We have decided that we will file the Writ of Mandamus.
Have a cosult with lawyer scheduled for next week ... will see how it goes.

im sorry Luc - i quoted the wrong cost for LOC sorry for the confusion. It is currently 275 w/ biometrics.
No worries, as I mentioned that cost is long lost and paid multiple times at this point anyway

Hey all, I was wondering who's been waiting the longest now. I know I am getting close!!!! We filed for AOS on July1, 2004. My third set of biometrics are due to expire in March!!!!
I thought for a while that I was the longest... AOS filed in January 7th 2years ago. Sorry to hear about your wait time.
Considering WOM? Or how much longer you think you will wait?
I had second biometrics taken in September and I am loosing hope. Nobody seems to be able to tell me why nothing is happening.
Last time I called they told me not call before 6 months after I got a responce on Service Request #1 which was August 17th.
Does that mean everytime I inquire about my case I am giving them another 6 months of doing nothing?
Without filing the "WOM" or what it's called how long can this take. Forever?
Is there anything else that could be done besides contacting senators and congresmans?
The only this that is holding us back at this point to file the WOM is the lawyers fees.
Also even though my green card should be for 10 year I will do not have to spent $400 for removing the condition I have already spent $600 on two EAD and AP renewals and I will have to do another 350 in June. Don't ask how am I on 3rd EAD at this point...
Oh one more thing. I am note sure how much the country of origin has to do with the security checks. Two of my friends from the same country just had their GC processed. total processing time 3 and 4 months.
That is frustrating.
Seriously is there anything I can do to make them touch my case?

I wanted to thank you and Rebecca who has invited me to the phone call last night.
It has been very interesting to listen and encouraging that people out there care and want to change things for the better.
I am getting more and more frustrated with my own case. Called the help line today... what a waste...
it will be 2 years next week since we filed AOS and nothing seems to be happening.
Contacting senator did nothing... I am not sure how much longer we should wait.

So this is what I dont understand.
My friend who lives in California (I am in NYC) just got her green card in mail.
And all of you my fellow black holers please sit down.
She filed early September 2006 had their interview October 31 got her green card this morning. Total processing time 3 months.
Dont get me wrong I am so so so happy for her not to mentioned she was here illegaly for 5 years so finaly she can go home but in the same time where the h*ll is my green card. Seriously.

I am also glad to see that some of us are getting somewhere as it does not look like that in our case.
Have not heard from senators office for a while. I guess after reelection maybe not so much priority now.
Waiting for results of second Service Request in mid December.
Is this nightmare ever going to end seriously?

Yes we spoke to a lawyer and we have been told that year after the interview we could file some lawsuite to request decision or something...
But it is little pricy so we have not yet decided...
we are kind of thinking it has to happened right... I dont know

I have to completely agree that the argument of "oh at least you are together" is not enough

I have received second fingerprinting notice for 9/30
I have called the help line because I have received the exact same email as 6 months ago and they have sugested to go take an infopass for more info.
WHAT A WASTE OF TIME that was.
the lady did not know anything at all and at the end she told me that I am not waiting all that long that some people are waiting year and years and years and that they are working on on obvisly when they are sending me emails.
someone please KILL ME
trying to stay positive before hitting 2 years filing anniversary in January

I say for EAD that does not take that long just in case you GC will
besides it gets easier if you can get out of the house and socialize little with outside world.
Winter at home... not so much fun. I have done it in the beginning for 6M and I was MISERABLE.

This whole fingerprinting biometrics madhouse is unbelievable.
I thought I started to understand but I must admit I am completely lost again.
I thought name check went hand in hand with fingerprints as one big thing... But I guess not from what I read...
I have received second Fingerprint notice last week and went this past Saturday.
I was under the impression that my background check was pending... Which I thought included FP and name check
So is it possible that the FP never made it to the FBI and the whole thing is just laying somewhere doing nothing?
And when my fingerprints were done again what does that mean?
Should I call FBI at the number that is circling around and ask them what was done?

keep copies of everything you submit. From what I have heard and read here you will need them again when filing for AOS.
Back 2 years ago when we got married we did not even know about K visa and all that.
We went to the Czech embassy, back in summer 2004 to ask what should we do if we consider to get married but they did not really tell us anything constructive. They definitely did not mentioned the fiancée visa... ironic...
Anyway the process is exactly the same accept you just get married here as a snap decision and then file.
Honestly it is not better or worse, it's not illegal... you just need to figure out what works best for you. Now I know so much more about the whole immigration thing it's funny.
I am glad you will be there for New Years that is great. Prague is beautiful especially in the winter time. At least I think so.

This whole thing it’s quite hard sometimes. It’s nice to know that there are people out there in the same situation with their families far away.
Besides it also helps to speak to someone in your native language as well. I know I have been missing that a lot as long as I don’t have any Czechs/Slovakians close by.

I dont think they post sending out interview letters (personally I think they should as they post sending out welcome letters and other stuff but not the really important one like that) I believe that we just have to keep checking the post box.
I too, am going through NO office as I live in mississippi, although am hoping that it will be done in the Jackson sub office and hopefully be quicker.

I just got an invitation for another biometrics for I-485 for this upcoming Saturday...
(my first ones were taken on February 26th 2005)
Perhaps a good sign? Could it mean that my name check is done and we are perhaps closing?
Either way I am interpreting it as a good sign

just throught I'd chime in. we filed for my AOS in 1/2003 and finally had our interview this february. since then we've been waiting on the security check. of course, this is NYC and so everything takes much longer, but still this endless wait is infuriating.
I'm thinking about making an infopass appointment in a month or so -- anyone have any luck there?

joining me in to the NYC nightmare;) I have not seen someone who filed even before me for a long time.
Not to long ago here on VJ was someone in NYC recently approved who filed in 2003 as well.
I did Infopass on 4/11 this year... no luck whatsoever. I have been told that my application has been transferred to Service Center to California for the background checks. (which I did not know at the moment)
They have advised us to write a letter to address they have provided and inquire about the status.
After we did so we got letter back that they don't accept inquiries via letters or faxes... Seriously?
Anyway... I guess they will tell you where your application is but if you know that ... they are not much more help than that. But they must see little more than the people in help line... because those still do not see that my app is in CA.
Either way if you decide to go make sure you schedule the first possible Info pass which is at 7.00 AM things go much faster and you wont be waiting so long...

After 2 years 6 months and one fay form filing I-485 (yes January 12th 2005)
Saturday morning I have recieved 3 email.
1. Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Notice mailed welcoming the new permanent resident.
2. Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Card production ordered.
On July 13, 2007, we ordered production of your new card.
3. Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN
Current Status: Approval notice sent.
On July 13, 2007, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN.
Because I just filed a work permin renewal (4th one) I did not think anything about those.
I cried like a baby. All the build up frustration of years nobody helping me...
Ironicly about a week ago I have received letter from CSC where my file has been pending since November 2005 that my background checks have not been completed and therefore delay in the processing my application.
Also they have spelled my name wrong on this particular letter. Did they even look me up?
Anyway no complains now.
I only wonder. Is this card gonna be for 10 years? And is my name gonna be spelled correctly.
