  1. So I've been reading up on other peoples situations so here is mine, and hoping maybe someone can give us some guidelines. My wife

    is a GC holder, she started the immigartion process in Nov 2014. We made an initial entry into the US on my vacation. I work overseas as

    a contractor. So she was only in the US for 3 weeks than we both came back to Korea as I work here. Now I thought I would be done with my current

    contract before 1 year of her leaving the US in Nov, but turns out it will go longer than that.

    Would I be eligible for the SB-1 visa under these circumstances? I also came up with the idea of having her go to Guam before the 1 year is up to reset the time, but I'm starting

    to believe that isn't a good idea as I haven't heard of anyone doing this. I don't even think this valid.

    If she won't be eligible for the SB-1, I will have to just send her back to the US before Nov. and I will follow in a few months. Has anyone been gone outside the US for close to 1 year and

    than return. Was there any problems at the entry point?

  2. If you petitioned for a wife, then your case is completely different from the OP who petitioned for a fiancée.

    A wife enters the U.S. with an immigrant visa and automatically gets a green card. Your wife was entitled to that status once she entered the U.S.

    A fiancée enters on a non-immigrant visa to marry. After marriage, they must file for AOS for a green card during which time if the foreign spouse leaves without AP, then the case is deemed abandoned. The spouse is not entitled to a green card if she leaves the U.S. without AP.

    Yeah your right, our case is different.

  3. We didn't wait for my wife's green card as we were only there for vacation and for her to make her first entry to start her immigration process. I work overseas so I only took 3 weeks off. UCSIS mailed the green card to my parents address in the US. After we left back overseas, I had my mother send my wife's green card through the mail. No problems at all. The only thing that I wish I could have done, but I just didn't' have time was to get her biometrics done so we can apply for a rentry permit for more than 1 year out of the US.

  4. Revision: we called the Jongno Police Office near Anguk station today and were told that my wife's local police office was misinformed. The certificate they were going to give her was, in fact, the wrong one. We went to the Jongno Police Office and picked it up same day.

    Lesson here: use the Jongno Police Office. They seem to handle these requests a lot and know what they are doing. This is not the case with local police offices.

    Hello, did you already go through the visa interview. Was the KNPC you got from Jongno the correct one?

    I am in the process of getting the KNPC for my spouse, and they told me it would be 1 week as well, but I've read it can take 24 hours.

    So still confused about this.

  5. Hello, I am in the process of getting my spouse to the US. We are in Seoul, Korea.

    I've submitted my I-130 application already and am waiting for it to be approved.

    I am trying to get a headstart on the next step which is Packet 3. It states to bring certified

    copies of a Birth Certificate and Marriage Certificate.

    My question is will we get those certified copies back and when? Thanks.
