  1. Hello everyone,

    I just noticed made an error on the DS-260. The ones where it was asking for the address in the states where I will live. Well, int he line where it says " Name of person currently living at address" - Instead of placing the name, I wrote the address in the US whee I will be intending to live.

    What will I do?

    Also, when I tried to go back to the CEAC, I didn't know how i ended up being in the ds 261 section :( I thought I was reviewing the ds 260. Will this affect my timeline or my visa process?

  2. The ine that process the annotated narriage contract is the main office (civil registration department) located at time street cor. West edsa. If the annotated marriage contrat is already in their database then you can secure the document at any nso offices

  3. I only paid 80k to my annullment thats why i need to work for it...

    After the court of clerk signed the finality...the part of my attorney in my case were done...

    mine was part of the package. MY annulment so far was fast too, it was just the NSOwho messed things up not doing their work right.

    In my case, after the annulment was finalized by the court, my attorney registered it at the Civil Registrar where I was annuled, I have to pay a fee for that. Then I was instructed by my attorney to have it registered at the Civil Registar where I got married ( another fee. The Civil Registrar will then forward it to the NSO, give you instruction and estimate when NSO will recieve the document, and to follow it up with the NSO if the annotated marriage contract was already in their data base.

    EDIT: ( Sorry for my poor memory ) In my experience, I brought the documents issued by the court to the Civil Registrar to the civil registrar where my marriage took place. Paid the fee there, the Civil Registrar processed it and ask me to come back few week, after. When I came back, they handed me a sealed envelop, gave me instruction where to send it and to mail it through registered mail. To keep track as to when NSO officially receive the document. The civil registrar give me the estimate as to when my Marriage contract will be annotated and possibly be entered in the NSO database. When the I reached the estimated time, I followed it up at the local NSO and see if my annotated Marriage contract is already available.

Aftr waiting 21 days i got my authenticated annoted marriage certificate from nso...then since i dont have anymore time.. the next morning i went to our nso in our ptovince to get my cenomar..its actually cemar for those who got married..but they calling it cenomar..waited less than 3hours then i got it....

    You should go to main nso for processing your annotated marriage cert...

    I do not think you should really go to the Main NSO ...the civil registar will hand you the document needed by NSO for processing of the annotated marriage contract ( if you live far away ) you can mail the document ( the civil registar will hand it to you and it is sealed - they will instruct you where to send, whom to send it, and instruct you to send it through register mail so you know that it is recieved and they will instruct you when to start following up with the local NSO close to where you live and see if the Marriage contract is already annotated. You can secure the annotated marriage contract if it is already in the database in the local NSO close to were you live.

  6. Based on my experience this is what i did..forgive my english as im not really fluent speaking it...

    After i got my finality and decision i asks the court to give me copies i think i made five 10 pesos per page...coz they need to sign each page making it valid copies... Then the court told me to go to registrar to where the decision has been made..they are the one who will give you the certificate of authenticity... They put stamp on the finality and court decision again... Aftr that they will tell you to go to the registrar where the marriage recorded... By the way theres also my marriage certificate with me going to that second registrar... They are the one who will type the annotation of null and void thats my case at the right side of certificate... Then after that they are the one who will give a letter for NSO..Its like a request to annotate that certain certificate... You need to bring all of that.. finality court decision marriage cert with type annotation and the letter... Just bring all the annulment documents..rather be prepare than not... I paid like less than 500 then waited 21days...thats it... We just send a copy of finality and court decison in our k1 application then approved in 37days...yay...i remember everything..

    In my case, I ddn't experience this. Everything of that was taken cared by my attorney ( I just gave him tho the fee to have the document registered at the Civil registrar where the Annulment took place). When all were done my attorney sent me those court Documents with a raised Dry seal, signed by the judge and clerk of court - Certificate, Entry of Final Judgement, Decree of Annulment, and Decision.

    My attorney instructed me to bring the document at the Civil registrar where I got married to have it registered. Then the Civil Registar will process. They will tell you to come back when they get the documents processed and as far as I remember, they gave me a sealed envelop which I assume it was the dcument that NSO needs to annotate my Marriage contract. Then I mailed it via certified mail, so I get the tracking number and know when the NSO recieved it. The civil registar will then tell you the estimate when it will possibly the annotated marriage contract will be in the NSO database. I followed it up close to the NSO where I live.

