  1. It looks like a simple RFE. But the thing is: sometimes they don't change the status online after reviewing the RFE. That's very nerve wracking, I know. But out of the blue they send the interview date as long as with the EAD. USCIS, what can we do?

    Btw, was the translation of your husband's birth certificate made by himself? And did they ask for 2 copies on the RFE? Because it looks like they asked for the evidence only for i-485, and not i-130.

    Thank goodness! We are ready to receive that interview date in the mail! Hope it comes soon!

    The translation we sent was done online via Rev.com as it was the most convenient way for us to get it done. And yes, they only inquired for evidence for the I-485, so only one copy was needed for both the additional birth certificate evidence and I-94.

    So tired of the waiting game, but staying positive!

  2. I had the same issue... But after 80days from my initial filling I called the USCIS office and after 2weeks I got my EAD, and later receive NOA for AOS interview. Which was approved yesterday.

    If I may ask, which office did you call and what is the number? I tried calling the hotline (1-800-375-5283), spoke to a representative, and asked if there was a way to expedite the EAD process as we have had no status changes at all.

    Also, what did you tell them and what, if anything, did you request to get your EAD within 2 weeks after calling? I'd love to hear your response and try to do the same to maybe get some progress on our case!

  3. If I may, what was the RFE for? It may take more time due to the complexity of the RFE

    Ours was for additional evidence regarding my husband's birth certificate. We sent in a copy of the original as well as a certified and notarized translation but apparently it was not sufficient. :angry:

    We had quite a delay in asking his parents to get originals of secondary information straight from Germany (they live there). We were able to get some additional school records that stated his date of birth and his parents names. A few more days to get it translated, certified, and notarized and you can see why it took so long to respond.

    Additionally, we had to send a copy of his I-94. This infuriated me because it clearly stated on the form instructions that no copy of his I-94 was needed as he was filing with ©(9) status. But we sent in a copy of that too as it was requested.

    So all in all, we were asked to send more secondary evidence to confirm the birth certificate requirement and a copy of his I-94.

    As of today, no change in status nor notices in the mail. :angry: :angry: :angry:

We are on a very tight schedule too...but your husband has to stay in the country until he gets his green card...once you apply for adjustment of status...you are technically "out of status" until your green card arrives/approved...if you applied for an AP along with a EAD then once that is approved, your husband can travel outside of the country...but if I were you I would stay put in the US...so there is no letter necessary for him to stay here...he technically has to haha

    Anyone please feel to correct me if I am misinformed... :)

    That is such a relief! I'm sure I read it somewhere, but getting caught up in the process must have made me forget. Thank you so much! We can ease our worries now. We were in the middle of composing contingency plans should August 24 come without us receiving a formal letter in the mail regarding his legal stay. Thank you thank you!

    Now we wait... for our testing date and his EAD!

    Your NOA1 is the prove that you are legal. No matter which visa your are adjusting from, once your application has been received and processed, you are not out of status anymore until the decision is made. The EAD card is also a prove of legal status.

    I am in a similar situation but ive been waiting for almost 2 months now for my i-485 status to change from RFE review...my husband received his EAD approximately 3 weeks after the RFE review, but EAD is separate from the i-485...so i think maybe just try to wait for something in the mail and give it more time...the website is not always up to date like everyone has mentioned on here...probably by the 4th week ull see a change...im not really worrying anymore because I drove myself crazy stressing about it, but there is no point...so if it passes 75 days for the EAD call the USCIS and ask them to expedite ur husband's EAD, but im sure you have nothing to worry about, just being patient is all we can do...stay positive!

    Thanks for the reply! I am just really worried as we are on a tight schedule! This reminds me...Did you get any kind of notice/letter that allows your spouse to stay in the country while waiting for a decision? My husband is allowed to stay in the country 60 days after his OPT expires, which means by August 24, he needs to be out of the country! I doubt we will get a decision before then. :(

    Does anyone know if there is such a letter that allows him to stay?

  6. EAD takes 90 days. It has not yet been 90 days from March 27, the date you filed. Add to that the time the RFE was pending (you took 20 days).

    So 90 days makes around June 27, then add 20 days, to make July 17. Expect the EAD approval by mid-July.

    Thanks for the reply. Yes, I understand that it takes 90 days. I just got worried since others who had RFE delays (some longer than ours!) at least received a notice or status change soon after they sent their RFE response. We have not.

    I will keep your answer in mind, though. :)

    I'm getting pretty worried as we have not had an update yet ever since we sent in our RFE response. :cry:I filed for my husband in March 2014. I am the petitioner and a US Citizen.

    For reference, here is our timeline so far:

    March 18, 2014 - AOS Package Filed [i-485, I-130, I-765] and sent via USPS Priority
    March 24, 2014 - AOS Package Received & Online Case Status Updated to Initial Review

    March 27, 2014 - NOA1 Notices Received for all Forms in Mail

    March 31, 2014 - Received Biometrics Appointment Date in Mail

    April 23, 2014 - Scheduled Biometrics Appointment Completed

    April 29, 2014 - RFE Received for I-485
    May 18, 2014 - RFE Response sent via USPS Express Mail
    May 20, 2014 - Online Case Status Updated to Request For Evidence Response Review and RFE Received

    I am so worried as I see other similar stories who received RFEs and dealt with it, but did NOT see any delay in their EAD processing like we are. We have not received any notices thus far about it being approved nor has the Online Case Status changed for either the I-130 or I-765. Both are still stuck in Initial Review.

    I understand the RFE will delay it a bit, but it's been almost 3 weeks since they have received our response and nothing has changed. Most other couple I have read about with similar timelines usually have a testing interview date by now, as well as an EAD Card in Production. We have nothing. :angry:

    All we want is at least a notice for a testing & interview date or a status change for the EAD!

    Hoping that anyone who has/had any similar delays could chime in so I can assure myself that the delay does not mean anything negative. Thank you all!
