allow him to immigrate with his parents. On the other hand, I can see why it should be NO because he is not currently listed on the ceac.state.gov website. I just don't want them to think that we don't want him to immigrate with the rest of his family.