    In my case ( not everybody have trouble with the NSO- hit and miss I think ) I followed it up with my local NSO office ( I live in Leyte ) but it was already taking time ( not the normal time ) and my Annotated Marriage contract was no avail yet in their Database - I was getting frustrated and luckily, the local NSO gave me the ocntact person's number and email in the NSO Manila to directly follow up my case. But then again, it like just going around the bush. So I decided to follow it up myself, only to find out that NSO Manila lost my document - go figure .. theycan not deny they recieved it coz I kept the tracking number. So while I was there, they asked me the copies that the Civil Registar should have sent or made ( luckily I asked the local civil registar to make me another - since before I left manila, the head of the NSO who takes care of the this kind of document emailed me saying there were errors in the document that was sent to them - blah bah ). While I was there, they were not expecting my presence, I asked to see the document, but they can not locate it, so I handed them the document I then have. it only took them a few days to do their job then. Frustrating but this did happen to me.

  7. I'm not from the Philippines and I am not familiar with the process that you had just explained above so I have a few questions to ask you. Firstly, my fiance's anullment has already been registered Local City Civil Registrar where the anullment was granted in court as well as at the Local City Civil Registrar where the previous marriage took place. Here are my questions:

    1. Who will forward the anullment to the NSO?

    3. What is a annotated marriage contract? (I am presuming it is a marriage certificate with something written or stamped on it indicating the the marriage is no longer valid, nullified, and void?)

    It is the Marriage contract when your fiancee got married but with annotation at the upper right hand side saying "PURSUAN TO THE DECISION DATED xxxxxxxxxxx(DATE WHEN MARRIAGE WAS FINALIZED BY THE COURT) RENDERED BY JUDGE ABC D EFGH (THE JUDGE WHO FINALIZED THE ANNULMENT) OG THE REGINAL TRIAL COURT, XXXX JUDICIAL REGION, BRANCH XX, METRO MANILA ( EXAMPLE), UNDER CIVIL CASE NO. XX-XX, THE MARRIAGE OF ( NAME OF HUSBAND ) AND ( NAME OF WIFE ) CELEBRATED ON (DATE OF MARRIAGE) AT ( PLACE OF MARRIAGE) IS HEREBY DECLARED ANNULED ."

    4. At the minimum, exactly what document does the U.S. consulate require the K1 applicant to produce at his/her interview as proof of termination of a previous marriage?

    For the I-129 F we submitted COPIES of the following Document:

    - Document from the Court

    1. Certificate

    2. .Entry of final Judgement

    3. Decree of Annulment

    4. Decision

    -Annotated Marriage Contract

    Interview: Same documents were asked but the ORIGINAL . They sent it back to me through the mail when they sent my visa.

    Also, during the Medical, they will ask to see the Decision( Original- ones from the court). If the reason for annulment is psychological Incapacity against your fiance, she will be made to undergo Pschological test. If it isnot against her, then she is good.

    My fiance does have her COURT DECISION, AMENDED COURT DECISION, AND CERTIFICATE OF FINALITY. I figured that because these are legal documents issued by a court it should be sufficient enough for proof of termination of a previous and/or any previous marriages and if not, then what is?

    Annulment is deemed final when you are able to secure the Annotated Mariage Contract from the NSO. It is up to you and your fiance if you are willing to take the risk and see if the USCIS will accept it this time, but always remember the court document together with the Annotated marriage contract ( original) will be asked during the interview.

    I've read other postings made by other forum members in other threads stating that at their interview, they produced to the U.S. consulate their court decision, some stated they produced their annotated marriage certificated, and some stated they produce their certificate of finality. Taking an educated guess, this sounds like it means that as long as an anullment related document which states that the marriage is nullified and void is sufficient proof for termination of a previous marriage.

    Like what I said, every case is different, there are different consuls who interview applicants. It is again up to you and your fiance if you are willing to take the risk or just get everything done so that when it is asked then you do not have to worry about Administrative Processing or 221 G's.

  8. The submission of the appropriate anullment related documents are sooo confusing to me. You stated that I will need a total of four documents which are:

    No. 1 Anullment

    No. 2 Decision of Anullment

    No. 3 Entry of Judgement

    No. 4 Annotated Marriage Certificate

    My questions:

    Refer to no. 1 and no. 2: Aren't the Anullment and the Decision of Anullment the same thing since the Anullment is also called a "Court Decision? (I'm confused)

    Refer to no. 3: What do you meant by Entry of Judgement? Don't the Anullment already indicate the judgment by stating on it that the marriage has been nullified and void?

