I did my medical examination around 6 months ago, while I was in the process of getting all the paper work together my husband lost his job and we didn't have an way to prove that he had enough money to support me. We put all the process on hold and now that he has another job we are doing the process over again. My question is for how long the medical examination is valid for? I need to go back to the doctor and to the examination again?

Yes, you need to send the appraisal along with the I-864, and I would list it anyway since the I-864 instructions state you may list the value of your home. Best to list all the assets you have when trying to get it accepted on assets alone. You can list all vehicles except one that works, as stated in the instructions. You need to show that you own all the vehicles and are listing all but one of them.
As far as I have seen, the USCIS adheres to the I-864 instructions when adjudicating for AOS far better than the NVC and COs for a spousal visa.

Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the
owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis
for the owner’s claim of its net cash value.You may include the net value of your home as an asset. The net value of the home is the appraised value of the home,
minus the sum of any and all loans secured by a mortgage, trust deed, or other lien on the home. If you wish to include
the net value of your home, then you must include documentation demonstrating that you own it, a recent appraisal by a
licensed appraiser, and evidence of the amount of any and all loans secured by a mortgage, trust deed, or other lien on the
home. You may not include the net value of an automobile unless you show that you have more than one automobile, and
at least one automobile is not included as an asset. -

My husband and I used only assets. Make sure you can show ownership for some time along with official value. Assets must be three times the poverty guidelines for your household size plus a couple of thousands for good measures.
Thank you for the contact information, my husband just talked with them, unfortunately they could not help us with our official appraisal. But, he gave us another contact that maybe will be able to help us with the metal appraisal.

Here I'm once more. At this time after one of the visajourneys answer our questions about using assets as proof of funds for support since my husband just got fired, we realized that most of our assets will not be able to count as assets (house and 401k) for support. Which was a BIG BUMMER! So my husband said that if we can prove the ownership and value of our bullion, this will be more than enough to show that we have enough money to support our household for a long time without needing to work.
So our question is, somebody knows how to prove the ownership and value of bullion (medals, metal)?

Thank you for taking your time to answer my questions. We are in a difficult time right now, we were with everything almost ready to be filed we are just waiting for the last year tax transcript so we could send our packages to the immigration when my husband lost his job, we can not afford to wait any longer because I need to work to help with our expenses. So we are in a bad place right now. And I'm looking for what we can do and the best way to do it, to avoid been denied.
- House: We just have one home, so, as I understand you correctly, it doesn't count. Which is bad.
But we will appraise it anyway, maybe they accept. This what we hope. In my country we use to say that hope is the last thing to die. So I will keep hoping and doing my best to make this happen.
- Cars: we have proof of ownership of all of them. And get a Kelly blue book will not be that difficult.
- Stocks: I just confirmed with my husband that 20k are stocks nd 40k are related to retirement plans as such as 401k. All of our stocks we have everything to prove ownership and current value. Because we receive reports of it all the time and we can easily access to all this information if is necessary.
- Medals: this will be the hardest one to prove value and ownership, but, I'm really hoping they will accept anyway.
Once more, thank you your response was, by fare, the one that helped me the most.
There are so many questions and my nature that want everything to be as perfect as possible so the denial will not be our answer.

Using assets for the 864 can be difficult and not everyone qualifies. There are specific rules they use to determine if it (the asset you claim) will be allowed. Its not just add up things you have that total 60K.
So for your home- if its your primary residence then forget using it. It wont be allowed. Its considered a hardship to lose your home.
3 cars and 1 bike- Perhaps they will allow 1 of the cars since you are going to be 2 drivers and will each "need" a car/ This Im not sure of because no one really tries to use cars as assets unless they have a car collection of antiques or race cars or something like that. Anyway if you want to try to use the car you would need proof of value like kelly blue book plus proof of ownership.
Stocks- this is commonly used and sometimes allowed and sometimes not. Is it part of a retirement plan? Because sometimes they disallow that as its a hardship. If not then you need proof of ownership, current value etc. Depending on the value they can decide it is not liquid enough OR the value is unstable.
Metals-- Im going to assume its similar to stocks you should have some kind of proof of ownership and value.
You would send everything in with the 864 or RFE. If its an RFE you wont get another chance if denied. If its the initial AOS you will get an RFE.

You are thinking of an expedite but I really do not believe they can get it because of that. Otherwise no. She can move to get away from it may sound hard but immigration is that way.
Luckily K-1 is fast now and not a year wait as when it was at TSC
Thank you for your time correcting me. It was never my intention to recommend anything that was against the law or to put someone in trouble. I was just trying to think the best way to guaranty that she is safe.
And definitely asylum is so much more complicated and definitely she will need a lawyers help to do that.

OP she can come on VWP for 90 days and then go back home when it's time for medical and interview. That really all you can do. Maybe she can move to relatives in another city while the process is going on? (Thinking if she can leave for vacation for a month in the US then work won't be an issue anyway)
Could she go to the US embassy or call them and ask what they recommend her to do? Because is a urgent case where her life is in dangerous? I'm just thinking out loud.

OK. I didn't know was not legal to do what I suggest that was why I said to go and talk to an Immigration Lawyer that could help them better. I was thinking with my Brazilian lawyer mentality. And in Brazil would be perfectly legal to do that once her life is being in dangerous.
So Phillabuster please do not consider my recommendation I don't want to put you guys in any trouble. But, I still think that you need to go to the police department and make sure that they have knowledge about what is happening to her.

As he is unemployed we'll not be able to use his salary or benefits because he doesn't have any. That is why we will just be able to use our assets as proof of funds for support.

First of all, I'm sorry that your fiancee need to pass for all of that.
I don't know if I will be the best person to help you, but, I'll try.
Your fiancee still have a valid tourist visa? If she does, I would advise you to say to her to go to the police and register an occurrence about what she is being suffering, is important that she has some kind of legal proof that she has being harassed (something like police occurrence, affidavits of people that witness what she is going thru, every document that can be used as proof of all this harassment). Is important that every single document are legalized, notarized, and more important that you guys make sure that all documents are valid in the immigration eyes. Maybe would be good to talk to a immigration lawyer and show the documents to him before she come here. Just to make sure that everything is valid and that you can use as proof of your dangerous situation.
If she has a valid tourist visa, If I was in her shoes, I would get in the first airplane and get here in US. When she arrived I would notify the immigration and file a I-130 package and a I-485 to adjust her status.
I'm not sure if I helped you. But, if was me I would do that. Maybe somebody else could help you better than I did.

Hey y'all. Although I'm super happy to announce we have filed our petition, there's a big problem. My fiancee and I are both gay and transgender and my fiancee has been getting harassed for three solid months now. Today, she received a death threat and had to break the bank to call a cab home, she was so scared.
She came to me in tears tonight to tell me about it all and I just. I can't stand seeing her suffer. At this point I care very little about if I have to take out a loan to finish off her fees, but I don't want me bringing her out on a visa waiver in September to mess with any potential interviews. (Would we need a different visa, or would the visa waiver we've used for touristy stuff before work?) Or with her chances of being accepted! We definitely don't plan to do anything stupid like elope or disappear. I just want to give her any break I can from what's going on in her city right now while we wait for the NOAs. If it's not safe for her to come out from a legal standpoint, I'm not willing to endanger her chances of coming her permanently, but man I just. REALLY want to give the poor thing a break for a couple weeks.
Does anyone know how long she has to prepare for the interview when the interview date is delivered, or will we have to send off the copy of the petition to the consulate before they give us an interview date? Because if that's the case then I can just mail it off with her towards the end of her trip, no issue!
If we wait the maximum five months it seems to sometimes take, we're looking at getting our NOA2 (the one where they're like "yes, you can come, but let's get you checked out first") in November.
Basically would me bringing her out for a month's vacation from persecution and death threats interfere at all with the process, or would we be okay to work around our visit? (Honestly it'd be nice to give her her ring as well for strength and maybe extra evidence for the second packet we have to send?)
Sorry to repeatedly bother everyone with our problems but we really could use the advice. My husband just got unemployed while we are filing for Adjustment of Status, but, we have assets that exceed 60k. Which are the best assets to use as proof of funds for support To make the immigration approve our funds? I know we need to have at least 60k. We want to avoid the need of a co-sponsor.
Our household size is 2,
We have:
- a house that is almost paid of (150K in equity, less than 2 years to go)
- 3 cars and one motorcycle all paid of (not sure of value),
- stocks (60k)
- metals (that I'm not sure of the value, I think is around 40k, and I don't know how to prove their value to the immigration either).
We need to declare all our assets? If not which ones are the best as proof of funds?

The best thing to do is to submit an authorization for travel form - I-131 before you go out of the country. After you receive your authorization for travel you should not have any problems.

You should not be worry about that. Every now and then somebody do some sort of error. And when you have an opportunity you just need to clarify that and everything will be ok.

Yes you should. Because every penny that you have will help you with the sponsorship and to prove that you have 125% of the guideline of poverty.

File I-864 list your mother-in-law income there and list her is part of your household.Do not forget to attached the last 3 years of IRS for both of them.

I think the best way to solve this is you and your wife go to a court get a marriage license, and then get married again in front of the judge. Is fast and is not expansive. And will help you to avoid be denied, because you will be legally married in the US. You can always attach your wedding pictures that prove that you did a religious ceremony before.

A letter where she explains her situation will be good. I don't think you need to put a letter from her university. But you can, if you want to. Is a prove that she is a student.
