  1. When they file, do they need to submit the latest ITR? I kinda have the same dilemma. My fiancee did not meet the poverty guidelines this year but should be good to go next year. Do we have to wait for 2015 tax return or can we show the embassy paystubs, certificate of employment that would show she is fulltime and earning above poverty guidelines with bank letter on her savings account. Your thoughts? :)

  2. Hi VJ!

I was thinking if any of you is/was in the same situation with my fiancee and I.

My fiancee is currently unemployed but worked part-time for 2 mos this year (August to September 2014). She has been long unemployed and has been living under her dad's roof - meaning, her dad has been providing for her (until now) her basic needs. When we met, that's when she decided she wants to work and be independent so we could be together and worked only 2 months to finance her vacation when she visited me here in the Philippines for 2 months.

So our question is, when she files for her 2014 tax return, the ITR for 2014 is close to none. The thing is, we want to start K1 as soon as she gets a job as she plans to find one ASAP when she gets back to the US this December. What are our chances?

Will we be denied since our 2014 ITR isn't really sufficient? Or can we do something about it if we show them the following:

Insufficient 2014 ITR, current paystubs (future 2015 job), Certificate of Employment with specified monthly salary on it, bank statement?

Since she will still be living with her dad until everything is complete, all her salary will be put to her savings as she is not paying any rent, mortgage, etc.

Is this possible? Or do we really need to wait for 2015's ITR which means we have to file on 2016 the earliest?

I appreciate anyone's response on this inquiry.

    Thank you so much!

  3. My fiance and I just need some assistance on the entire process. Although I know it is available in the website, it's still different to talk with someone who really has tried the entire process.

My fiance (sponsor) will visit here in October and she will stay for almost 2 months. Is there anything we can process while she is here? Do we need to have that financial proof as early as now? Or is this something we can provide later on?

Will W-2 be sufficient? A copy of contract showing Annual Salary?

And there should be no other steps for same sex application right?

Your inputs on this is greatly appreciated!

    Thanks,

    Van

  4. Regarding the financial requirements for the K1 fiance visa, do applicants meet the financial requirements for the K1 fiance visa if they can prove a combined annual income of $18,912, even when they may be using their earnings to cover their living expenses? Or are applicants required to have a specific amount of savings, and assets, in order to meet the financial requirements? Can you please tell me what the exact financial requirements that applicants must prove, are? Can applicants combine their assets, jointly, in order to meet the financial requirements? Or is the USA sponsor required to meet all of the financial requirements, without any financial contribution from the non-USA foreign fiance? Can you please explain to me the exact financial requirements for a K1 fiance visa, as it pertains to each party of the engaged couple? THANK YOU VERY, VERY MUCH!