    I know what a CENOMAR is (CERTIFICATE OF NO MARRIAGE) but you mentioned I need a CEMAR for my interview (btw I am the Petitioner, you probably meant that the K1 applicant needs to have a CEMAR for the interview) anyway, what is a CEMAR? Did you mean to say a CENOMAR is needed for the interview? I thought a K1 applicant must produce to the USCIS and/or at the time of the interview a CENOMAR "only" if the K1 applicant has "never before" ever been married in which it would be an Annotated Marriage Contract in my fiance's situation.

    This were the documents I got from the court:

    1. Certification

    2. Entry of final Judgement

    3. Decree of Annulment

    4. Decision

    In my own personal experience ( being annulled ), this was what I did:

    1. After the court finalized my annulment they issued me those document coming from the court. My attorney registered it at the Civil Register where annulment took place ( I have to pay a fee for that). Then I personally registered it with the Civil Register where my marriage took place( again another fee). Civil register then forward the document to the NSO. In my personal experience, it took me about 1 year before NSO annotated my marriage contract. (I have to personally go to NSO Office Manila hounding them to do what they need to do since it was taking them long time )

    Annotated Marriage contract - This is the marriage contract that is annotated by the NSO saying that marriage is null and void.

    When we started the I-129, we submitted all this document, just a copy.

    Interview, original of all this document were asked. CEMAR is the annotated marriage contract since your certificate of marriage is then annotated already.

  9. When i filed the k1 visa i attached all the documents coming from the Local Civil Registrar where your fiancee filed her annulment which include the decision,cert of finality and cert of authenticity no rfe got approved after 18days :) Goodluck and Godbless :)

    Always remember tho that the court document has to be registered at the Civil Registrar from where the annulment was filed and where the person got married. After this is done, it will be forwarded to the NSO ( final stage ) unless you want to risk showing at the interview without the Annotated marriage contract then that will be every applicants call. But what if during the interview the Annotated marriage contract is not yet available - or the NSO had not yet released this document and thus this will be asked - this is again something for every applicant to think about. Not every case is the same - so it will be yours to decide if you are willing to take the risk or get everything done before any problem occur. or take the chances that things will go smooth, ad worst is just face whatever problem there is afterwards.   10. My fiance will be submitting proof of termination of any previous marriages. She has received her ANULLMENT (also know as a "COURT DECISION" in the Philippines") followed by an AMENDED COURT DECISION which is still the same decision nullifying and voiding her previous marriage, and a CERTIFICATE OF FINALITY. My question is, is it the AMENDED COURT DECISION that must be submitted only? or does the first COURT DECISION also have to be submitted with the AMENDED COURT DECISION?

    I was annulled too. Way back 2011 , during my interview, they took the document from the court and also the Annotated marriage contract ( all original - it was sent back to me together with my passport when I got my Visa ). The final stage of annulment as far as I understand is when NSO annotate the marriage contract as Null and Void.

    Just got my I-94 last week through electronic copy and it says it will expire on May 30 this year.. The problem is my fiAncee visa was expired.. Do you think I'm still capable to get ssn? And what are the requirements I need to bring? Thank you

    As far as my K1 was concerned. I was given 90 days upon arrival to get married. So on the I-94 it should just be 3 months. so if you arrived 3 months ago like what you said in your previous post, then your I-94 must be expired already 3 months after your POE. - I am just not sure why you said your I-94 will expire on May of this year. Correct me if I am wrong, maybe there's changes on the expiration of the I-94 ( other than the change from paper to electronic ) I am not aware of as opposed to the I-94 when I came here in the US (2011 ).

  12. You won't be able to pay the IV fee or fill out the DS-260 until you've filled out your DS-261 (choice of agent) online (unless you have a lawyer attached to your case). Once the NVC have reviewed and accepted your DS-261 and it has been added to your case file, the IV fee should become available to pay through the payment portal on the CEAC website. It will take some time before the NVC review it, and different users have been quoted anywhere from 20 to 60 days. In our case, it took around 30.

    Once your fee has been paid and you have completed the DS-260, you can email the confirmation page to the beneficiary to print and take to their interview.

    We sent our IV package BEFORE paying the fee as we knew NVC were slow in reviewing the DS-261/generating the IV fee. We included the same bar coded cover sheet generated after paying the AOS fee with a cover letter explaining we were instructed to do so by an NVC operator over the telephone. Hopefully, that will have saved us some time rather than just sitting on the IV package until the fee became available.

