    My status shows :- Administrative Processing.
    So here's my situation :-

     

    Few things to notice in the first place :-

     

    • My sister (living in U.S) is my Agent.
    • My father (living in U.S) is my Petitioner.
    • My brother in law (living in U.S) is my financial sponsor.
    • My sister applied for the immigration for our parents after she was married in the U.S and after our parents reached there, they applied for my immigration to U.S as per the category :- F2A.

     

    So everything was going fine until I had the immigration interview recently at the US embassy Islamabad on 23rd July 2018 for the category: F2-A. Everything went smooth until I went up to the interviewer. He asked me a couple of question which I answered them all and while asking me those questions he was checking my files he had which were submitted by sister to the NVC. Anyways while checking those files he told me that your sponsor filled out the wrong form which was (I-864). So he handed me a white paper saying that this paper shows what document you need to correct/submit so ask your sponsor to fill out the right form and submit it to the embassy in your city and you're all good to go. So upon looking at that paper and I came to know that the form they need is : Form I-864A as there's a cross on the line where it says "Form I-864A between my brother in law and my father. The form which the CO officer showed me was the Form I-864.

     

    Now here comes the part where things get really confusing and messy. When my sister was submitting all the required documents to the NVC, she also submitted the form I-864A (which they are asking for right now) and she didn't submitted the form I-864 and after she submitted that form (I-864A). She got an email from the embassy saying that she didn't provided all the required documents.

    Here I am copy pasting the exact words they said in the email she got from them :-

    So after this she submitted the missing document which was (Form I-864) and after that my case processed further and I got the email for the immigration interview.
    So basically thing is they already had the Form (I-864A) as my sister submitted it in the first place to the NVC.
     
    And now they are saying the same opposite as they are asking for the form (I-864A). I dont get it that why are they asking for it again when they already have it in their records? and if they don't then why did my case proceed further to the point of interview?
     
    One point which needs to be considered is that this form I-864 A would be the contract between my father (my Petitioner) and my brother in law (my Sponsor). So i am confused about "who needs to fill this form" either my petitioner or my sponsor ? because the submitted I-864 A form was filled by my sponsor and they are asking for it again so do they want that form to be filled by my petitioner ? i am confused....
     
    Also how do I have to submit the form? I mean do I have to send it to the U.S visa services centre near Shaheen Commercial Complex in my city via courier or do I have to take it there by myself? Because on this paper it is written that send the required document to the embassy via courier but on this link here :- http://ustraveldocs.com/pk/pk-niv-documentsubmissioninfo.asp
    It says that you have to go there so I am confused on here as well.

    If you guyz need any information or have any questions then feel free to ask me. I'll provide you as much information as i can that you need in order to help me with this case.

    I know that this post has became quite long and I am sorry about that but I tried to be clear as much I possible could.

    Hi, congratulations, but about oath ceremony! I checked many official and non official sites about oath ceremony , I could not find any for this Friday. May be only for some individuals, as my cousin told  me the same. Though received only 10 year green card. No oath related communications. By the way where your oath is coming up this Feiday? We'r getting worried about her now and thinking why she did not get the oath cerem letter until now ?

That being said, after reviewing of LPR rights ( I created another thread ) it came to my knowledge that you entitled to a hearing with a judge in things go that way. I also think if something is not in proper order with petition then you at least get RFE or interview as a chance to prove your marriage. There is people still waiting for months AND for years like being stuck at background check etc. “Sit and wait” is not an option for everyone.

    If I were you, I will wait the approval of my case before traveling abroad because it will be extremely critical with all kind of difficulties  to handle that situation if the denial letter will be issued and I m not here in USA.

    Hi, My understanding about RFE is that they want to refresh our folders with updated information from our end before they revisit our file and review it to make their final decision about our case.RFE does not mean that the papers previously received by them  are accepted as "good to go".. Actually the final review will be started once the response of the RFE is received by them. Let's see if some other more informative remarks will shine up more sides of this issue.

    Tax transcripts for the yeses not submitted earlier, not tax returns, birth certificate of a birth, new joint house Deed are better additions to the package. Pregnancy certificate is not valuable compare to a live delivery. Good luck.

    Oaltawel , you can make a new Deed for ownership of your house , (I think that is your primary residence) in this Deed you can add the name of your spouse then submit this document to them as a proof of joint ownership of you and your spouse for your primary residence.

    ·         Letter from wife’s doctor verifying her pregnancy and due date.

     

     

    My questions,

    What can I send besides these 4 options (please correct me if I'm going to send wrong documents). 

    1. My son's birth certificate. 
    2. Joint income tax return for 2016 & 2017
    3. My wife is pregnant now, I'm going to as her doctor to write approve of pregnancy. 
    4. Joint homeowner insurance for last 2 years. 

     

    Now, for shared responsibility for a common residence such as leases or mortgage, i paid off my house 3 months ago, and when I bought it my wife wasn't even in the USA so her name never mentioned as ownership besides the homeowner insurance.

     

    What else can I send?

    Hi, please post the third page of the letter you received so we can post our complete remarks, until then, just focus on the letter of REF  VERY SERIOUSLY as this IS THE LAST CHANCE TO SUBMIT THE  documents they want,, like your all marriage documents, birth certificate of your baby born in USA and the financial ties with your spouse in USA. TILL  THAT TAKE GOOD CARE OF YOUR PAPER WORK AND post THE LAST PAGE OF YOUR REF you received. GOOD LUCK.

