Folks, my wife's green car expires on Nov. 4th, I know I had asked about the removal of condition process about a month and half ago, but I was in a serious car accident and have just barely made it back home after about a month of recovery. I have all the stuff ready all I need to do is package it up and send it out. Do you guys think its too late? Does it have to be done when the 90 days are left or can I still do it?

  2. Hello Guys, Having followed all that we learned from here, we were able to successfully get her conditional greencard. We have been happily married now for two years and her conditional greencard expires this November, I have tried to search quiet a bit but have been unsuccessful as to what forms and documents are needed for the renewal of her conditional green card, also since we have relocated to Phoenix Az from NY, what processing center will we be sending the documents to? Any help will be appreciated. Thank You!

  3. Nataly, what is your country for which the K-1 Visa was filed?

    What you should also do is make sure that you meet the minimum income requirements for your Fiance to get the visa.

    Include 3 years of your tax return if you can rather than just 1 and you only need the federal tax return, not the state one.

    On the letter from the banks, make sure along with confirming the accounts, have them put the current balance in each account as of the day that the letter is given to you and how long the accounts have been open.

    Letter from employer must say how much you make for your gross income, not your net but your gross before taxes every month, if you are employed full time or part time along with how long you have been on your job..

    Make sure that if you can, include your last 4 paystubs with the packet,

    Also include your own proof of being a US citizen, Copy passport ( all pages) or copy of your birth certificate or copy of your naturalization certificate if you are a citizen by naturalization.

    when I did mine, I included a small cover letter that had my info on it along with my fiance's info as well.

    I included full name for both, Date of Birth. Alien Registration number for you and your fiance ( if applicable) , the fiance's passport number and country of origin and definitely your case number.

    Also include copies of your NAO-1 and NAO-2.

    The more you send the better as they have less things they can give and RFE for. Also, Make sure you make a photocopy of everything and send it to your fiance. what I did was I scanned it all and emailed it to my fiance and she printed it back home in Germany. It saves money on mail and also reaches there right away.

  4. Yes, I had that opportunity, but we got the AP card quick enough, 20 day turn around time with an expedite request from the USCIS field office officers. We just got back from Canada yesterday from my brothers wedding, the AP card for my wife worked without a hitch, they just had us go into the office in order to get her passport stamped and get her paroled in. they created an I-94A and stapled it to her passport. It is standard procedure for everytime that one gets paroled back into the states! I would take advantage of the infopass by july 1st to be on the safer side. Cheers.

  5. So here is everything I had:

    My wife wrote an appeal letter to the USCIS field office director and hand signed it as to why she would like to go.

    My brother wrote a letter and hand signed it as to why he would like her to come to the wedding.

    The wedding card and invitation.

    Proof in the form of paid receipts for deposits for my brothers wedding for the part that my wife and myself are funding.

    proof of my wife having had filed the AOS, EAD and AP by sending it to the chicago lockbox.

    notarized marrige license of my wife and myself.

    The officer looked at all of this at the local office and asked if she has had her finger prints taken, she said no, so they took them then and there on the spot along with the pictures that are needed for all 3, AOS, EAD and AP. He then told us that they have decided to expedite the case so that the card can make it to her in time. He told her that if the card didnt come in on time, to come see the local field office and they would issue a document that would allow a single re entry into the US from Canada. and thats how things went.

  6. I don't know that you'll be able to get approved for the temporary leave. And AP will likely not be approved by the wedding date. If you get neither, she should definitely not go with you to Canada, as much as I know that'll hurt.

    Well, We are definitely not going to canada if she doesnt get either!

    When did you send the AOS papers? Did your wife already do her biometrics?

    AP/EAD takes from 1 to 3 months to be approved. A bad planning wedding date abroad will not be considered an emergency. Expedited AP are for real emergencies like the death of a family member abroad, etc. Very unlikely she will get expedited.

    Remember Immigration doesn't work around our plans, we have to work around immigration's. It sucks I know but that's the game's rules.

    We had those get accepted April 23rd and I know that the expedite process is different, no she hasnt had her biometrics, but a temporary leave is different from an expedite isnt it? I would like to think that it is atleast worth a shot?

    I wanted to ask you a few questions about what the possibilities are for approval with the following scenario. My wife entered the US with a K-1 Fiance Visa and we filed for AOS,EAD and AP in one packet. We live in Buffalo, NY and my brother is getting married in Toronto, Canada on May 30. Both my wife and myself are funding a significant portion of his reception, about 75% with financial committments that will get processed right after the function. Being my only brother, my wife would also like to attend the wedding. Now to my understanding my local USCIS office has the right to grant a temporary leave US and come back letter for her to attend the wedding. We are planning on going to the local office with the following:Full copies of of our marrige license and certificate, her passport, my US citizenship paperwork. A letter from her stating why she would like to attend the wedding, his wedding invitation, a signed letter from my brother saying that he would like us to attend and that we are funding his wedding reception. In Toronto, all the deposits are given in the form of cash except for all the liqour that was purchased using a joint Credit Card Account that belongs to my wife and myself. I do have the receipt for that. I understand that this is not a financial loss for myself and my wife but what do you guys think that I need to bring along in order to get an approval? Also the NOA1 for the EAD and AOS has come in but the one for the AP hasnt come in the mail yet but there was a case number created that we have on the USCIS website. I am pretty sure that I can approach the local office to give us a hard printed copy of the AP NOA1 letter that we can include as a part of the requisition. Now there is definitely a USCIS form I need to file alongside as well, I do not know which one that will be! Any help in this matter will be highly appreciated!

We were honest about it and attached a letter saying that she would like to visit her family who is back home in Germany somewhere in late august and more visits as well, so lets see what they will do for us. But we did attach a letter. I had taken her with me to the local USCIS office and they advised us to put in a letter as well as the form asks for further explanation as to why you think you are eligible for an advance parole?

  9. We sent out packet on out last Monday, I followed to the dot the list that had been compiled by Ayla. We did have wedding pics, all our joint accounts had been created, joint car insurance policy as I added her on as a driver. ( Thank God she doesn't have to take the NY state Drivers test as the insurance company recognizes her German Drivers license as valid in USA ( Yay). I also included a loan pre-approval letter for a mortgage that we got for buying our first house together, ( PS. We just put a down payment on our first house on friday last week), and we included a copy of her new Health Insurance card that has both her and my name on it as it is issued by my employer!

    Question for you guys, The packet was recieved by them on Wednesday according to USPS tracking, Do we know approximately how long before a case number is issued and they send out the NOA-1's as her i-94 will expire at the end of May 05/31/15. Also we are going to try and get a letter from the local USCIS office for a possible 3 day leave to Toronto Canada as my brother is getting married on May 30, and both my wife and myself are co-sponsorer's (financially) for his wedding reception, Dont know what the chances of getting the approval are for that but lets see!

    Trust me, you are not alone! I am going to have my friend who is an immigration attorney take a look at the entire packet before I send it out! So lets see where this goes. Seems like there isnt very much action in this thread compared to what we had for the NOA2 thread for TSC june filers previously!

Guys, I used my parents along with myself for Affidavit of Support for my now wifes K1 visa as I had only 1 year showing income, Now I have 2 years showing income and 1 year 2012 that I was a student shows no income. As I am sending in the tax returns for 2012, 2013, 2014, do you think I need my parents as Affidativt of Support again for AOS? or my two years worth of income is good enough? what are your thoughts on it?

    Also, My fiance has a sealed copy of her medical record form from the consulate in frankfurt that she recieved with the visa packet that she cannot open, does she still need to do the DS-3025 vaccination document sheet or will sending out that envelop suffice with the I-485?
