  1. For anyone needing further info on this:

I called NVC last night and spoke to a very friendly lady who answered all my questions. One was the same as yours. She said to send everything in one package with the cover sheet on top. No need to separate them. Just make sure the items are in the order the cover sheet says.

By the way, did you send an additional cover letter like the wiki suggests?

  2. I'm the sponsor. I moved back to the US to start work in August, but I am using last year as the current tax year so I don't have to wait 8 more weeks for a transcript. I'll bring the newest taxes to the interview.

For Item 19 on the I-864EZ (Federal Income Tax Information), my situation is:

-- Most recent year filed using Foreign Earned Income Exclusion -- have transcript.

-- Second most recent year -- did not file because I made less than the required amount. I have a written explanation of that with that year's tax requirements. I did not receive any W2 from that employer because it was not in the US (as evidence of any income). I also have an official IRS verification of nonfiling.

-- Year before that was in the US, so I filed normally and have the transcript.

    My questions are:

    1. Must I check the box that says "I have filed a Federal tax return for each of the three most recent tax years" if I in truth, have not? I have read that I shouldn't leave boxes blank, but I have also read that I can check it anyway since I'm providing the necessary info even though I didn't file for all three years.

    2. In the line about the year of nonfiling, do I list the low income on the line, even though I did not report it/file? Or do I write "not required to file -- see attached letter"?

Separate question: I read on the NVC Process page that I should fill in the residence address even if it is the same as the mailing address because people have received checklists for leaving this blank. My question is whether to fill it in with the identical address or write "same as mailing address" on the line.

    Thanks in advance!

  3. Hey, I'm facing a similar situation and wondered if you found any answers elsewhere since you posted. What did you end up doing?

My husband and I have lived in Argentina the last 3 years, and I will move to the US for a job that starts in August. I want to file now so I don't waste another month, but that will complicate the change of address situation on the paperwork.

Good luck with your journey and I hope to hear that you found some clear and positive answers.

  4. I am the USC and have lived with my Argentine husband in Argentina for the last 3 years, married last month. I am preparing our I-130 package to send ASAP. I've been offered a job in the States that begins in August.

At the time of filing, my husband and I will both have an Argentine address. Four weeks later, he will move to another apartment here, and I will move to the US. To keep mailing simple, and since I'll be there so soon, my father will be my US point of contact. He will add the payment to my package and send it on to the Chicago Lockbox.

A lawyer advised me to file to Chicago (the correct lockbox for petitions filed from abroad) and include a note for USCIS to use my father's address as my US domicile for the next month before I physically arrive. My USPS address change to that domicile is part of our I-130 package. (I have otherwise maintained bank accounts/taxes/permanent address in the US.)

My question to the VisaJourney community: is this okay? Can I specifically mention my father or just direct them to the address? Should I list the Argentine addresses on the actual forms and just include an extra attachment with the pending change? I'm not doubting the lawyer -- I'm just interested in hearing from people who have faced this issue personally.

Also, I've been reading on these forums to answer another question, but with no luck. Once I move, I need to change our addresses with USCIS, but the website will allow only US>US address changes. I understand that I will need to call them, but I'd like to minimize the confusion and do this correctly the first time. What is the best way to handle a petitioner move to the US between NOA1 and NOA2?

    Thanks! :)