    Congratulations, at least another step is completed successfully from your end. I have one question through you to all who have any related information about it, and that is, what if some one got a baby and still waiting for her apporaval of I -751,should she report this change in her family to USCIS at this point of time?

    I'm sorry, I don't know much about that aspect.  We live a long ways away from the field office, so we didn't want to come and risk being turned away due to no appointment. 

    We did do an early walk in for his biometrics more than a year ago, but that was at a different facility closer to home.

    Someone else may have a better idea of current rules about appointments.  Good luck!

    Hi, thank you very much for very helpful information. Is it true that they do not see any one without infopaas appointment and walk ins are not allowed for I- 551 stamp pending decision on I-751?

    Had any body seen or experienced that at USCIS office at Los Angels field office, A US national infant( I have 4 months old son) was allowed with their parents with out info pass for him? My understanding is that this infant has nothing to do with their parents immigration issue.He is just accompanying his parents, so still he needs info pass ? Other question is that at the same office as I mentioned above, do they allow walk ins for to get one year stamp on our passport or we have to have appointment for this purpose . ANY BODY , ANY ANSWER RELATED TO THESE ISSUE ???,!!!!!,!,!!

    Thanks for your very helpful information , one more question, through your experience , I noticed that at Los Angeles USCIS Office, you noticed two lanes, one general and other with info pas appointment . Does it mean that if we can not make appointment through info pass, we still can go there for one year extension stamp on our passport by standing in the general line ,go inside the office on our turn after having guard check our documents like, the extension letter issued by USCIS, our passport and government issued I'd etc.and see the immigration officer. Is it true?

Physical GC was taken, but the agent made a copy for us (we have one anyway). We were done and out of there by 8:13am - even earlier than our appointment was supposed to start! If you really need a quick appointment, schedule early and show up even earlier. The agent said CSC is working on September 2016 now... website says October but really, doesn’t matter at this point!     Hi, congratulations, at least you have one year stamp on your passport . I have a question  and that is, what if I have the info pass confirmation and PIN number but don't have print out because I.have a hard time in printing the page, Do you think they will give a little of their time to check the confirmation of my appointment and accept my appointment when I will be there with all the information ?

    You can explain to them in the office and the guard/front desk should be able to print out your appointment notice from their computer.

    But if you want to be safe, just call them to cancel this one then schedule another one.

    Hi, I m facing the same issue. I cancelled the appointment on 7,9 and 13 th of this February just because of this problem and lucky enough I was that today again I got the appointment but the problem persists as same.  I could not down load PDF version or print the appointment letter. I have a concern that this appointment date is just couple days away from the last date of my one year extension letter which is compelling me not to cancel the appointment .The good thing is that I wrote the confirmation and PIN number before try to print it.Do you think they will accept me with confirmation and PIN number to take care of my appointment and let me see the immigration officer for one year extention stamp on my passport if every thing goes well other than this issue?

    Hi, every body, Same problem we have also,even more.....At frist it did not let us print the page and on later time when we tried to put our information to reprint the appointment page it comes on the screen page" There is an issue with your request,please try again". Another thing , lucky we were that we  wrote the confirmation number and the PIN number on a piece of paper and when we put our confirmation number and PIN number on " Rescheduleing frame " on the screen it provides .The information that we have an appointment comes up on the screen page with the time date, name and location also.We don't have time to reschedule the appointment again because just couple days are left from the day of expiring of our letter of one year extention.Actually we came accross with this situation at least three times during this month. 

    Did any body experience this kind of situation ? Any  helpful point will be appreciated.

  20. Actually in many states it is absolutely illegal to marry first cousins. If you are applying for a k-1 and marrying your cousin here in the US you need to make sure it is legal to do so in the state you will marry.

    For k-1 visa ,marring in SOME states in USA it can be difficult / or impossible to get a marriage lisence thought immigration laws have no problem to accept a marriage lisence issued by another state of USA, also if u want to marry a first cousin in USA and your state of residence does not allow it . U can visit ur nearby state where it is allowed to marry ur first cousin.You can happily do so and immigration authorities will accept it !!!!!

They do not like first cousins getting married. It's very much against the social norm. But they will not say anything to people who are first cousins and got married in another country.

    America has freedom like no other. And yes, it is up to people if they want to marry their blood first cousins, that is their progative. I am not judging. (I do personally feel bad for any abnormalties the children may have as a result of this union.) And because of this, there are only a handfull amount of states that allow first cousin marriages by blood.

    Here you can marry whomever you wish, except animals, immediate family (incest),,,,and apparently "aliens" because the Embassy's will try their darn-dest to hold it up in AP. This should be illegal. But LOVE is LOVE and we all should be free to marry whomever we wish... First blood Cousins is a debateable thing...which i don't wish to debate. I'm just sharing the facts.

    Though I have many significant words to share about medical aspects of " first cousin " marriage issues and science, ( I m a medical doctor/ surgeon) and tons of the literature is also available in pros and cons about the topic but indeed here it is not needed.

    What I meant when touching the issue was just for immigration purpose and not more than that. This is my humble wish to let all who r going through the long waiting immigration journey know,that immigration laws have no discrimination against the first cousin marriage . In these days even same sex marriages r also accepted for the Immigration purposes in USA. This is the beauty of freedom of the Great Amarica !!! ..lLastly thank you for understanding.
