  1. Yeah exactly. They don't communicate much at all. I gave a copy of my short form birth certificate when we filed in the beginning, I called to be sure that was enough. The lady said thats fine. I get to the interview and get told they can't make a decision til I get a long form birth certificate and send a copy. There's an extra month delay right there.

I actually submitted an inquiry that my case was taking too long they just sent me a letter saying that I was sent an RFE on April 23, 2015. Since I received a letter from them in about 3-4 days after inquiring about the case I realize that the other letter must have been lost. So, I just submitted another request online saying my RFE was lost. Hopefully, they will resend the RFE to me in a few days.

Have you tried making an inquiry yet? Maybe they tried to send you something. If I had gotten that RFE on time it would have been about 9-10 weeks post interview so if your letter is not lost they prob are getting ready to send it to you.

  2. You can can make a service request or case inquiry https://egov.uscis.gov/e-Request/Intro.do

  3. i am one of the dv lottery selected from last year .i submit my application on sept 11 and i got my combo card on october .I have not heard anything until now.i got 2 info-pass until now adn i made one more info-pass next thursday.Hopefully i will get result this time .

Okay, I see. Combo card? You mean work permit? How are you able to schedule an infopass, every time I check it says that none are available at this time? What option do you click?

Go to USCIS site and schedule an info pass appointment with you local field office the moment your case gets past 120 days pending post interview. They should be able to give you specifics, try to speak in person with a tier 2 officer there.

Thanks. It is 2 weeks away from being 120 days. I keep trying to setup an info pass appt on the website, and it keeps saying none available at this time...are you familiar with this?

Not quite as long as you but we had our interview in February. Still didn't hear anything at all.

Wow, okay. I wonder what is going on. My friend applied in NY and got her card in 2 weeks. Even if they want to request evidence or ask for something I would at least just like to hear from them.

    Thats a long wait

    Yeah it really is...

  4. I was interviewed a long while now and have gotten nothing, no request for evidence, not even a letter! At the end of my interview, I was told that based on what I had presented she would approve my case. She said she needed to check something and she would send me a letter. But, she never did. Everytime I call USCIS they tell me its still processing. Also, they tell me they have not gotten to my case yet and are processing the first week of August 2014 (I applied first week September). I find this hard to believe. Is anyone else that applied to this field office in a similar position?

  5. Hi everyone,

I just thought I'd post a review of our recent interview in Norflok, Va. for those of you who might have to go through this office for your green card!

From reading reviews of the office, you can notice that several people did not hear the magic "you are approved" but were told instead that they would hear from USCIS soon. I guess some office or IO are different in regards to how they deal with petitioners! Anyways, here's how it went.

We arrived an hour before our appointment. The office was busier than I thought it would be. We first went through a small security check point, had to leave all electronics in the car. Then we went and sat down to wait. We were called at around 9:15 (our appointment was at 9:00). The blond lady that interviewed us was not overly friendly, but very nice. We were told to stand, she swore us in, and then she asked me the questions on the forms (terrorists, prostitute, etc...) This was the only time in the whole interview that her gaze was definitely fixed on me and you could tell she was being the professional that she is! She then confirmed some information with me and Chris (birthday, place of birth, work, adress). She asked to see our evidence next, she looked at it very briefly (bank statements from our joint account, tax transcript from 2010 showing we had file jointly, a letter from the 401K stating me as the beneficiary, a letter from the vet showing we both owned our dog, cards we received with both our names on it, our reception invitation). I gave her a scrapbook of pictures from the time we started dating up to now, maybe 25 photos total. She could not have looked at them quicker! She asked us how we met while looking at the picture, she laughed with us at some comments we made. And then she explained that in two years minus 90 days I would have to apply to remove the conditions of the green card. After that I thought I would hear the "you are approved", but she said that she had seen everything she needed to see and that we would hear from her if she needed further information or anything. We were out by 9:30am.

When we got home soon before noon, I checked my e-mails, and there it was! An e-mail from USCIS that the card production had been ordered. Overall it went very well, I was very nervous but I am happy with the results (obviously). I thought I this interview was a little more stressful than the K-1, maybe because we did not get a definite answer when we were done.

Hope this helps! I'm very glad it's all over for the next two years for us! And good luck to anyone going through the Norfolk office!

Hey, thank you for posting this! Approximately how long did you have to wait to get your interview after everything was submitted?

  6. It is for family unification.

Like I say I have not seen such a case, have you discussed your situation with a Lawyer?

I never got a full on consultation with a lawyer. But, I know a lawyer who works on immigration cases, I called her about it before, she had said that as long as I could prove the stay was temporary (with a job letter, visa etc) that I could still submit around this time.

  7. How does this work when the spouse is residing outside the US?

After all, no foreign spouse can immigrate to the US without the USC spouse.

So, why should an AOS be granted for family reunification. When the USC husband is living abroad?

My spouse is only temporarily residing outside the US. All the while we dated (3.5 years) we were both living in the US. We met in college, and I was already in the US because of school before I met him, after I graduated, I worked for a year and now I am going back to school again this August for grad school.

Page 4, #2 of this document addresses the issue in relation to sponsorship for the affidavit of support, so I assume it has been done before.

  8. Do you mean the I-140 which is for sponsorship of a foreign worker, or the I-130 which is for sponsorship of a foreign spouse?

Regardless, this is not a K-1 visa issue so i am moving this thread to the general immigration forum until the issue of what immigration benefit is being sought is clarified.

I meant the I-130 to sponsor a foreign spouse. I miss-typed. This should actually go under spouse visa process and procedure. Can someone move this for me? I don't know how.

  9. So he intends to fly back for the interview and use his Chinese income to sponsor you to live in the US.

I think we have a situation I have never seen before.

Yes, he will fly back for the interview. my husbands contract ends in September of 2015. At that time he will return to the US and start teaching here, he was kind of forced to take that experience abroad because since he has graduated from Undergrad he has had trouble finding jobs in the area that he interested in and was previously un-employed. During his current internship he is getting valuable teaching experience and also internationally recognized teaching certifications. These are things he will use to get teaching positions in the US upon his return. I don't technically need him to sponsor me financially, but for the purpose of immigration I do have to use him as my sponsor.

  10. Hello, I have been married for approximately 3 months, to my spouse that I had dated for 3 and a half years. I am currently living and working in the US, and will be starting graduate school in a month. I am currently on an F1/OPT. My spouse is currently working at a company in China where he teaches English, his contract will be up in September of 2015. He will be returning to the US then. We have a few questions/concerns as we prepare the the I-140 and I-864.

1)My spouses income for the current tax year reflects what he makes in China. He makes above the poverty line. When he sent in his tax documents, the government did not take that much taxes from him that I can see. He is getting a refund of $16 and did not have to give any money to pay any additional taxes. My friend thinks that this may be problematic, even though the taxes were filed and he was above the poverty line. She thinks that he should have been asked to pay more by the government. She thinks I need a joint sponsor, is this so?

2)What address should I use? He is physically in China and will return in September 2015. I am currently living with family, I will move to an apartment in another state in a month to start school. Can I just use his address in New York as our address?

3)We intend to have the documents sent in next week. I want to go to China to stay with my husband for my Christmas break, is it okay if I leave the US for two weeks to visit my spouse while my application is still being processed (I am saying in the event that I don't have an interview by then).

4)Do I need to have the results of my physical done and sent in at the time everything else is sent in? Will it slow my process down if I send the physical results in maybe a month or two after I submit the application? and how much does this generally cost? I would be doing it in the DMV.
