  1. Guys,

    Please suggest me with this. My mom is with me here and she came in month of May and as I was expecting my interview in July or August but unfortunately as it got late by a month. My mom has a return flight on 7th Sep 15 and my interview is scheduled on 01 Sep 15.

    So, can anybody tell me that how long does it take to print the visa after the interview and how soon I can pick up my passport?? Can I book the tickets for 7th Sep 15 or should I book 10 days after the interview i.e. 10 Sep 15 or onwards??

    Any advice.

    It is not advisable to book tickets before getting the visa. But I would suggest you dont make your tickets but wait till 5th Sept for your Passport with Visa, and then reschedule your moms flight by few days as per your need.

    My brother was on F1 and then H1 for total 7 yrs and he came to India to give the GC interview, still his approval took about 3 Months after the Interview, so he had to keep on rescheduling the tickets 3 times by one month every time and lose money. But you never know the delay it can be more or less.

  2. You can POE whereever you want, and also change your address if needed.

    The law states the petitioner needs to be domiciled in the USA on or before the date you arrive. That doesn't mean he needs to be inside the USA on the exact date you arrive- travel is allowed- but if he has been outside the USA for some time, you may be asked for proof that he still lives in the US (tax filings as a resident, lease or ownership of home, job he will go back to etc). It sounds like they were already suspicious about this issue at the interview, as they asked about your father and how long he will stay abroad. This means there is a high likelyhood they will check up on this when you arrive in the US or shortly after. How much longer does your father intend to stay abroad? Visas are usually good for 6 months, it might be easier and safer for you to simply wait and travel to the US when he is ready.

    Regarding the suspicious thing, it is not about being suspicious. It is a natural and standard question to ask about the petitioner. They will get to know where he is by click of a button about his travel history to the USA. I told that he plans to go to the US after 3-4 months.

  3. I am asking about the law or guidelines about this, If I can go to the US alone ?

    Are there any one with similar case like mine, can you share your experiences ?

    One more question I have is, I have written one NY address for my Green Card delivery, it is my siblings address. However I would like to do POE at my friends place CA live there for a short period like 1-2 weeks and return back to my home country. I have however not made plans where I have to stay on long term later.

    Is it ok to do Port of Entry at another city than mentioned in the forms etc, is there any law / rule / Guidelines as such related to this matter ?

  4. How long has your father been abroad?

    Is he domiciled in the USA (does he have a home there, job waiting for him, how does he file his taxes etc)?

    How long does the law allows for him to be out side the country, he is a US citizen ?

    He has filed for his latest taxes, which were seen by the Officer at the Interview before approving the visa.

    I told the Interview Officer that my dad is in home country and has come for some personal reasons, currently is not on a job. And also he will go back after few months when the weather is better.

    But neither did the Interview Officer told me anything about a condition to travel along with the petitioner back to the US nor I got any other communication indicating the same. So I dont want to spend unnecessarily on tickets and stay in both the cases ?

    Dad wants to stay for some more months, hence I will have to travel alone to US for a short visit. Is that ok as per immigration policies etc ?

    Do Advice ?

    Also can someone redirect me to any online resources / links related to this topic would be great ?

    I am a applicant for family based immigration (unmarried sons & daughters of US citizens over 21). Have received my passport with immigrant visa after the Immigrant interview. However my petitioner father is still in India and wants to go back to US after few months.

    But I would like to go visit US once after a week for 5-10 days atleast, my brothers are in the US on H1 visas. Can I travel alone to US and visit my brothers or friends now ?

  6. Have you tried emailing US embassy in your home country?

    (Uscis in particular) and ask for the procedure on how to opt out?

    Btw is there a uscis in your home country? Bec. im not sure if all us embassies had uscis office..

    What i did here is that i emailed USCIS and ask them how and what are the requirements to be submitted.

    I didn't personally inquire in the embassy. Then i just mail the necessary documents and that's it after a month i received the notice of approval.. Btw they only use ordinary or regular mail so maybe its also a reason why it took a month to received their response.

    Maybe the person you spoke with doesn't handle anything about cspa, he/she should refer you to the right dept.

    1) To whom did you email, can you share the mail Id ?

    2) Later to which address did you mail your documents ?

    3) How much time does it take for approval, once it reaches the Home country USCIS ?

    4) And then after approval, how much time it takes by NVC to effectively change the category to F2B, and treat the case as F2B ?

    Can you please share your experiences on how things happen, the order and the delays, to you or other fillipinos.

    My brother's priority date is JULY 31, 2007, I called NVC yesterday and case was completed last Thursday, now waiting for interview letter until priority date is current. Visa bulletin for the month of August is showing JUL.1 2007, so I am guessing to hear from NVC on or before September. :innocent:

    I am pretty confident that the next F2B PD will jump to 14Aug 2007, so he may be getting the Interview Letter soon, try calling the nvc after a week if you dont get the IL in the meanwhile.

  8. HI! My name is april from the Philippines and my priority date is 12MARCH2010 with preference category of F2B.

    The Consulate sent me a letter last September 2010 regarding my Case number.

    I would like to ask because i just saw in the US consulate website regarding the ff:

    One Year Contact Requirement

    After you receive notification that the NVC is processing your case, you must contact them at least once a year. If you do not contact the NVC for one year, all documents and fees on your case will expire and you must resubmit them to resume processing.

    If my parents wasn't able to follow up then that means that my petition is now invalid.?

    attached is the NVC's message when i checked my case status, what does it mean literally.?

    It really makes me sad. can anyone please help me with this.

    I am currently living and working in Dubai would it be possible to forward my petition from the philippines to here.?

    Dont get disheartened, Just email the NVC right away once for some query, that should be fine.

    Just in case you didnt contact NVC for more than 1 year before your case was completed, then they will ask you to pay the fee and submit the documents again, however your application will be active and processed as usual after submitting the docs and fees.

    I have a question, the country my parents petitioned me is Philippines my priority date is March2010, i am now currently working in Dubai, UAE, I would like to ask if it is possible to forward my petition here in UAE..?? will it be faster since there is less people filing for immigrant petition from here than Philippines right..??

    It only takes into account country where you have citizenship or something like that.. if you are in some other country as a visitor/work permit it doesnt take you out of the Phil queue. However you can take your interview in other countries, but I am not sure of the rules for that.

    The above are as per my limited knowledge, do your own research from authoritative sources too :idea:
