  1. I'm GC holder currently living in LA, eligible to apply for US citizenship by the end of next year (2017). My fiancé is in Brazil. We are engaged and ready to get married. We are planning a wedding in Brazil in November this year. After marriage, I will go back to the US and he will remain in Brazil. The goal is for us to live together in the US eventually.

    However, upon having done some research, I realized we have two options to achieve this goal.

    1) We get married in Brazil in November. We wait until I become US citizen, after that I will file paperwork to sponsor him to come to America to live with me.

    2) We don't get married yet. We wait until I become US citizen. I sponsor him for his fiancé visa. He comes to America on the fiance visa and we get married within 90 days. After marriage, we will file paperwork to adjust his status so he can get his GC.

    Either way, I think we will be separated for about 1.5-2 years. I travel to visit him maybe 2-3 times each year. He might not be able to get a tourist visa to come visit me in the US since he got absolutely no travel record and he is poor.

    We are trying to figure out which is the best way to go about this. I'm not entirely sure which way is better in terms of less cost, lesser time to wait, if I will be required to come to brazil for interviews, etc (I will come if required, I just want to know so I can prepare myself). If you know better and have any input to help us make the right decision, I'd love to hear.

  2. There will be an interview? It won't be a problem if there is one, I've just never heard of an interview for ROC.

    File it when you have the evidence required. They always take a close look at marriages terminated in the first two years. be prepared with as much documentation as you can muster. I would also consider bringing in my ex with me to the interview. If you two obtain any counseling as part of your continued work on the marriage then bring the treatment notes. I would bring an affidavit from his mother as to the legitimacy of the marriage. For obvious reasons these types of affidavits carry a lot of wweight. You can certainly not file a joint petition, but his assistance and support will be helpful.

  3. Thanks for the replies! So I know that I can file ROC anytime now and I will file a waiver due to a divorce. I will explain what happened in the cover letter.

    I still want to clarify if I should only include evidence during our marriage or is it needed that I include evidence AFTER we divorced (as I've said we got back together so then we have had some stuff in our names after the divorce)? I don't want to send too much or too little. Any advice would be appreciated.

  4. First off, I'm new to this forum but I have been reading a great deal on here. I'm getting ready to file for removal of conditions but running into a few questions that I hope someone with more experience might be able to shred some lights on.

    Quick recap: We got married in the US (I was a F-1 student did not overstay my status), filed for the green card, went to the the interview, pretty much got approved on the spot, got the green card in the mail, everything went super smoothly, we didn't run into any problems, no red flags, our relationship has been truthful from the start. After a year, we filed for divorce, got the final decree shortly after. I moved out to another city several months after that. We kept in touch, he visited me several times, I visited him a few times as well. We decided to get back together. Recently I got my own place and he will be moving in with me very soon. My 2-year green card is to be expired this coming December.

    So here are my questions...

    1) I understand that since I am divorced, I can file for removal of conditions any time, it doesn't have to be within the 90 days preceding the expiration date of my green card. Is that correct?

    2) Can I file jointly with my ex-husband who is also now my boyfriend (again) since obviously I'm with him now? Or do I have to file with a waiver even if we got back together?

    3) About the evidence, do I include a letter explaining what happened since I am guessing our situation might not be common? We don't have much but we do have car title and car insurance. I used to have a bank account with him (that has been canceled), do I include that (but I will write on the paper that this account is inactive). Lease is out of the question because we went to the leasing office and they want to raise my rent 10% for one additional person on the lease! (very greedy in my opinion, my rent is already a fortune since I live in LA).