    We were done with the AoS thing ( including the DS-261 ) We just submitted the checklist..and in the CEAC portal, the IV fee is already there saying NOT PAID...I assume we can go ahead and pay it already, since the Letter form the NVC says we can pay it already too.

    Step 5 - Submit DS-260

    "The DS-260 replaces the old DS-230. As before, you will still submit the IV package, just without the DS-230. The DS-260 will be done online. It's only available once the IV appears as PAID in the payment portal. Like the DS-261, it'll be on the online forms portal (link in first section).

    • Note: depending on how prepared you are, the DS-260 can take a few hours. You can always save and return, if you wish; it doesn't need to be all done in one sitting. But, it'll take an hour at the least (30 minutes maybe if you're really fast). My suggestion is to have a DS-230 pre-filled out (found here [18]) and that way you can just copy over the answers. This will shave off quite some time if you prepare ahead. But be warned, there are some differences between the DS-230 and DS-260 where the DS-260 asks for more information. You can view screenshots (and thus the differences) here [19] from when it was first released back in 2010. NVC also has a page with DS-260 screenshots (from October 2013) found here [20].

    As with the DS-261, print out the confirmation page at the end. But make sure to bring this one to the interview as NVC states it's required.

    • Note: if needed, yes, the petitioner can file the DS-260 on behalf of the beneficiary. This is very common, especially due to the language barrier and/or no/low internet connection.

    How to answer the vaccinations question: Since there are some people having issues with answering this question, I thought it'd be good to explain it a little further as there's not just one right answer. If you have your vaccinations AND the record to prove it, then just explain that. If you don't have the vaccines and/or the record to show it, then again, just explain that, and add everything will be done at (or before) the medical. People are over-thinking this question when you really shouldn't be. Just answer honestly."

  14. We're already done with the AOS ( we received checklist but sent the NVC the docs they need )

    In my understanding, I can pay the IV fee correct? As it appears anyway in the CEAC the amount and say NOT PAID. So ones I pay it, Do we have to do the DS 260 first before sending the NVC the IV Packet? As a petitioner, we can do the DS-260 online right? - Is there anything that needs to be printed out DS-260 and sent to the beneficiary?

    I also, read about DS 261 in the VJ http://www.visajourney.com/wiki/index.php/NVC_Process

    In step 5: Submit DS- 260 there's a statement that says "As with the DS-261, print out the confirmation page at the end. But make sure to bring this one to the interview as NVC states it's required."

    Can we do the DS-261 too and just sent the print out to the beneficiary?

  15. thanks again my fiance told me that some got approved without cemar and mc annotated but they provide it on their interviews but some are unlucky got rfe im a little bit confused on what to do coz i want my fiance to be with me asap thank u for answering :)

    Just in my experience....I was annulled too...but to keep everything safe, we waited till I get my Annotated marriage contract from the NSO. Which served us well since it took almost a year for the NSO to do their job ( that is with me personally following it up at their office in Manila - I was from Tacloban City ,Visayas Region ).

    My point is, we do not know the surprises there is ahead, if that 3 months which you said will be met or not ( if she will really get it by then good..if not, then what will you do especially if like my case, it took me almost a year before I finally got it? This are the risk you have to think and if you are willing to gamble and go ahead filing for a K1 visa and just trust that she'll get it in 3 months time.

  16. You think scanning it isn't a good idea?

    This is what we did way back 2011. My fiance made a letter of intent to marry and signed it using pen with blue ink. He then scanned and sent it to me which I later on printed it in colored ink.

  17. I am trying to get the IV packet prepared for our minor children who is in the Philippines. Anyways, my husband, who is the petitioner is ok to send this IV packet right? ( As I think it is from Saylin's guide in VJ Wiki ). My question tho is, I know the cover letter is optional but I think it is nice to have one. in the SIGNATURE part, will it be ok to for my husband to be the ones to sign and have his name there than our minor children? ( The guide in VJ Wki shows that the SIGNATURE is that of beneficiary and so is the address )

  18. I've read this page http://www.visajourn...php/NVC_Process that Saylin made. It is pretty much comprehensive and a great help.

    Just a little clarification tho to make sure of things before sending of the AoS packet, in Step 4 it says "Don't forget, it's highly recommended you write your case number on the top right of ALL documents (except the bar-coded cover sheet and the cover letter). This is in case NVC misplaces one of your documents. If it has the case number written on it, it has a much better chance of being reunited with the case."

    Question: Does this include the I-864 Form? Do I have to write down the case number too?
