  1. You CANNOT use the K1 visa, the K1 visa is one only entry and it becomes extinct once you have used it. You are in AOS, have you received your EAD/AP card? The AP is what you have to come and go with!! What I did was I took a copy of our marriage certificate and the letter to acknowledge I had filed for AOS and was currently waiting for my GC. I also obviously took my EAD/AP card. That is all you need, they didn't look at my marriage cert or my 1-485 noa 1. It is not risky if you have your AP card that is the whole purpose of it!

Thank you Shell20. On the I-131 form it mentions it should be used for medical emergency, studies and business. So I was hesitant on using it for a holiday.

Sorry I'm new here, how do I get my timeline to show on the bottom when I reply, like some others?

You must have your passport and unexpired combo card or separate AP document to re-enter the country. I've heard of some airlines causing difficulty when boarding as they are not all familiar with these documents. I traveled with British Airways and had no problems but heard of someone who had real problems boarding the flight, although they did get on.

I'd arm yourself with pages 1 and 44 of the following document just in case you have any problems with your airline:

By the way, the first time you use your advance parole you will be sent to secondary inspection as a matter of routine. They will put an advance parole stamp in your passport that will be valid for a year. You won't need to go to secondary for subsequent trips as long as the stamp is still valid, or that's the theory.

Thanks Derwood, that is very useful.

  2. Good morning you all!

Shell 20, when you re-entered US with the AP did you need to provide any other documents beside the AP card and your passport? People keep telling me it is risky.

My husband told me he did research and the K-1 visa was the best way to go.....if only I knew that it could mean endless waiting. >.<

Your timelines are freaking me out, can't believe some of you have been waiting over a year! Ridiculous!

  3. Hi,

I'm in NC, on Mar 5, 2015 I received the letter about the potential interview waiver and the approx. 6 months delay.....that really worried me I thought it was something to do with the funding of the DHS that's been on the news recently, then I found this forum.

What's strange is my friend (living 10mins from me) filed for AOS just a week before me and received her GC late Feb 2015, it only took her a little more than 4 months. She was originally on a tourist visa to visit her bf, overstayed a year, got married and then applied for AOS through a lawyer. How come I started way earlier than her, followed the correct steps, yet receive notice for a 6 months delay? Really doesn't make any sense to me.

I was wondering, if I have AP and leave the country for vacation will that be a problem? I'm not sure if the AP can only be used for emergency, studies or work.

In case my case is forgotten, how do you get in contact with the department/person actually handling the case? I've read about incidences where people spoke to a higher level officer or could expedite their case. When I call I can only reach people who are repeating exactly the same case status that I have access to online already and it can be a 30min wait to actually speak to a person.

I'd greatly appreciate any insight on this!! :)

Sept 2013 applied for K1 in Hong Kong

    Oct 2014 filed for AOS

Mid Feb 2015 received my EA and AP combo card

  4. Hi,

I filed for AOS from K-1 visa early Oct 2014. I did my biometrics in mid Jan 2015 and received my EA card in mid-Feb 2015. Today I got a letter from USCIS stating my application is a potential interview waiver case (that I was kinda expecting) and that my case would be delayed for approximately 6 months due to workload factors not related to my case.

My friend who overstayed and got married filed her I-485 a week before me and received her green card two weeks ago.

I find it strange that there is to be a 6 months delay on my case, when I most likely don't need an interview. I'm speculating it has to do with the funding of the Department of Homeland Security. Did anyone else receive a similar notice? Is this normal? I'm not sure if I should go to the closet USCIS office to inquire further.

  5. Hi,

I came to the US on a K-1 visa and filed for AOS on Oct 15th. I received a letter requesting further information from the USCIS on Oct 29th and sent it. Then I received the following update.

On November 14, 2014, we received your response to our Request for Evidence for your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, Receipt Number MSC1590083170. Our National Benefits Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you. You should receive a decision or case update by January 13, 2015, unless fingerprinting or an interview are needed. If you move, go towww.uscis.gov/addresschange to give us your new mailing address.

I'm a little worried because I haven't received the biometrics appointment notification yet, from my research most people receive it within 2 weeks after filing I-485. Is there any chance that they forgot to schedule my biometrics appointment? Should I call USCIS and check? I had issues with the mailman returning my mail so I'm not sure if I was sent but returned, do you receive updates online if a biometrics appointment is scheduled?

I'd appreciate it if anyone can share their experience on this.
