  1. It's close...I hope.

They sent us an RFE and we answered, just forgot to check a few boxes. The website updated to say that we should hear back from them by July 31st. When we checked back, it said that they were working on it but the projected date of July 31st had been removed. Odd?

In any case, I know that I'm legally entitled as a Canadian to spend up to 4 months I think in the US. Do you think I can spend the rest of my waiting time with my future husband in the US? I have someone who can check the mail for me...we're just getting really anxious to be together.

  2. It may be a lot better to wait and use your Canadian health benefits for the birth. Doubtful you can buy medical that will cover your pregnancy. As you know, the US medical insurance system is a mess.

You can slow down the process and/or ask for an extension if you're not ready for the interview or activating the K1.

You would need to get your EAD/AP card after you marry and file because the K1 is single entry. Sounds like a bit of a gamble for the bridesmaid trip.

Thanks so much for the info. This is in line with my thinking. I failed l mention that my fiancé already has insurance through his place of employment, and I would just be added to this as his wife. Not sure if that tips the scales in my favour at all?

  3. Here's a doozy: I'm a Canadian in love with an American. We started applying for a K1 visa in September. We've finally just received our NOA2 after submitting a RFE (forgot to check some boxes about my fiancé's (non-existent) criminal history on the I29F. The NOA2 says that we should hear from them by July 31st, but, SURPRISE! I'm pregnant. If I gather all the remaining documents and am there by the fall, will I a) be allowed to enter pregnant, b) be able to acquire medical insurance before I give birth? We intend to elope just as soon as I get there. Bonus: I'm a bridesmaid in a wedding in Jamaica in October, if I enter the U.S. and marry immediately, will I be allowed to cross back into Canada to catch my flight for my trip or should I just forget about that until my status changes? Phew, that's a lot of questions. Thanks for any and all information.

  4. Oops, I accidentally fell in love with a US citizen and we are now engaged. I want to go through the proper avenues and I would like to know what the best and quickest option will be.

I would like to be able to work as soon as I can upon my arrival in the US as my fiancé and I are anxious to buy a home. Some tell me to marry and then just not return to Canada, some tell me to go through the K1 (fiancé) visa process.

He earns around $80,000/year so I think he would be eligible to sponsor me?

Is our best option to get married and apply for a K3 visa? Roughly how long does this take and how much should we expect to spend?

Also, around 13 years ago I was involved in a car accident in which one of my passengers was killed. 3 years later I went to court facing vehicular manslaughter charges but it was dropped and I do not have a criminal record. How will this come into play? Surely I will have to disclose this information somewhere, how do I broach this? Will this affect my eligibility?

I'm sorry about all of these questions, thank you for your patience.
